I do not know where there is a hidden pot of money but Milleniun might, after all they had it in the first place!!!

Phil, the figures are useful and interesting. I know there is a process in place which I appreciate but it is cumbersome due to he legal process. I think I may know the company who have been engaged for the debt recovery in the UK, they are very good so we should see an increased rate of recovery.

But I think people must understand, it is no good voting for an owner based administration, even for a temporary period, when so many of our owners are happy to run up huge debts themselves. If ML are not good enough, and I have no loyalty on this as I see it as purely a business decision, then lets see what alternatives we have. Can you provide a list of other companies that are capable of running CDA and who would be any more trustworthy. Send them in an email or PM rather than on an open forum if you have that kind of detail. Thanks.

That's the problem Davell, there is no hidden pot.

The fees are set to cover the items in the budget with a 5% reserve, but in the past we have alway spend to the budget and as debt is running at around 3% there is no money.  The only far things will even get to is if they are budgeted for and a proper reserve built up.

No one is suggesting self administration, yes this has worked at other resorts such a Mar Menor and the CC but at the moment we need the services of a professional administrator.  There are many out there, I'd start by looking at the other Polaris resorts or resorts of a simular size.  The vote at the AGM is not to replace ML with Y, it's to not renew X if the owners are unhappy with them.  We can then spend time choosing a new administrator.  ML could stay on for a temporary period or we could appoint an interim one.  

All the community has to vote on this so it will not be until after the second set of AGM's on dec 1st that the final decision would be know.  At the AGM for La Isla last Saturday it appears that they did have a new admin in mind and I'm told ML only stayed on by a narrow margin.  For me that was not the way to do it, having a separate Admin for a single level 2 would just cause problems and probably increased costs, it has to be a decision taken by the entire resort.

Here's a quick pop quiz.  looking at the info sent out with the call to the AGM, how much money did the community have at the end of 2011?

Just wondering ,

on the proxy form after where it says CONDADO DE ALHAMA there is a gap for us to fill in  , what ? Is it a date ? if so is it the date of the Agm or the date I give my consent to my garden representitive for the proxy ?

Or is it for something else?

Downloaded the proxy form from this site and urge everyone to do the same , do I know the agenda ? no I dont but I DO trust my representitive to use my proxy vote correctly when the time comes , if any one does not trust their rep then find someone you do trust with your vote , its the one thing you definately have control over so get it sorted sooner rather than later , dont use the excuse that you didn't get an email from ML , that reason for not sorting your vote/proxy is now moot .

Having just read the report that was sent to the owners for AGM and one that was sent to the presidents a while back I am confused.

It seems that the answer to your question is about NONE!!!!!!!!!!!!

The money that is owed to us by debtors has been included in the summary as cash we have to pay bills when any fool can see that this money does not exist untill we get it and it comes in in dribs and drabs whilst others get added.

for example the huge debt according to the figures was reduced by a small percentage yet the accounts show it all as a usable assests.

How can you pay a bill with a debt???

so from ML own figs the answer is none

I can imagine very easily the set of accounts and balance sheet you have been provided, regardless of what is said here about MCC we have been through the mill and know what happened to us, or should I say nearly. You don't need to heed someone who is not an owner as I have already stated but at least ensure that what you believe is a good situation really is good and it seems  people that really know are confirming that all is not well and that's a mild way to put it. Ptan said community fee debts are at about 3%, if that is true and I don't think it is then your financial situation is very dire indeed.

Rather I suspect the community fee debt is somewhere around the 30% number and climbing and the expectation of that money coming to the Community any time soon via the normal routes taken by solicitors working for the administrator are slim in the extreme. We have reduced our private owner Comm Fee debt from in excess of 30% to below 5% but not because of the Spanish Court system...it is slow open to abuse and they do not enforce judgements, you still have to chase the money yourself but now you have a court order in your hand that has taken some 2 -3 years to get someone in Northern Europe won't give a damn believe me! You have to get after them in their own country and their own courts which is now posible, easy and without cost to the community...Administrators however (in the main) will not use it, there is one on the costas that does.

I have never advocated self administration for CDA, all I have said is that we had no choice and for us it has been especially fruitful and relatively easy albeit a number of people have put in considerable effort and time to make it work. We will not stay this way forever though as it is hard work.

You can however vote against the re-appiontment of your current administrator and then negotiate a way forward with him or another but your bargaining position will be seriously enhanced if you have a no vote in your pocket and lets be honest are they going to give up a very fat pay packet rather than negotiate a way forward where you are the employer and not just at their mercy.

One writer told me to stop intefering in your business and it was my intention to leave it there but I know first hand the misery that getting it wrong can and for MCC did cause, so forgive me if my advice is seen as interference but if enough of you tell me I will go away.

Ok seems like the only route to go on this is a no vote on the administrators even if it is just to get them to tow the line more. Regarding the budget, if it is in such a poor state and I have to admit I am not clear on that based on the report from ML, should we also be voting to reject that too?

Having read all these comments for days and days, may I ask if all the people with the negative comments to make are actually presidents themselves or putting themselves forward as garden presidents in the upcoming elections, so that they can actually do something about all their worries in how the resort is run. Just wondering.........

you might have to explain those figures as some won't be able to see them through their rose tinted glasses!!   I am insulted that people keep putting on here that there are hidden or personal agenda's, the is no hidden agenda as far as I am concerned but there is one very big bloody personal one and that is to protect my investments and my beloved resort I really can't understand why others don't want the same!! I am really surprised at some posts

I work in finace and I see what you publish and understand it, yet you must be somewhat daft in thinking that everyone understands the docs that you present as unless you study these they are somewhat alien to the majority and before someone hits back with saying I am insulting the majority of residents it's no more than me saying I know nothing about tiling a roof.

Phil, your have increased your activity due to the elections with your group of anti ML, I think you and a select band of others are on a witch hunt for ML and I hope people see through this.

Question for you my old chap, do you think large barking dogs that scare kids is acceptable? Especially when the owner never tells the dog to be quite, is that a true sign of a persons character.

I love dogs, yet if you start to slate others, others may come knocking at your door, remember the Spanish police ain't so friendly to dogs like we are in the UK.

Stick to IT, business and accounts is not your strength.
