I usually don't say much here on eye on Spain, but I read every word and as you all know I speak and e-mail with a lot of people. As a lot of you write: this is getting quite a mess. Apart from all the breaking-in issues etc, it just seems time to set a few things straight.
 
First of all: WeTakeCare is MY company. It is in MY name, I own it, I get the earnings, I pay the debts, if someone sues the company they sue ME and I will be held responsible. If the company goes bankrupt (which seems unavoidable at the moment), I will personally go bankrupt. Max does a lot of work for my company, but it's not his. The house in Don Juan is his however and not mine. Therefore I am formally NOT part of the community. We chose this construction very carefully so not to get a conflict of interest and not to jeopardise our house. We have always agreed that if there were ever opinions voiced that Max' vice-presidency and my company would cause a conflict of interest, he would step down immediately and as this is now the case there is no other choice.
 
There seems to be a general idea that we are earning lots of money in Don Juan, and that Max' position as vice-president helped a lot in that. Both things are very untrue, more the oposite. We hardly earn anything, and the main reason (except for the difficult financial time in the whole of Europe) is Max' vice-presidency. The promotor has tried from the first meeting on to break down our company by telling bad stories about us, personally contacting all lawyers and clients and tell them they wouldn't do anything for them as long as they were our client. Luckily we have some very loyal clients/friends who stayed with us nevertheless, but I also have a lot of testemonials from (prospect) clients who decided because of this to work with someone else. I can't blame them, probably in their situation I would have done the same.
 
Besides that, most of you don't seem to realise how much time Max (and all the other members of the board of the community) put into work for the community. UNPAID, I must add because a lot of people think he gets a wage for that. My company suffered a lot from all the work he did for the community, because a starting company needs a lot of time and attention but the community issues somehow always were more pressing, more urgent, more time-consuming. Maybe, once at the beginning, we thought Max' position in the board could be a help PR-wise for the company, but as soon as Nuria started to play up we knew it would be the opposite. We talked about it then for a long time, but he decided -with my consent- to stay on as vice-president because we love this urbanisation, and we like the people in it and want the best for it. Some of you may be a bit sceptical about this statement, but let me tell you that Max has always been in the board of our community in Amsterdam, where his area of work was completely different and could in no way have profitted from it.
 
We have all been through rough times in Don Juan and we're all getting at the end of our patience and understanding and frustration. I DO understand that. I dare say we have suffered even more than most of you. We had to move from rental to rental because the completion got delayed (we moved 6 times in one year, in the end my daughter just asked "where is my bed today mommy?"). Every single time the urbanisation was without water or electrics or whatever, WE were there to experience it, while trying to continue our daily life. So yes, we DO understand your frustration, your worries, your anxiety to get things clear asap. We've always tried to be as friendly as possible, as informative as possible, as helpfull as possible.
 
But very few of you (apologies to those who DO understand and have always been so supportive through e-mail, PM, mail, in person, that is very very much appreciated) understand the strain that is sometimes put on us in our position. We are "in the know" about a lot of things. We speak Spanish. We know most of the people here. We can organise things. While you are here on holiday, we LIVE here and have to deal day in day out with LOTS of people asking questions, airing complaints, demanding things, requesting our help. On all times of the night and the day. While we are sleeping, while we are having dinner, while I am bringing my girl to bed, while I am trying to get my administration done. It is not uncommon to be called out of bed at 4am to explain in Spanish to someones taxi-driver the way to Don Juan. We don't get a dime for all of those things, because these people are no clients,and hardly ever a thank-you. While you were all demanding your English television and becoming sometimes abusive about it, the board of the community was trying to prevent Arrohabitatge from taking over the community and costing us all thousands of euro's. While you were shouting about the blinking pools not being open, or dogmuck on the grass, the board was busy to prevent all our houses from overflooding and/or collapsing. But all we hear is "more that 70% of the community thinks you're doing it wrong". "you're attitude is not right". "You're just making a lot on money out of this."
 
There is a group of people that whenever they are overhere, like to group together and gossip about us. I don't mind that so much as the fact that they choose to always do that right below our balcony so we can hear every word they have to say about us.
 
The ironic thing is this: we are always busy to defend the English-speaking community towards the Spanish residents here. WE shushed down the complaints about Andy's noisy renters. We explain to the Spanish here how important English television is for you and how from your point of view that matters more than the communities' war with Nuria and that's why Max went great lengths to get this deal with Gemsat and saved you all a lot of money (and no, he didn't get anything for making that deal, not even a free setup box). But still people complain and think we are just working on a big scheme to get rich.
 
