Hi All,

 I am looking to complete on a property in Jardin 2 in the near future, the person I am dealing with through the UK as well as Polaris world said there is no requirement as I am buy from the bank, I am not to sure about this as you hear all the stories about buying in spain.

Would you recommend to still get a Solictor ?

Can anyone recommend a Solictor.

We used www.abadabogados.com. They have offices in Murcia and Los Alcazares and in Puerto Mazarron- although we actually met with them in San Javier at another Solicitors.  We had no problems with them and found them to be very efficient. We priced a few before deciding and these were about mid range. Since completion they have helped us with a number of queries by email at no charge.

Also used www.snagitmurcia.co.uk for the snagging process. We thought we couldn't be there for that although in the end we were but we had them go ahead anyway and, for us they were very thorough and efficient.

Hi Gareth

Welcome to the Forum.

Firstly it depends on the circumstances you are buying under:

Are you buying a resale or new property?

Has the property got any debts attached to it, as in Spain the Debts stay with the property, so if for example the property has outstanding community charge you could be responsible for it if any outstanding amount hasn’t been settled before completion.

Are you going to be able to be in Spain for completion whenever that is?

Do you understand the process and all papers that are required for completion such as habitation licence?

Are you going to be able or capable to inspect the property for defects large or small before completion?

I could go on.

Some people have used the services of Solicitors and Home inspection services and some haven’t, its personal choice and your own abilities and availability.

I used a solicitor, for me I wouldn’t buy a property in the UK without one so I definitely wouldn’t in Spain. Others happily just used the builder to arrange everything, this wasn’t an option for me but its horses for courses.

I did complete our own so called snagging inspection of our property which is inspecting the property for minor defects to be corrected by the builder before of shortly after completion. This should not be confused with a structural survey as we would consider having in the UK which is different and again consideration should be given to this also. Once again horses for courses.

Solicitors are not cheap in spine however in the finical climate that exists at the moment you should be able to get a reasonable discount as they are short of work.

The cost of reputable home inspection services are not too bad and well worth it if you are not capable to do this for yourself.

Hi Thanks for your Help,

Phil it is supposed to be throught Polaris world, but don't understand when they say its bank owned and that Polaris world have a mortgage on the property. it gets all a bit confusing I think I will be getting a solictor.

A solictor would be a good idea and give you some INDEPENDENT legal advice  - sadly there is no guarantee that Polaris World will be around for ever, they have already had two financial "near misses" and with the economy as it is,  a 3rd time might knock  them out.

I can recommend the guys we used who are in Murcia and also Los Alcazares so are convenient on the way through to CDA from San Javier - make sure also you get a Spanish will also !!

The name of the solicitor is Marisol Socias and she she charming and very helpful and speaks excellent English, also her office is directly above the Notary where our final exchange took place..

Hi Gareth

When Polaris World was building the properties they finance the building by borrowing part of the money from a bank who turn this loan into a Mortgage on the property, this is normal practise in Spain. When you buy the property part of the agreed price you pay will be used to pay off this “Builders Mortgage”. You may have the option of taking this Builders Mortgage over which in some cases can save you some costs, but this isn’t always the case as you may well get a better deal in obtaining your own Mortgage and if you are not intending to have a Mortgage irrelevant.

However due to the property crash in Spain and the rest of Europe the Banks have taken over the ownership of most of the unsold properties from Polaris World as security for the moneys owed to the banks by them. Polaris World are still acting as the sales agent for the banks in the sale of the properties.

All in all this shouldn’t make much difference to you but hopefully explains the confusion you have between the different parties involved.

We bought direct from Cam Bank - and we gambled and put it on their auction site so saved loads of money on our buying price.  It would be worth looking at Cam Bank to see which units they have.  Ours was never lived in - brand new and we are very happy with it.

I got solicitor recommendations on there and sent out a number of enquiries - I ended up going with

We live abroad already and so there was no way that we would be able to come over to do any of the buying process.  I never even spoke to Pablo - everything was done on e mail and we sorted out power of attorney with him via the Spanish Embassy in Abu Dhabi!  I would highly highly recommend him.  Everything was handled professionally.  We came over after the sale was completed and met with him in person in his office.  A very nice man with a great team.
