I have read the earlier threads (it would be easier if everybody tried to keep the same thread for the same subject) If what you are saying is correct, then NOBODY should be completing without a habitation licence you are basically agreeing to buy an illigal property, I think this subject needs further clarification and would advice everybody to speak to their solicitors to get the correct picture.

If you have used the solicitor recommended by the agent then they may try and advice you that this is OK but it isn't, so buyer beware!

On completion you must have

Habitation licence

Final De Obra- Final Licence to say the building is completed to the satisfaction of the council planning dept

Bulletin for water (agreement for water contract)

Bulletin for electric  (agreement for electric contract)

without these documents any property is not legal and any good solicitor will advice you of that. There has been cases were builders have tried to bully people into completing without these but that is against the law.

Agree that its vital for everything to be in place etc.  The key thing that is so wrong here is the fact that Peinsa and our agents (Medsea) or solicitors have never mentioned anything about this.  If they were all working 'properly' then the habitation licence wouild have been built in to the revised projected completion dates.  This is basic project managment and they must have known.  It appears as if they just stumble from one thing to another, with inadequate communication back to clients, or planning.  We are buying in Ph5, and the dates of March (ish) 2008, change to Feb 2009 in the briefest of emails from the agents.  They could now end up with buyers pulling out of this project big time.

Hi all,

We totally agree with the comments made by RSTA & KP about the latest delay situation at CDP & also cannot believe the Habitation licence issue has not been factored into the completion dates. We are in Phase 1 & were hoping to be coming out in March/April 08 to complete. We have booked holidays from work,(luckily not the flights yet),as no doubt many others have, based on the latest information & the excellent progress we have seen on site over the past 12 months.

We feel it's about time someone in authority at Peinsa 97 SL, finally let us,the owners, know where we stand. Perhaps Roger could pen another letter to them? Or Amanda Oakley at PSI, who seems to have a contact at Peinsa, may be able to help us?

It's so frustrating to be so close,only to hear another rumour,of yet more potential delays. "Does anyone know the truth about what's happening at CDP?"