So here we are. This company will go bankrupt very soon, so we're desperate to find another way to survive, struggling to make end meets at the moment. Yesterday the boiler of the neighbour above us came crashing from the wall and more than fivehundred of litres of water have streamed into our house. My daughters room is completely ruined so once again she has to sleep in another bedroom without her beloved princesses on the wall. And would you believe that even while I was standing there, crying because of the damage in my house, trying to save what I could save, people came to demand some key that I don't even posess because their connection to the Sky-dish is -as they say- more urgent then my overflooding house.
 
This post has gotten far too long already, and I doubt if any of you has come this far. I am not saying this to get your pity or even sympathy. Our troubles are our own and shouldn't concern you. But for a long time now I have wanted to once clarify OUR position here. Perhaps next time there is something to complain about, people could try to remember how very very much time Max puts in the wellbeing of the community and that all the problems you experience here, we experience even more. How big an impact all this has on our lives and that therefore we might not always have the time and patience to explain the same things over and over again to everybody.

We are not evil people, believe it or not we mean well...

Please read the message from Saskia below.
If we want our community tho work out and living in peace together think then after reading the message for at least 10 seconds!

I know Max and Saskia for about a year now and they did a splendid job so far!!
Ofcourse some of you doubt the the double role as VP and running a business but all of us are enjoying now the work they have done in the past and still do.


A big THANK YOU FOR BOTH OF YOU !!!

And remember we are not there yet!
We are still facing a lot of unsolveld problems where Max and Saskia play a very important role to solve these problems.
Talking about, pools, water supply, the eroding walls.
All problems that we cannot fix behind our computers in a different country

I don't see who else is that driven in his role as VP than Max is.
We really need this guy for the community!

I hope that the discussion and accusements will stop because all this wasted energy should in my opinion be turned into a nice holiday feeling in a community that isquiet and peacefull.
Because thats what at least 80% of the buyers bought the property, to relax and get away from the stress during the year.
Why then making stress again about holiday?

Saskia and Max, I really hope you will continue the your fantastic role in the community and I am sure a lot of people share this opinion!!

I think a lot of people have forgotten what a lifeline Max was in the early days when we were all waiting for completion. I know we asked him and Saskia for help and they were the first people we turned to when we first took over our apartment and didn't know the ropes.  We try not to bother him too much now!  (I hope)

But we know from conversations with them both how much they are hassled and that some people seem to think they are paid by the Don Juan community to sort out everything. They are not. Waking people up in the early hours for details for keys is just inconsiderate and rude.

We had a little experience of how this feels a just over a week ago with some rental clients were in a neighbouring apartment. First of all hadn't been given the right keys then got locked out on their balcony, then didn't know how to get a taxi. This was only one couple over a few days but it was quite tiring! 

I think Max, Saskia (and David) are providing an excellent service for us English speaking owners and hope that they will all continue to do so.

A day out of the life of a vice-president.

Yesterday was an easy day. Some renters locked themselves out, the owner was no client of ours, but you can’t leave three small children and their parents without help. So we found a clever solution to get them back in and they were happy. We will send a bill to the owner but don’t expect to be paid for our time as he declined our services earlier and stated he could manage it himself.

At 9 ‘o clock in the evening I got a phone call from Irma from the administration office. Arrohabitatge informed them that the water company will cut us off in a few days as we don’t pay the bills. Nonsense of course as we don’t have to pay the bills from Arrohabitatge AND they claimed in several official documents that they withhold owners money to compensate for the water costs they have to bear. So they are clearly lying, but still it’s a major issue to be cut off in the middle of July. So the request was if I could spearhead a delegation to the town hall of concerned neighbours and member of the committee (as our president was as usual not able to do so).

This morning we visited the town hall. We didn’t have an official appointment but by showing up in numbers we made some presence and got to speak with the responsible bureaucrats for the urban planning. They couldn’t help us as it was it a private issue between a company an us (not true as the whole thing is the result of the provisions the town hall made in the license of primary occupation). We finally got hold of the town councilor in charge of urban planning. She was polite although dismissive. We managed to negotiate a solution in which she agreed to organize a meeting with all parties (including us and Acosol, the water company) before Acosol will cut us off.

After the meeting there was some fall out between the committee members as one of them behaved badly in front of the town councilor. We want to be firm, but not rude and this member crossed that line and damaged our collective interests. It took some time to reconcile the people and find a solution for the next meeting as we don’t want this behaviour repeated.

