This is a report from todays Sur in English newspaper.  Perhaps it is the thin end of the wedge in terms of making adjustments to the PGOU-86 and is another indication that licences will again be granted in the near future.  It also seems increasingly likely that a high percentage of developments irregular to the original plan will be granted legal status by ammendment as opposed to being demolished or otherwise excluded from official plans.

Marbella

The Junta de Andalucía has amended the Marbella 1986 town development plan in a manner which means that 100 building licences which have been pending for several years will be granted and the number of protected buildings in the old quarter will be increased. At the request of the interim committee and business owners associations a report on the situation was carried out six months ago and the amendment means that some construction and reforms to buildings in the old quarter can now go ahead. Building licences will be granted in line with stipulated criteria concerning types of building materials to be used and heights of the buildings and architectural surveys will have to be carried out for every project.

I have just returned to LRdM after having been away.  Regarding the new PGOU 07, I would urge anyone visiting LRdM, to visit the sales office for the development (at the entrance from the main road) where a copy of the proposed (and soon to be agreed) PGOU 07 can be viewed.

Interested parties unable to visit the development can view it online by visiting www.surinenglish.com (edition July 13 - 19)and downloading the paper in PDF format or by visiting www.marbella.es and following the links that jamesyvonne have suggested many times before.

We must now be at a much fatter end of the licence wedge and anyone who suggests that La Reserva de Marbella II will not be granted a licence in the very near future can only be ignoring the evidence, or have a hidden agenda at heart.

We visited the sales office originally when we purchased the property and were told a load of garbagge and that we have licences, everything was all in order etc. etc.  Why go now to the sales office and be told more lies?.  Why are you so certain we will actullay get our licences.  Yes, things are moving forward but not everyone will get them.  I will believe it when I see it and I have that very, very important piece of paper in my hand!

it seems incredible after all this time that the council can't end this now. why not publish the list of who is in and who's not. i know kenny e is very positive but i will not breath a sigh till we see it in black and white.

many people have hidden agena's the sue the developer camp- buy now at all cost's. we love our appartment but are fed up with the mess we are in, when will it end. why should we pay more money with all the empty appartments around or do we get a discount in the future!!

Mayor ángeles Muñoz is eager to get the PGOU 07 town development plan approved as quickly as possible to fill the “legal void” created in the GIL era. The new PGOU plan will be debated at a council meeting this month - two months before the deadline date set by the Junta de Andalucía - when it is expected that it will be intially approved. It could be given the final seal of approval by early 2008. The Mayor also reiterated her stance on the 752 properties and three buildings which under the Junta’s proposal would be demolished. She said that she would defend the interests of the property owners because “the citizens shouldn’t be punished for other people’s mistakes.”

I would have no interest in calling to the LR sales office when I am in Marbella.  In fact I close my eyes everytime I pass it or I put my right hand up to the side of my eyes in case i would get a glance at it.  It does not leave nice memories for me.
Maybe some day they will build a monument on the site ( with a licence) for all of us.
A monument to all the HONEST people who spent their money there, who beleived that what they did was right and that what they were told would be honoured.  Instead --WHAT A MESS.
Posting on the La reserva gate is NOT FOR ME...........TOO LITTLE.........TOO LATE.

If one is unhappy to live in such a beutiful place one can move somewhere else.  Some peoople are never happy.  We for one appreciate what we have and how lucky we are every day.  Moaning isnt going to change anything.  We have been to the town hall and seen the new plan and ALL our development is on it as legal urbanization.

if people are viewing this forum unsure on how to procede, may i say we found the office very helpfull. We were given the keys to our appartment before we completed able to snag list before we completed ( only about 3 things wrong which wre put right immediately).

We were nearly swept along with the "lets sue them group" but decided after viewing our lovely appartment to complete, execpting that it was a risk but so is suing a developer in another country.!! it seems that this has now paid off and the licenses will be granted soon. It would benefit the community if everyone that signed up to have an appartment did so now. Then we can perhaps make headway to building our community and taking it back from the developer.

Goonan  well done.  We feel the same.  We completed on Manzana 4, 3 years ago the second Manzana to be built and we were told a load of lies.  Our  ex community presidente was related to Anna Pennaroya, certain other family members in our community owned apartment s in Manzana 4 the "The flagship" of the development, shown on the advertising board on the N340 and on numerous websites and estate agents literature and web sites.  We thought the sales office were helpful at first , we had nice friendly phone calls informing us of the AGM and if we gave them our proxy vote they would sort everything!!!!

Only the second year  when i booked a fight at very short notice to attend  the AGM did I discover the ex presidente was related to Anna Pennaroya, and that she was sat in the meeting and texting him on her mobile and that when we tried to vote on a new president that she and an ex member of her staff Cristina left the room and came back and said they had another member to stand who happened to be related and was at the time a member of the Pennaroya staff!  At this time we checked our community accounts things could not be justified, garden equipment had been stolen and the list of irregularities goes on.  We had two gardeners both of which the community of Manzana 4 were paying for but the developer was using them at our expense for other work. They both thought they were employed by the developer.  One gardener used to wash his car with the fire hose in our garage!  The heating pump broke down within 9 months r in one of the blocks and we were told it couldn't be fixed as we had no money in the community!!  After a lot of pressure on the developer she said "she had got one from the other buildings" but it was the Manzana responsiblity!!  I could write a book.  But we have now got a good presidente, a good community spirit and we are righting some of the wrongs.  It is a nice development and will be even nicer  if and when we have "The Licence". But beware in your AGM's the late notification of the dates and times,  the phone calls , the proxy votes to the developer etc because the developer is only looking after them selves.  I do belive that certain Master community members are related to the developer and certain members of other Manzana committiees are related to the developer..   I wish all you owners good luck in getting your licenses because at the end of the day we all want a nice development and good community spirit.  Lets all hope we get through this horrendous nightmare and can enjoy our investment.

