To anyone still waiting for money back from above .I first paid deposit end of 2004. I have been informed via Pilar Alonzo that Cam Bank have agreed to pay all my deposit back . Pilar first contacted me 2014 and I will receive my money in a few weeks tiime. I understand Cam have negotiated with solicitor interest on the deposits as payment for Pilar and her team's hard work. I hope this gives hope .to anyone who was in a similar position to me. I did not have to hand  any money over to solicitor. whoever is assisting you with your claims I am happy to correspond with anyone who has any doubts on this issue. Best of  luck to you all  whoever is assisting you with your claims. This situation should not have happened to anyone in the first place. Regards Mor

THE NIGHTMARE CONTINUES FOR US, 11 YEARS & COUNTING…

We Heard from out solicitor today that Banco Popular have appealed against our court case that was won in February despite the supreme court ruling I keep reading about!  I don’t understand all this Spanish Legal mumbo jumbo anymore unless I’m missing something?  If the Supreme Court decision is absolute, then how can and why have Banco Popular Appealed?

When is the Sentence declared firm and final?  Has anyone else had court case won and had money returned from Banco Popular? We’re completely devastated by this, as we thought we were seeing some light at the end of the tunnel!

As I understand it they can only appeal against the law or procedure being at fault and not the decision from the first instance court.  

Your lawyer will inform you why the appeal has come about, unless they have made some mistake in the law or procedure?  

You should get back the deposit now if the appeal just concerns costs and interest. 

We have asked out solicitor to confirm the grounds of the appeal - the First Instance Sentence did not include legal costs but did include deposit paid plus 6% interest. 

The defendant bank is ordered to pay interest at 6% as agreed in the General Guarantee Policy issued to Huma Mediterraneo dated 12 May 2005.

With regards to legal costs it can be seen in this case that there were doubts in law regarding the liabilities of the Bank according to LEY 57/1968, since both at the Statement of Defence (26 February 2014) & Preliminary Hearing (17 November 2014) the Supreme Court Sentences dated 30 April, 23 September & 21 December 2015, which now definitively clarify this subject, had not been issued.  Therefore, there is no imposition of legal costs”
