I signed up to einforma recently and had a look at Huma's publicly declared financial results.

A few days ago I got an email from them with the title
Hay cambios de solvencia en HUMA-MEDITERRANEO SL.

In English, there are changes to Huma's solvency.

The rest of the email is an invitation to pay €30 for details of the change that has been made to their balance sheet.
Now I don't want to pay any money so I was wondering if anyone on the forum  has access to these details already through their solicitor or their line of work?

I'd be grateful if you could share the details with us.  My suspicion is that the Subiela family have either taken a dividend or posted their 2007 results, in which case I'm really not bothered and I can live with the email's sensational attention grabbing title!

I think the agents should be held to account for what has happened to their ACC clients. I am digging out some of the advertising brochures they sent to us and will post my experiences of trying to get them to take responsibility in a separate post. 

I know I have posted this before, but one of the most important questions we asked our first lawyer was ' where will our money be held until our home is ready'  He assured us that Huma had no access to this money , it is in a separate account . So everyone was clearly telling us lies, because if the bank has the only access to our money, then why can't we get it back ??

I contacted Miguel a couple of days ago by email about the state of things and I got the following reply - it looks like we just have to continue on through a legal route.

Dear Mr. Fozard,


  I am writing from this address as the other one is causing me problems lately. I fully understand your concerns. If Huma becomes insolvent it could obviously be difficult to recover the funds. At this stage we have to wait and continue with the process, and then proceed on one way or another depending on how things go. The fact that Huma goes bankrupt would make things more difficult, but we could study other ways to keep fighting against them, like for example claim a direct responbility from the administrators of the company and make them and their assets respond for the refund of monies. However, it is still early to discuss about this, we will have to see how the process goes.

   With regard to point nº 4 on your e-mail, I must say that I do not remember having said to any client that Huma would not go bankrupt because they had many assets at Mazarron CC. I could have never said so because we are not involved with the MCC and it was not relevant at that and this stage to investigate their assets on that development.

   I understand that these Internet Forums can be very helpful to clients and give them the opportunity to talk to other people in the same situation, but sometimes the information given can be incorrect and can cause misunderstandings. It is always better to check with us first when any client requires information.

Tongue firmly in cheek!

When Miguel says " It is always better to check with us first when any client requires information" is that like the time we enquired if ACC was OK before we parted with any money?

Call me an old cynic (I was a young one when this started!)

As far as I know - Andersons were not involved in purchasing ACC.

They have been used after the event.

What is going on here ??  With respect to you, you must understand that people on this forum are at the end of their rope with this situation. The last thing they need is somone posting in a cryptic manner. If you have something to say , say it. If you are yet another lawyer touting for business, then just come clean !

Sorry to be blunt but I have had enough of people promising to deliver my money, ' it may take a  while'  we have heard all this before.  I have spent 4,500 euros up to now on lawyers who were full of confidence that they could help me, then once they have been paid, don't even bother to reply to my messages.

What infomation do you have that enables you to say that Huma will not complete any of their developments ?

It worries me that you are using the words ' it is probably illegal'.

I personally feel very vulnerable at the moment having been lied to by the very people I should have been able to trust, ie. three solicitors and the bank.  So, if you have any useful information to offer, then please share it with us all  , but please ,  spare us the 'mystery factor'.

I cannot disclose information without jeopardizing the situation / court process.

You may take this as you wish and when  i meant "illegal" it was referrring to according to EYEONSPAIN rules.

I have been considered as SPAM ( assume for using a "getyoumonyback... "email address) and according to the EYEONSPAIN rules i cannot post my real email address so i won't.

My private messages have been disdabled so I can't reply to posts.

I can only wish you all the best.

There is someone out there who is trying very hard to avoid you getting your money back as I  may be jeopardizing other peoples business's.

by the way:

1. I haven't asked for any money; the only money needed wil be to secure the "procurador's" fees (barrister) and only if there is a 99% chance of winning as will be disclosed in due course.

2. Anotojo; No need to be sorry re: your bluntness.  I understand this, I see it every day and this is the only reason i have offered to help. I do not get paid to do this; i actually jeopardise my own situation.

3. The information  I have, cannot be disclosed ... yet and I cannot share anything.. yet.

And  I agree with you with regards to trust; The advice my father gave me was; "trust nobody".

I will try to chat with Justin to enable private messages.
