Hi - some info for those whose patience is wearing thin, I purchased a 2 bed aprtment, facing the Golf course before works had even started, but after 4 1/2 years waiting, without any voluntry information I could wait not longer - so I asked for my money back plus interest - another wrangle - No I didnt want to sell - the fees excessive, the market slow - just give me my money - and eventually they paid.

Hoever I do hope those who proceed enjoy their apartments, My wife and I had a dream - it was great while it lasted - we where looking so much to the future but the experience became soured - however we still love the costa and will be back - eep sending the photos - its good to see what we are missing

Hi, can you tell me the procedure you followed to pull out.  Are you getting all your money back?  Our patience has worn thin after almost 5 years and we would really like to pull out and start fresh again with something that is already built and ready to go.

After almost 5 years we were told to expect our money back in 4 monthly payments,starting April 25th.But, an email this morning has completley gutted us ,The solicitor has confirmed that jale has gone bankcrupt.Maybe there is a small chance that we get somthing back ,or is it better to face the horrible truth that 80,000pound has gone,feeling just a little sick to say the least.I dont suppose we are the only ones......

Kate, you need to speak to your lawyer, soon as! There are ways of getting your money back, but it will be a lengthy process...and nothing is guaranteed!

We completed last July and don't regret it for one minute. Yes, it has been frustrating and Jale have let us down but after the AGM in February and the feedback from the EGM in April we are optimistic about the future. Admittedly, the Community is going to have to be responsible for finishing off the landscaping and the areas around the pools. The Community office bearers are already making plans to attend to this and there is a willingness amongst those owners we have met to press on and get the work completed.

There is in reality not a lot of work required and if everyone chips in, adds in a few hundred euros to the Community funds the complex would be well on its way to what we envisaged by this autumn. A lick of paint here, some plants/trees and flowers and some determination is what is needed. If those with outstanding debts paid up we can solve our own problems. Some other developers have encountered similar financial problems but their developments are nowhere near advanced as Fairways which is virtually complete.

We all have our own views and circumstances but in our opinion the answer is not to be resigned to losing our investments but doing what we should to protect them. Optimism and not doom and gloom is required..

Agree with Anne.  There is a different feel to the place since " lying skumbag " Jale no longer run the site. We were at Fairways a couple of weeks ago and we called in the sales office under the pretex of our friends wanting to buy an  appt.  We were given a list of all unsold appts of which there are only 21!  This means that despite all the doom & gloom with Spain in general and particularly the state of the Fairways they have still managed to sell 90% of the apartments!  There is obviously a market for these apartments and if you do complete and then sell you could find yourself much better off because of the exchange rates.  This has to be better than loosing £80,000 deposit!

I do agree that jale has caused a lot of his own problems.And despite all the negative feelings that we had,waiting for completion,we held in there because we wanted the apartment.But at the end of the day after 5years and not in a state of completion we decided to withdraw with the solicitor only too pleased to terminate the sale.Our dreams were shattered.Now he has gone bankcupt not liquidation,we will have to wait longer to get our money back,while he is still trading under a different name.We are hoping to get our money back and if 90% of duquessa fairways is now sold well we shouldnt have a problem.I really do wish everybody all the best and hope evrything turns out well.

I think you will find that Jale have filed for "protection from bankruptcy" because they are asset rich but cash poor.

Obviously, you need to make your own decisions and speak to qualified lawyers about this but please do not quote that they are bankrupt because this is simply not the case.

I share the optimism following the AGM.
