I too, am totally disgusted by this decision.  Why should we, the people who pay their fees, be penalised by paying extra for those non-payers??

If we do have to pay extra (which I don't think we will be willing to do), do we get our money back with interest?  It makes me sick to the back teeth, especially when I had so much trouble with the tenant above me.  The owner didn't pay his fees so in effect I would be paying extra to allow harassment from a non payer/tenant.  Doesn't make much sense.

What if we can't afford to pay extra??

I truly believe that the decision at the AGM to increase the Entidad fee to accommodate the non-payers, is the first step in the process of writing off the bad debt that these owners have accumulated. I guarantee that at next years Entidad AGM, the Board Members will be advising us that we should be realistic and accept the fact that this problem is here to stay. I will also stick my neck out and say that chances are not one cent of bad debt which is currently owed to us, will have been collected via actions that are currently in the hands of the Spanish court system.

 

Before the Entidad AGM I received emails from the President of my Phase, that say the intervention of the Town Hall in the collection of Endidad bad debt, will be far more rigorous than that which we experience through the normal court system. Well thank God for that !! So if the Town Hall is so good at forcing these owners to pay up, why was the decision made to employ a debt collector at a cost of €27,000 per year?   

 

The fact of the matter is, we are well and truly in the smelly stuff and from the decisions that are being made on our behalf, there doesn’t seem to be very much that we can do about it, other than pay up. I firmly believe that it is time we started to think outside the box on this matter and take action that some may consider to be controversial. For example, if we were to take action to highlight individuals who refuse to pay their debts and these individuals then felt the action was unfair or questioned the legality of our actions, then let them take us to court. We all know how long that would take.

 

I know everyone may not agree with me, but I believe we should take the gloves off and be prepared to try something new. The direction that we are currently heading will cost us more and more, while these individuals just carry on as usual.

I could not agree with some of the sentiments expressed more, however complaining on an open forum is not going to get much response.

Roda has a political democratic structure now run by owners, not the developer and grievances need to be put directly to the Entidad, if we are talking those fees or to the community re their fees either via Housing, the President or your Entidad representative if you are lucky enough to have one, many now don't.

The only small problem is that the only real chance you get to share and air your views is once a year at the AGMs, so make sure your voice is heard.

I would agree, when airing our views we should make sure they are pointed in the right direction. But when a seed is sown, it is difficult to prevent it from growing and from the comments I have read on this forum, it would appear there are a lot of unhappy owners out there. From my perspective I have no qualms about contacting the President or Housing and expressing my opinion on any given subject.

 

Expressing one’s opinion is one thing, having it listened to is another. It has been mentioned we have a democratic system in operation, I’m afraid I must disagree on that one. How undemocratic can it be, when at an AGM a President of a community can hold the majority of owner’s Proxy votes, when these owners have had no indication before hand how their votes will be cast.

 

There are important issues to be dealt with that need all the owners attentions, but not everyone can attend an AGM to have their voice heard. When it comes to matters that are on the Agenda, I believe the Proxy vote should be structured in such a way that would allow owners views to be properly counted. These Proxy voters would then be given the opportunity to express their views through their votes, rather than through one person’s viewpoint.

Can anyone confirm exactly how many properties on Roda are owned by the developer,and how much is outstanding in community fees and what action if any has been taken against them.

Hi - I had a long chat with one of the Speakers yesterday . 

The main thing that came out of the discussion was that if the bad debt chasing results in a substantial inflow of funds to the community then PERHAPS entidad and/or community will reduce in the second half.  I suppose since we are now March that we have to wait and see what happens.

The other thing, which echoes Hugh_man's statement - is that we should put our queries in writing to the Board via the relevant speaker or President representative and that way they will be put forward as topics for discussion at the various meetings.  I had suggested for example that the owners would be appreciative of more regular updates from the Presidents - lot's of what goes on during the year comes as a complete surprise I am sure to lots of owners - after all we elect the officials to represent our interests but also  the feedback has to come back down the line more than once a year I believe.

Yes,  that point was discussed too - but the Speaker said to email any one of them and hopefully the matter would be discussed at the Board meetings.

I havent received a request to pay an extra 2 months. Is this for all communities or just phase 1? Surely if we increase owners fees by 2 months and they can't afford to pay we are increasing the debts and are now talking about taking the good owners who pay their standard community fees to court as they can't afford to bail out the non payers. Does anyone know if anything is in place to ensure this does not happen? We could potentially end up in a worse position.

The increase applies to all owners not just phase 1.

You won't receive a request for the extra money separately, you will just find that your 2nd quarters bill is a tad larger than your forst one.

Has this been agreed or is it going to be discussed at the AGM?  I want the extra money back I pay with interest, this is a joke!  I pay extra and the property owners who don't pay rent out their properties for peanuts and bring down the rental rates.  They need big stickers placed on their doors showing everyone who they are.  Someone give me the stickers and i'll do it!

This is beginning to sound like the benefit system in the UK.... Work all your life and pay your way to fund all the pi**takers and tax dodgers so they can carry on sitting at home supping their special brew while watching Jeremy Kyle.

The chances of us getting these extra payments back are remote.

The increase was agreed at the AGM on 26th February- so you missed it!

Very few people attended or gave their proxy votes to anyone - even though I emailed as many people on Phase 2 apartments as I could I had virtually no response. In total - including all the properties that Roda own there were only about 39% of owners represented. We had 2 additional proxies so our .9% didn't affect much at all - but at least we were there.

I understand that the short notice for the meeting is difficult for a lot of people - but maybe this will encorage more people to attend next year or at least give their proxy to someone they trust.

If you don't vote - you have no voice !!!!!

We haven't been able to go to any meetings but have given our Proxy Vote to someone that is able to attend and we trust.
Our AGM is on 28th March. So I strongly advise owners that are not able to attend to pull their fingers out and find someone to vote for them.
 
Its no good objecting  after the event!!!

ALTHOUGH WE DO NOT HAVE NAMES IM SURE THE NON-PAYING OWNERS PROPERTY NUMBERS ARE ON THE DEBTERS LIST.

STICKERS NEED TO BE PUT ON THE FRONT DOOR + THE SHUTTERS OVERLOOKING POOL ETC.

NOT SURE WHAT THE LEGAL STANCE ON THIS BUT I WOULD BE MORE THAN HAPPY IN HELPING IN ANY WAY POSSIBLE.

    we where at the meeting and it  was the conclusion that if we did not agree the buget that the entity would go bust . so what would yoyu do? are you willing to let this happen? We like you are paying all fees due and are not happy about paying more. But what do we do, if anyone has an answer please let us know.

I hear what you are saying Margaret but with a possible ever increasing fee we will be in danger of the people who ARE paying soon not being able to carry on paying, leading to even more non payers. Its a vicious circle I know!!!!

We all say we want a voice maybe the presidents of the different communities and Entidad should check the transcripts of the forum to see what feelings are.

 

As far as stickers on doors I agree and will do my block i suggest we have a template a3 in size print them off and individuals take a number of blocks to do prit sticks would do.

I am flying over for our phase general meeting next week but cannot do this for both general meetings I will take posters with me and start sticking. How can I be sure we are getting the right units I know the non payers for my community

 

I would be happy to give my proxy to someone who is voting for the best intentions of the owners for the Entidad