When this was done I returned to Don Juan to discover that the electricity in all blocks was off. Saskia alerted me to the problem that there were people locked up in elevators. She was stressed as she wanted to keep all the people inside elevators informed but couldn’t do that on her own. Besides the priority seemed to be the three young girls (see chit chat) who where understandably very frightened.  Meanwhile she had to call the maintenance people, the people responsible for the elevators and the electricity company. So she was glad I was back and could do parts of this task. Together with the assembled forces we managed to free all people (with the young girls first of course).

After that we discovered that an unknown person had put on notices on every hallway with the message in Spanish and English that the water would be cut off because we (the committee) didn’t pay. It was not signed, but clearly an attempt from Arrohabitatge to scare the owners, alienate them from the committee and force us to pay. We removed these signs as they were already outdated after our conversation with the town councilor.

Late that night a fierce wind came up and several trees were on the point of breaking. So I went out and tried to tape them to their posts. While doing that the guard informed me that there was a lot of water streaming into the garage of block 10. I had a look, realized it didn’t come from a broken tube in the garage, so I went up the stairs. All apartments directly above the leakage showed water damage so I kept searching. Finally I found the culprit (I was probably wrong but…).  You could hear the streaming water on a second floor apartment and with a flashlight it was apparent it was flooded.

I got hold of the key of the water cabinet and turned off that apartment. No effect at all.

The only explanation could be a leakage in the penthouse floor above it, but for unknown reasons this has no tab in the water cabinet. I consulted another member of the committee (by now it was close to one ‘o clock in the morning) and the decision was made to wake up the president as he is allowed to call in the fireman and break open the doors. He arrived (he had to be waked), consulted with me and together we decided that it was better to turn of the main tab of the whole building as the fireman would be clueless how to solve this difficult plumbing issue. So I was home very, very late.

Did I take some money from the community? No, actually I didn’t even have the time to plan a scheme to do so. Worse I didn’t have time to work for the company we have to live off. The whole day was spent on community issues. And guess what: tomorrow there will be people complaining at my door that they don’t have water in block 10. They will not be happy that we stopped the imminent short-circuiting and possible fires, they won’t be glad that a few people’s apartments were saved from further flooding, no they will complain and by the way tell me I mix my interests with the company of Saskia.

This is the life of a vice-president in a community. Whoever thinks he can do better is free to publically announce his willingness to substitute me. I already said I will stop doing it. Gossiping behind my back is easy, but please try to do my job for just one day before you volunteer.

Hi all,

An amazing amount of supportive messages by e-mail, sms, in person and on the forum convinced me that the majority don’t think there is a problem with me working for a company while being vice-president. These messages were sometimes touching; stories which we never share which paints us as near saints. We are no saints but we are passionate about the Don Juan community and find it difficult to let people suffer if we can be of help. Thanks for all these nice messages: we were touched by it.

It convinced me that hardly anyone thinks there is a conflict of interest so that is no reason to stop my work for the community. The other reason to stop acting (at least in an active sense) as vice-president: time spent where our financial situation should be priority one- is still valid. I decided to keep it up as long as I can. The Don Juan community needs strong leadership as we have major problems. I’m sure that the current committee can function without me, but the interests of and communication with the non-Spanish speakers would be severely hampered if there were only Spanish people on the committee. David Munster is not resident so he can’t join all meetings. As a resident with unfortunately limited Spanish speaking skills I am still acknowledged by the Spanish as ‘one of them’ so I get to hear all the stories and know what really happens in our residential.

It is clear that my role as vice-president sometimes conflicts with our own business interests. It cost a lot of time and apparently feeds negative feelings with some of the English speaking neighbours. I have heard the hearsay. I would charge 1700E for a garden while they only cost 700E and I can do so because I made an exclusive deal with a company as vice president. The reality is that I do have an agreement with the artificial grass supplier as he didn’t want to do the small gardens as they don’t make him enough money. The deal is that he has to do the small gardens in exchange for the right to do the large (corner) ones as well. I didn’t make that agreement as vice-president and everyone is free to negotiate themselves with their supplier of choice. By the way I get a 87E provision on every small garden but in exchange I have to do the marketing, invoicing and measuring. So no 1000E markup and certainly no exclusive deal as vice president.

