HI DIANE

Like you ,myself and wife went to the Oasis site at the end of January and no work was going on .  So thats at least 2 full months no work has been carried out,lets hope you are right and the new builders start work this month.    It sounds  very hopeful if discussions have taken place with the Bank and HUMA  I got the impression while I was there that Carmen was a very straight person to talk to and was willing to give information she had.    I await your next posting

Brian, I am not aware of anyone on here gloating about your (or anyone else's) situation - you seem to think this is some kind of point scoring game - perhaps the sums of money that many people on here are worried about losing is small potatoes as far as you are concerned? 

Perhaps you are embarrassed at your posting history in which you have consistently defended Huma, first Mediterraneo and now Indalo - although I notice a recent change in the mood of your postings, along with the realisation that Huma does not actually give 2 hoots about you or anyone else that has invested in any of their projects. 

You seem to fail to understand that Huma Indalo/Mediterraneo/Cheatingloadofbas*ards (or whatever name they are currently trading under)  is run by the same man, Antonio Subiela and members of his family.  My solicitor has told me that all cases against Huma Med  are being regarded as against Huma as a whole company, which of course includes Indalo. 

After the problems at Mazarron, which have still not been resolved, why would you think that these people will try to make OCC a viable place to own a property?  Even if they manage to get the place built, the infrastructure will probably take a long time to be completed and signed off by the ayuntamiento, if indeed it ever is. 

There are people from the Almanzora site who are still awaiting their money to be returned to them - do you really think that this bodes well for the way in which Huma will treat anyone at OCC?  As I understand it, most buyers on OCC are the poor souls who didn't receive a bank guarantee when they purchased at Almanzora, and were told that they couldn't have their original investment returned to them, but had to "transfer" to the OCC site?  Hmmm, sounds like a really ethical company to me.  Not.

So no, no smileys or sarky comments, unlike yourself.  The rest of us aren't laughing.

Money is money, there is no such thing as small potatoes to anyone and not when you paid the deposit at 1.45 and you can bring it back at  circa 1.08!

 No one is trying to 'point score' just being pragmatic in the worst economic recession since the 30's

If it makes you feel any better, because of the current economic situation it does seem that OTCC will be mothballed or at best re scheduled

I have been told by two lawyers that the Vitalicio Seguros overall guarantee [I have a copy] does give us protection for Manzana 1  for our deposits of 53.000€ , when they are out of contract time or if they go bust plus interest

Not as safe as an individual BG but very much better than still being in ACC with none at all!

Although I have yet to hear a rational reason why an insurance guarantee is not as good as a bank one- Spanish law does allow for either an insurance or a bank guarantee

It may be that BGs are easier to exercise than insurance ones, because the latter are more difficult to deal with  

And you can see from the posts on OTCC forum many want it to go ahead...it does seem that it is only the ACC people who would like it not to!!

I do not see why the success or not of OTCC has any interest to ACC people, who are taking Huma Med to court

With respect, what happens to you is not our business because we are not involved and in the same way what happens to us at OTCC should not be of any ' real time' interest to you!  

So why are you bothering to post on the OTCC forum?

Those of us who did change,have to face the reality that, the world economy has in the last 12 months gone rapidly downhill, and just hope, that Indalo can sort everything out and get a new builder back on site 

Again good luck to you all at ACC and I hope you get your money back soon

Brian, you appear to be incapable of understanding most of what I say, so I'll use big bold lettering for just 2 points, in the hope that it permeates your skull:

OCC IS CONNECTED TO ACC AND MCC - IF YOUR SOLICITOR TELLS YOU DIFFERENTLY THEN PERHAPS HE KNOWS SOMETHING THAT AT LEAST 3 OTHER SOLICITORS WHO ARE INVOLVED IN CASES AGAINST HUMA DON'T KNOW.

PLEASE DON'T KEEP TELLING US TO MIND OUR OWN BUSINESS JUST BECAUSE SOME OF US HAVEN'T PURCHASED AT OCC - IT IS ANYONE'S BUSINESS WHO HAS MONEY INVESTED IN HUMA, AT WHICHEVER SITE THAT MAY BE.

I can understand your defensive posts, you are obviously embarrassed at getting it so dreadfully wrong - you have been incredibly naive, especially considering the fact that you are an estate agent who sells property in Spain, and should really have known better - you were still defending Huma until very recently, which frankly beggars belief.  At least the rest of us have the excuse of being mere buyers with little or no experience of the Spanish property market (although I'm willing to bet we are now all very clued up indeed and would never part with our money until we have cast iron contracts/guarantees)

I certainly wouldn't buy a property via an agent who believes 100% what the developer tells him/her.

I don't know if you have inadvertently led people to buy a Huma property, and are now suffering the consequences.  It certainly isn't good for business is it?  It wouldn't be so bad for you if other properties in Spain are selling, but due to developers like Huma, most people who watch or read the news or have access to the internet are now very wary indeed of buying in Spain.

So perhaps I was wrong about small potatoes.......but at least  if you learn something from the lesson, then maybe any future clients who decide to buy via your company will be better protected against this sort of thing.

Guilty as charged...On ACC, offered MCC and OCC but opted to stay at ACC and keep a weather eye on OCC via the forum.  It's a free world - ask Sr Subiela, he's definitely still free and probably already spent my €80K.

However, I can't wait for OCC to be finished as that would mean money starts rolling into Bank Huma and they can start paying out what they owe!

That dream is still alive at least!

My own biggest mistake was believing the Spanish consumer protection law would protect me.

