IMHO I think you need to pause and think.

Woodbob - you say you know who they are. I assume you're taking the list from your community AGM notification. Well these are as at December and some people may well have paid since then and you will offend them.

Most of the owners who haven't paid are "absentees" so what good will it do?

Agreed but are you not tired of paying for others fees

Yes, like everyone else I object to funding the non-payers. But taking the law into our own hands is not the solution.

Most of those reponsible for the Entidad and the Communities are not too keen on open public forums.

It is a shame that the Entidad website is not interactive and only P12 of all the communities have an owners website, that is why it is so important for all of us to make our voices known at AGMs if we can attend or by proxy or by contacting both the Presidents and Administrators together so they get a feeling for owners views. However they still have to act within the law.

Unfortunately under HORIZONTAL LAW in Spain, there is very little communities are able to do to recover debts legally which is why so many resorts up and down the Costas suffer the same problem.

I agree with Pommers, whilst not happy to subsidize, there seems little available alternative, some debts may well have been paid recently others could be an administrative error as has happened a few times, many real debtors will rarely visit and are unlikely to see any notices posted they will be quite happy for the debt to be placed against the property as they will redeem the debt IF the property is ever sold, a rather viscious circle, made worse I believe if the banks repossess, I think I am correct in saying they are only responsible for previous two years debts.

Hugh_man - you are totally correct - the banks if they repossess only have to pay 2 years unpaid community fees.

I have tried to put my point of view by emailing my  phase President / Entidad President with my views on high expense lines such as the security services etc. to be told that most owners want the level of security that is being provided.  

 What I have suggested that we as a community buy what we can realistically afford and all the 'ideal and desirable services'  come on stream when people pay up particularly with regard to security and I indeed suggested a way of reducing costs which involved the community buying their own vehicles and then buying in services from a security firm (as opposed to contracting vehicles and personnel from the security firm).  This has been adopted on another exclusive resort (El Valle) and it seems to work.  They inspect every vehicle that enters and the registration plates are recorded.    I have to say this suggestion did not go down very well -  perhaps this was not an intelligent thought on my part - I was only trying to help.

But we have to keep writing to our President and Vocales with our views so they are properly briefed.  Let's face it they have been elected to represent our interests and must take our views into account when making decisions.

Sounds like some very positive and intelligent suggestions to follow up on to me, shame they were not postively received..

Sadly very few votes were cast at the Entidad AGM as Pommers has previously stated and most of those were all in favour of the boards proposals, so either most other owners are happy and there only a few of us whingers on here or Roda owned properties made up a large proportion of quotas cast.

 

At the risk of further criticism I would agree with those that have stated that it is a shame that currently some 400 properties have no direct input into Entidad board meetings, one member  having resigned, one not attending meetings and one Phase not represented directly.

Only when a good proportion of owners find their voice will we have true democracy.

It is your investment and your fees guys, get up and speak.

I as an owner am not in favour of compromising the current level of security, but Sandra if what you say is right, then there may be an alternative way that is more economical. I do feel strongly that your suggestion should be considered and not dismissed as appears to have happened. Surely we as a community should at least be looking at what works in other resorts.

 

I totally agree with you Hugh_man, it is our investments and our fees and owners should certainly get up and speak at their forthcoming AGMs. But take Sandra’s suggestion as an example. If she were to make this proposal at her AGM, then given the feedback she has just received from her President, then the motion would not be carried. The reason being is, the amount of Proxy Votes held by the President and as a result the President commands a veto over anything that is discussed.

 

In this instance the owners of these Proxy Votes may well agree with Sandra but unfortunately if the President does not agree with whatever is being proposed, then the rest of us have no say. Unfortunately this is but one example.
