Hi

I know this has been discussed numerous times before on other threads but I am just looking for any information or opinions that anyone may have.

Like most people after getting that call from Polaris back in August telling us completion would be 9 months early we have now finally got to a mortgage offer stage.  The question now is should we complete without the dreaded certificate of habitation?  It has been quite a stressful few months sorting out a mortgage while watching the pound drop like a stone.  Without a plan B in place do we wait for the certificate and risk losing the mortgage offer as the banks situations change daily or go ahead and cross our fingers that it will be issued in the near furture? 

I know it's our decision ultimately but I am just looking for any opinions any of you may have on the matter.

Hi Jo

This is  a real difficult dilema for you, and as you say the end decision can only be made by you. All I can say is that hundreds of apartments have received habitation licenses (ourselves included), so see no reason why you should not get yours eventually.  It is a risk, but possibly an even greater risk is that you do not get a mortgage after your present offer runs out.

Lastly , it may be beyond your control, in that some banks will not complete unless habitation license is in place.  Whatever the outcome, good luck, and when you do complete, it will be worth all the hassle, as we love our little place in the sun!

Most of us completing on Jardines last year were in the same situation.  It is a pain when you go over there to complete - as many of us did - and then be told that the licences were not ready.  We all had differing opinions on this.  Most simply took our lawyers advice and waited but some people, mainly those without the need for mortgages, pressed on.  We all did, indeed, get our habitation licences within a short space of time without any hitches but, as in my own case, some banks simply will not hand over the mortgage cheque until the cert is in place.  I was actually in the notarys office waiting to complete when the lady from the bank with the cheque in hand - literally - said she couldn't issue it without the licence - so that was my decision made for me really.

Ultimately your decision, but we pressed ahead without the Habitation Certificate on the advise of our lawyer who had confirmed that the architect had agreed all was in order with the propperty, it was merely a formality for the paperwork to be done.

2 weeks later we had the Cert of Hab and never regretted our decision.

We advised by solicitor not to complete without cert, but know others have and not regretted it as got cert not long after.But is it worth the gamble?
