This company is criminal. It takes millions of euros from expats and others and does not deliver. Both Almanzora and Mazarron are the same. In my case, the house is finished, I have paid half of it and Huma will not hand it over or return the money, claiming they cannot pay the mortgage and release the house. Yet they are still building on Tabernax. Taking them to court acheives nothing, since, although you win, they never seem to have any  money. Once my court case is over I intend to get m y solicitors to file to force Huma into Bankruptcy. Whilst that will not get my house or money, it will punish them. I have tried, unsuccessfully, to have Huma accused of either theft or fraud, but the Spanish close ranks, even the lawyers. Someone on here suggested freezing Huma's assets. I'll try that, but I know my lawyers will tell me it isn't possible. Tell your friends to stay well clear of Huma; they are a bunch of thieves.

So are you saying that HUMA have completed your house on MCC but have previously mortgaged it and now refusing to complete?  Did you transfer from ACC or were you an original purchaser on MCC?

It maybe worth reposting this on the Oasis forum - and pointing this out to Rowlands and others who think Oasis will be fine.

Hello all,

You certainly aren't alone in your disappointment. Huma Mediterraneo simply have not provided what was promised to investors.

Bank guarantee claims are, however, possible using Ley 57/68 to get your deposits returned.

Put some substance behind what you state.  Claims are always possible but are you aware of any successful claims using Ley 57/68 where the client has received payment despite not having bank guarantees?  I know of cases that have been won but nobody will say definitively that they have received their money back where no guarantee was issued.

Dear 'ILostMySenseOfHuma',

There are more and more cases being won using Ley 57/68 which allow investors' monies to be returned. These cases have set a precedent which means that the our clients' chances of success are high. 

In short, Bank liability can be claimed if the purchaser can provide evidence that the Bank where the account with the deposits in was opened, knew that the account holder was a developer and that money being paid into the account was deposits from purchasers of an off-plan development.

I think the answer to your question in relation to Huma - is simple - No.

I do believe other people on other developements may have got their money back but not against HUMA.

All the solicitors state cases have been won - when pressed have they received their money back they ignore the question and waffle - a bit like politicians really.

This is not to say you shouldn't take action against HUMA on these grounds - that is a personal choice - but if you want to wait until people in the same circumstances as you have their money back then carry on waiting. 

Personally I have used three solicitors so far suing HUMA.  The first two were on the embargo route - waste of time and money - the third one was taking criminal action against the HUMA directors (another total waste of time and money) - this was with a company called CPC !

At the moment I am using a 4th set of solicitors and I am suing the banks.  When choosing my last set of solicitors I went for one that had won cases (even if the monies had not been recived yet).  I just felt I couldn't let HUMA and the banks get away with it - but I am not advising people to do this you have to make your own choice.

Good luck taking the Bank to Court. My Solicitor is taking the Bank to Court any time now. I also have heard of a lot winning the case due to this law . I have not really heard of anyone having their money back, as the Banks appeal and then you hear nothing else.It would be wonderful if people could get their money back as it as been a lot of heart ache all these years.

We agree Ann. All we want is to get victims' monies back and at the moment it seems like using Ley 57/68 is the best route to take.
