I wouldn't bank on getting much, if anything back. The Spanish legal system has let the directors of Huma get away with our money and no doubt live a life of luxury!!! The Spanish legal system is nothing short of a disgrace.

The appointed administrators have to return to the court in April to present the state of the company after its 12 months of protection from  creditors, having met with them on behalf of Mazarron Country Club Association of Owners and its lawyer on two occasions the last being this week the conclusions are that the company will be liquidated on the instruction of the judge.

The only creditors that will get anything from the debris will be the banks that own the huge number ( and € amount) of mortgages taken out by the company against unsold land and properties.

Those assets will be claimed by the respective banks being the collatoral for the mortgages, mortgaged assets apart there is nothing I can assure you all.

Your only opportunity is to sue the banks who had a legal responsibility to issue a BG for every element of pre-payment you made in respect of any off plan property purchased in Spain.

Maria and her team together with an extremely active and committed British man took on the might of the banks in the now famous Hellin fiasco and won despite not having any BG's ..... it is written into Spanish law that the banks must secure and gaurantee prepayments for off plan property purchases... now go and get after them, even if you have to sacrifice a `portion of the monetary result!

There was a suggestion at one stage that we might get the iva back, presumably from the Spanish goverment. Does anyone know anything about that?

Hello all,

Recent developments suggest that there is a strong chance of getting deposits returned using Ley 57/68.

This involves claiming against the bank which held your deposit and some firms have already won cases on this basis.
