I am the mentioned person who has just lost the sale of my Apt. in La Reserva, I have also been made aware that are properties will not be entertained by any of the Spanish banks until we aquire the  First occupancy licence

I am certainly not the only purchaser in Reserva de Marbella that is to be exposed to this horrific scenario, there are 413 of you in the very same situation.

The Spanish government have taken wealth and local taxes from us for the pleasure of bringing investment into the country, they have repaid us with a fraudulent local council and then taken the right from us to sell our investment. We have had no support and been left to our own devises.

If you value your hard earned investment you can make a start by sending your details to Graham Blackburn with enough support we can take this to a European Court to site our case against the parties involved.

I hope the Pennororas can sleep at night!

All get together to do what exactly, Graham? 

I am sure that you want to do something positive about this hideous situation that all we investors on La Reserva are in, but I for one am a little concerned that there is not much we can do apart from complete (if at all possible) and sit things out for the medium to long-term hoping that all licences will later be granted.  The only alternatives to this are likely to be met with very strong legal resistance, in Spanish small-print and at massive extra cost and with no guaranteed returns whatsoever. 

I for one have taken enough of a calculated risk in my initial investment some three and a half years ago - and that was with the 'assistance' of people who I thought were giving impartial professional advice as required by 'law'.  To take further legal advice in an attempt to counteract the initial decision seems to me to be yet another risk that I can ill afford to lose, and therefore my decision is to complete and sit things out at least until I know for sure that the development definitely will, or definitely will not be granted a licence - until such time, I see this latter option being the most cost effective and one which hopefully will secure my investment to which in the meantime I may yet get to enjoy.

I may be wrong and I look forward to receiving notice of your intentions with genuine optimism.

The loss of sale is indeed unfortunate but I don't think people should get too hung up on the licence of first occupation.  Most people believe the licence will be granted in time and unfortunately we just have to sit it out in the short term.  Taking legal action is an option but bear in mind that it can end up being costly and frustrating.  My advice to people who have not yet completed because of the lack of a licence is to check with your solicitor to ensure that interest and community fees are not accumulating in the meantime.  The fact that a licence has not been issued is no guarantee that these fees will be waived.  Ask your solicitor to check out this aspect of the contract and get him (or her) to point out what the financial consequences are by delaying or pulling out.

I have a Mortgage on my property in Manzana 3 bloque 1, 2.5 years now.. through one of the largest banks in Spain. They did all the research on my application and all the paperwork was checked by my abogado. So perhaps they are refusing people for another reason.???

After making a straw-poll of seven banks in Marbella, I found four that would, in principle, be willing to accept mortgage applications for purchasers of apartments on La Reserva de Marbella.  Admittedly, some are prepared only to offer less than the 70% Loan to Value that was the norm, with one offering no more than 60%, but it most certainly is possible to be granted a mortgage (subject to status) for La Reserva today, with the licence pending.

As I have mentioned in previous posts, there are tens of thousands of dwellings in Marbella currently without licences.  The economy on the Costa del Sol would be severely affected if it was impossible to complete with a mortgage.  Whilst it may now be more difficult to find a mortgage lender for property in Marbella, it most certainly is not impossible.

I am the president of Amatista, and am responding to the rubbish that is written about the developers influence regarding Amatista development as in Graham Blackburns post dated 24th October.

I have been an owner for just over 5 years, and bought off plan. our initial president was elected for the first 4 years and provided an excellent service to our community which we are very proud of.

Last year he felt that after 4 years it was time for a change, that is when I put myself forward and was elected.

During my time as an owner which I attended every AGM meeting, the meetings were conducted in a professional manner and the views and concerns of all owners were discussed and taken into account, without influences from the developer, infact the relationship that our previous President had with the developer, helped us in the early days with snagging problems and getting things done.

Since I have been President, I have not been approaced or tried to be influenced by the Developer, I have only the interest of our community and to maintain standards that will add value to our apartments.

If as a community you are unhappy with the situation then attend the AGM and don't give your proxy to your President or administration office. 

Graham mentions how wonderful Manzana 4 is now, there is washing put out on washing lines in view and satellite dishes erected which are unsightly, if this is an example of a "top notch" community, then I am glad I am not an owner in Manzana 4.

Graham,

I find the fact that you choose to broadcast the contents of private conversations, held informally in a bar, disrespectful at best.  I think that you are continually clinging to every possible negative of the situation and your attempts to embroil others by recollecting sentences spoken some months ago and quoting people without their permission are of no help whatsoever. 

One reason that I did not respond to your invitation to join your database is because I see my investment with quite a lot of optimism for future happiness in a peaceful environment.  I for one certainly do not wish to be represented by someone so pessimistic and gossip-fuelled whose attempts to gain support are made by broadcasting the supposed contents of private conversations some months later.

Whilst I don't expect you to agree with me, I hope you will accept at some point the right for privacy and for people to have a different view on things. 

Some people see your mountains as molehills - I am one of those people.  I will complete and I will enjoy my time there as I do whenever I stay in / visit the development which I have done on a regular basis all this year.  I find the development brings me happiness and contentment, feelings which I am sure I will be able to enjoy after I complete; partially due to the fact that thankfully my apartment is located quite some way away from yours.

I think Graham's concerns are quite rightly justified, as we are owners in Manzana 4 we share the same concerns and it has been proven that the developer and our previous administrators were related!  I  have attended two AGM's and both have been farcical.  Anna Pennaroya was texting the Administrator during this meeting and when it was proposed a new President should be elected a member of the developers staff from the sales office went outside to make a call from her mobile to a colleague to ask her to stand!!  She returned to the meeting and proposed her! They were determined not to lose control.  It took a further year for us to elect our current president and admistrators and all the while we knew that things were unlawful.  Since the new president and administrator have been in control they have uncovered numerous uscrupulous practices that have been going on from day 1, unfortunately at the expense of all the owners in Manzana 4.

I stayed in the apt for 8 weeks when we first completed back in 2004 and I have seen it all first hand! and many times since.

On the note of satellite dishes - that is in hand and has been for sometime!

I say keep up the good work Graham.

Thanks for sharing your experiences. Can you say what difference the current administration has made to your complex over the previous administration?  Have there been any significant differences like cheaper maintenance fees for example?

Dear Graham, I have just returned from abroad (not Spain) and have just read your reply, and am suprised by your comments regarding a bar conversation.

I am not supporting or promoting the developer, I was just stating my point of view regarding our development Amatista.

Yes you have problem in Manzana, but surely the answer is to get togeather  with the owners and do what is right for Manzana and not worry about other developments, I am sure that in the long run Manzana will be a good investment for the owners and they should enjoy their investment, it can not help your cause by running down you development, because no one will be interested in buying when they are told of all the problems.

All I can recommend is get on with what you have, and I am sure in time Manzana will be a development that the owners are proud of, like we are at Amatista.

Dear Seabury,

As an owner in Manzana 4 i can confirm that since the resident ousted the old admin we have seen a marked improvement in our community, most notably financially with a reasonable reduction in our quarterly fees. As Scottie says, some of the scams that were going on were quite incredible. It would seemt ehat every contract appointed by the administrator had some Pennoraya flavour - including our old president who pretty much failed to do anything officially.

 

Im sure like many others in the community, we a re only too happy that our new president and administrators are well and truly on the case and have mutual best interests at heart.