I wish you would write a book - you could call it  ¨How To Cause Unrest To Benefit Your Own Hidden Agendas By Spreading Lies And Manipulating Facts¨.  The information that you spread on this forum under numerous names is so outdated I had to check that the dates of your posts weren´t from 2004.

Extract from today´s ´The Town Crier´ newspaper:

Marbella Town Hall announced a new General Urban Plan (PGOU) last Friday that will put an end to 17 years of legal insecurity caused by the corruption and administrative chaos of the so-called GIL years.  All three political parties represented on the council - Partido Popular, the Socialist Party (PSOE) and Izquierda Unida - approved the draft plan.  The general public will have access to the plan over the next two months to make known any objections.  The Junta de Andalucia will have the final word on the implementation of the plan which is expected to become a reality by next summer.

The new PGOU, drafted by a team under the direction of architect Manuel Gonzalez Fusteguera, will legalise 18,000 houses and apartments and rehabilitate another 8,802.

If you dared to pull your head out of the sand and actually visit the Town Hall you would see that a licence for the entire development of La Reserva de Marbella is on it´s way.  Everyone can see that you are factually incorrect just by clicking on the links I have posted below (I notice that you have been unable to post any links whatsoever to the contrary). 

As for anyone recklessly and purposefully causing unnecessary unrest before an AGM, I think it´s very clear that this is again the workings of a few for their own hidden agendas. 

Thankfully, the majority of members on this forum are happy and have moved on a long time ago - stop living in the past and join us.

Kenny e I do not use different names on this forum never have and never will!  I do not tell lies and spread rumours just the truth   I have not posted any links and have no intention  of doing so.  What I wrote in the post below is the truth, I have no reason to lie unlike others on the forum and nor do I spread rumours.  Some people on here do not disclose that they are related to Pennaroya and only have their best interests at heart.  We invested our life savings into our apartment as did many others and you do not seem to realise what a nightmare journey we have had and are still having due to the developers greed and also the corruption in the Marbella council.

I am getting tired of explaining in any plainer English that I am not related to Peñarroya, nor do I have their best interests at heart: I am however, posting informative information for the benefit of (maybe would-be) owners who rely on such things as this forum for accurate information as to the situation in Marbella and our development.  I also very thoroughly research all my information before posting and the facts that I find (mainly from the Town Hall) always transpires to echo the very same information that is helpfully supplied from the offices of the developer who genuinely have the best interests of the development and all owners within it at heart.

We have all invested heavilly in our purchases.  What has happened is largely unchangeable and a brighter future already exists.  It is unfortunate that some people have done their very best to burn all bridges with the very people best suited to help and who now find themselves singing from a very outdated songsheet in a terribly isolated position whilst still trying desperately to recruit new believers to the fold.

By all means, lets move on.  But lets know the facts as they were.  I bought 2 apartments and the estate agent asked for the keys for me to view the apartments in order to do the snag list. The answer from the devolopers was that I could not view the apartments until I signed at the notary and took posession of the keys then I could view and do a snag list.  BIG DEAL..........the apartments were mine then.

I spoke to several other people up at the developemnet who had purchased and they also told me they were not allowed see their apartment before taking them over.

I have bought property in Marbella and Tenerrife and was allowed to see the properties before completion in order to do a snag list.  The developers could not be more helpful and insisted in cleaning the properties before I took them over.  They also asked me to fill a questionaire as to the quality of the service the builders provided.

Im sorry I did not find the La Reserva service very good at any stage, as I said its something I would rather forget about, but the discussion seem to have risen again in the last few posts.

The property is now ours so we should make it ours. Why should the developer be involved at this stage.  ITS OURS NOW.

I too compiled snag lists after completion which was not a problem as all of the few problems that were found were rectified within one week in each case.  The same can be said for all neighbours apartments too.

I think that anyone who owns apartments in the development and who has their community fees paid up to date should rightfully have a say in the happenings of their investments, including the developer.  The development is not yet totally completed in terms of sales and occupation and from what I have found, if the developer were to pull out at this stage, the development would be in total disarray which would have very serious consequences on all of our investments.

I am glad to hear that you managed to get your snagging done so quickly.  We completed on our property at the beginning of March.  It is now the end of July and although we have made a fair amount of progress in getting the snagging completed we have had to compromise - ignoring some of the minor issues in order to get the broken entry phone replaced (which we consider vital).  I am only glad we did not do the snagging ourselves and instead hired somebody who not only produced an excellent comprehensive report, but has been tenacious in the extreme in keeping on top of the outstanding issues.

we shouldn't be bickering amongst ourselves but agree to look forward to building our community. it has been a total nightmare since we found out about the marbella illegal build, we were all told lies at the start from estate agents, solicitors . however through all of this we have held on and avoided an ulcer or drink problem!!.

Can we all get together, let manzana 4 do what they want to do, it is there community and concentrate on manzana 3. All of us have spent money that we need to protect. Can somone bring up the issue of dog do at the agm