I would wager  that your OCC insurance backed guarantee is less than legal if it has an expiry date as well!

As an Agent  and a purchaser, do you agree that Huma have acted unlawfully in failing to return monies owed ?

Furthermore,  that any person who is thinking of buying in Spain should avoid doing any business with them whatsoever ?

Hi All

As an ex ACC purchaser i watch these threads hoping that people either get a refund or a build whether it is on ACC, MCC, OTCC.

However you all seem to be taking out your anger on Rowlandsbb.

He is just an agent trying to earn a living.

If you read his advice? on many, many forums he has a voice on every country under the sun. He must be very clever.. or not.. to understand the purchasing legalities, the pitfalls, the bargains it's impossible. He just wants to earn a living.

He does not understand the problems in Spain for goodness sake, so never ask him for advice in Bulgaria or Thailand.

I have bought a property in Egypt and i challenged his advice? when he posted on a forum,after may i add transfering to OTCC, that buying in Egypt is like giving your money away on day one.

We are very happy with our place by the way Brian. When will yours be delivered.

Anyway it's no good venting anger at him.

I feel sorry for everyone left in this mess that should never have happened. I have now read that the banks will not pay out on bg's and they have to be taken to court. Unfortunately it looks like this saga will go on for years.

Good luck to everyone wanting a property on OTCC, I hope your dream comes true one day.

A special good luck to all ex ACC, It has been a rough ride but everyone is hanging on, trying their best to get what they deserve. At this point thats all that can be done.

Ran you're right as usual.

We should stop having a pop at honest people trying to make a living and turn on those crooks who have taken our money, deposited it in bank accounts which by law should have ringfenced the money for building purposes only and then issued a bank guarantee to insure the deposits in the event of the contract not being fulfilled.

I was defending my right to free speech on whatever forum I choose be it Speakers' corner or the OCC EOS forum.

Let's start a thread dedicated to the directors of  Huma and see what creeps out of the woodwork.  I'll start it on the ACC forum!

Forgot to say that we have bought in Northern Cyprus, known as Turkish Republic Of Northern Cyprus.

Much safer and legal than Spain. Have title deeds, building permits and its finished within time.

Happy to pass on details of lawyers, development company etc.

Have just received this e-mail, still cannot get through on the phone to speak with anyone, doesn't seem that it would do any good anyway....

Communicate you that Pilar she is not working any more in huma.

Unfortunately I have to communicate you that in OTCC the work is not start yet, but my boss communicate me that within 1 month and half he will give me any news about when construction will start.

By the moment that I get any news I promise I will let you know.

Seeing as you work for Huma (and dealt with ACC) any news on when Huma will start to pay back deposits, bank guarantees and interest on payments?

Or will Huma continue to ignore court's rulings?

Of course if this is just a wind up, then Ha Ha, very funny.

I think my post has been misunderstood. My husband & I transferred to OTCC we have been trying to contact Huma, Pili or whoever for the last few weeks, to no avail, but I then receved the e-mail from Claudia, the one I copied & pasted. I thought it would be of interest as it seems that yet again, another 6 weeks is to pass before we know if or when the building will restart. Still we cannot get through by telephone. We transferred on 14.2.2008 and our contract runs out (whith the two months grace) on 14.7.2009. The posting below was NOT from Claudia. I do not work for Huma, never have we are just two people who have handed over (stupidly) 129000 euro with no bank guarantees.

No problem, we have got through now, they say the lines were blocked because they we locked in meeting with the new builder!

But they still cant tell us when they will start building, now saying that it will be 6 weeks before they can tell us, then another 6 and another! On ACC it was always 2 weeks!

So Huma were "locked in a meeting with the new builder" Only they could come up with someting like that. I'm thinking more likely they were in a meeting with their solicitors to discuss how best to protect their monetary assets when they file for bankruptcy. Hope I'm wrong on this but it's not looking very bright. I'd be prepared to hang on a little longer if only they could give some hard evidence that this "'deal" with AGLOMERADO LOS SERRANO is really going ahead. Be grateful if anyone could let the forum know any information on this.

looking at the photos ken/pat posted,  the tarifas that are half built at occ,  differ from the photos of half built tafitas at acc.........the acc is built from block/brick...............occ is built from preformed concrete a cheaper and much more problematic way of building............these section build were used on camposol were they have caused many problems, the sections are put together and the gaps are rendered over, at camposol the sections have settled leaving huge cracks and gaps as seen on holiday homes from hell.....read camposol web site about the problems.

surveyor, he said the build is pre-fab the hooks

you can see are for the crain to place the walls

together,   its the cheapest build

and poorest quailty, watch out!!!!

We are going out on Saturday for a week in Retimar and have arranged to see legal advisor/solicitor in Vera on Tuesday next week.

We hopefully will be setting up procedures to pull out.......after 5 years of this we've had enough.

I don't want the property because with the euro at its present rate it's too expensive. If they would sell it to us at the 40% that they have of ours then I would consider it.

I will let people know how I get on.

Well we've bin and now we're back.............................Went out to OTCC and again nothing moved met with Carmen  what a charming lady..............

Saw solicitor on Tuesday.. Called it a day they are firstly issuing HUMA with a notice to issue Bank Guarantee and then they have 30 days to whateva...then we sue them.For money paid interest and fees. Then we get to court and they don't turn up... then they don't pay.

I have to send Soliciotr money to start this though. Which I will do......I might sound peed off but I am.....4 years of dreamin' just gone.

 

Anyway the weather was nice.