Another rumour is that I got permission to put up signs promoting my business. Again no such thing. The Don Juan development is full of commercial signs, usually advertising rental of sales. They all use their balconies to do so and we did the same. If it’s decided that you can’t advertise your apartment through billboards on your balcony we will remove them, but so far most people prefer to have that right and show signs with their real estate agents. As we have lots of apartments for sale or rent we could use all the balconies of clients to advertise, but we preferred a low key approach with just one sign as it doesn’t damage the overall look of the community compared to us putting up more than a dozen signs.

There is a group actively opposing me and for some time I thought they were representing a majority so I said I would step down to avoid any possible perceived conflict of interests. By now I know this is a very small minority consisting of no more than 15 people (or less) out of the 208 owners. You can read some of their opinions in their ‘newsletter’ here http://www.carvajal-spain.com/Newsletter%20July%202008.pdf In my view this is splitting our community as this small group doesn’t air their opinions on Eye of Span, nor do they contribute to the general discussions here. Some of the questions raised are easily answered but for reasons unknown to me the author never raised them on EOS. I hope they will return to this forum and seek an active discussion instead of making accusations through a one sided medium.

Anyway, unless there is serious objection I will keep on fulfilling my role as vice-president and do it as good as possible. I attended all meetings of the committee while considering my options so I’m up to speed regarding the actual situation.

We will have an extraordinary meeting in just two weeks time but it is solely related to the lawsuit against Arrobhabitatge so no one has to attend to it. Proxy votes would be great though as the whole exercise is planned to speed up our court case and therefore we need to have an Extraordinary meeting. You just have to say yes or no so there is no need to come over. The latest feasible alternative was end of August and I know flight prices will only be higher than. So in this case proxy voting is key. I will inform you about this and the other issues in a few days time.

Hi Max, Saskia,
Just reading some of the post on EoS.  How bitter and cynical some people are.  You get them in all walks of life.  These are the ones who you see in films, in the event of panic, push women and children out of the way.  Sad but possibly true. 
I don't know you but as a non-resident and just an investor i already feel comfortable that a good couple like yourselves is there.  You sound compassionate about your jobs and committed to the cause of other residents.  Even in the storm of discontent amongst the minority you are steadfast.  That for me and my wife stands for a whole lot.  You and Saskia are the Don Juan rock!  However you also need to live and eat and pay bills and first and foremost be parents to your child, (who our hearts go out to after reading about your flood, what a touching story).
I work for the emergency services and i know all about those who are ungrateful.  But we keep going because we feel that what we do is just.
I say to all those who doubt What Max does, SHAME ON YOU!!  I say to all those who feel they can expect this couple to just put their family life on hold on a residents whim, SHAME ON YOU!!  I say to all who believe that this couple can live on fresh air, SHAME ON YOU!!  I say to those who have never thanked Max and Saskia for their services beyond the call of their duties without payment, VERY VERY SHAME ON YOU!!  Will they continue, YES. Will Saskia continue with her company YES.  Are they making any money from the complex YES and good for them.  Is the competition closing in YES YES.
They are doing a brilliant job a fantastic job with very little return and by all accounts very little praise.
Please Please rally round and support them, support this community.  And for gods sake pay them for the small service this couple provide. I have never met them, i don't even know them but i know of people like them and as far as i am concerned these people are saint for putting up with you and you are all better off for having them and those who defend your rights.

Hi, like most people we probably don't read the posts on EoS enough as we are busy with our own lives. 

We just assume that everything is ticking along and being sorted out. After having read the various posts regarding the "suppposed conflict between Max's role and Saskia's business we felt it was time to air our thoughts. 

 We feel that it is time to offer our thanks and support to Max and especially Saskia.

We have used several of their services since signing for our apartment, they were a "god send" especially in the early days when we had little or no experience of sorting out all the issues that come with buying a property in Spain.

Both Max and Saskia have always been friendly and professional, yes we have paid for jobs to be done, but the advice and patience and understanding has always been free.

Whilst we are living our busy lives trying to pay for our Spanish apartment and going there for holidays, Max and Saskia are living this constant nigtmare of ungratefulness and rumour mongering

We are very grateful for their expertise and for everything they do to benefit the community as a whole, much of which they do not publicise. Max and Saskia are caring people trying to make a living and have a life aswell.

We have not used their company for everything that we needed, but we have used them for the majority of jobs. We have been extremely pleased with their service.

We believe that if you have nothing worthwhile or positive to say then it is best to say nothing at all. 

On that note it is time to sign off - other than to say a huge thank you to both Max and Saskia for everything they do for our community - THANK YOU

Hopefully Max will continue with his role in the community and this will be an end to matter.
