Hi All

The SARC webmaster has been ill and this has caused a delay in posting reports on the SARC website. He is better now but just incase there is any delay I am posting the March report here for you all to be able to read ( it went out to SARC members onb the 15 March)

 

March 2010 Report
 
Telephone communications between Anthony Malpass, on behalf of the SARC membership and Almudena have been frequently taking place since the last report.  The following information was given or discussed:
 
Settlement Agreement
 
The translation of the agreement into English was sent to a legal professional in England, who is fluent in both English and Spanish. This translation should be with HdT early the week of Monday 15th March.
 
The letters to the purchasers/creditors have been written and printed plus the envelopes are stamped and addressed, ready for posting early the week of Monday 15th March. The letters will contain the HdT website address, upon which additional information will be posted for all of the purchasers/creditors to see.
 
SARC have asked:
 
  • For some form of compensation for those purchasers who continue with their purchase and have been told that there will be information regarding this on the HdT website.
 
  • About the possibility of HdT making contracts transferable, for those who wish it.
 
  • If those purchasers who have cancelled their contracts, can be given the opportunity to resume their purchase with the same compensation/conditions being made available to them as those who have not cancelled their contracts. (SARC felt this may be of help to those who cancelled their contracts but do not have bank guarantees and  this could possibly enable purchasers to get a better and quicker return on their money)
 
 
 
Notaries
 
 
A list of Notaries, where purchasers can discuss the agreement settlement and sign acceptance of it, will be on the HdT web site. This list will include those inside and outside of Spain.
 
Water Licences
 
HdT have presented all of the documentation to the Murcia Tribunal for checking and to ensure that it is all in order prior to sending it to Madrid. Once this process is complete copies of the documentation will be posted on the HdT website.
 
 
HdT Eire / UK meetings
 
There should be confirmation of any meetings and their dates & locations on the HdT website. HdT are working on the logistics of holding the meetings.
 
 
HdT Website
 
The HdT web site is going to be activated on Friday 19th March and as already stated will have information posted upon it for all purchasers/creditors to be able to read in either Spanish or English. It will have a question and answer section to assist in clarifying any issues or concerns regarding the settlement offer that will also be available on the HdT website.
 
There will be a link from the HdT web site to the SARC site and vice versa.
 
 
Comment / Opinion
 
We are now entering the final stage of the process where each of us purchasers will be able to read the settlement agreement and think about the possible outcomes and there effects upon us.
 
Most of us do not have a bank guarantee and are in a highly vulnerable position, as we are last in the queue for the repayment of any money if HdT are liquidated. We are all probably aware of how little if anything creditors have been repaid in the UK from companies being liquidated. With the current economic conditions assets would be highly unlikely to reach anywhere near their value. (How many of us have seen closing down sales and stock being sold for a mere fraction of what it was originally being sold for?)
 
We are concerned that over the past couple of years some purchasers have spent money on legal action, trying to get their creditor status elevated from that of an ordinary creditor. Sadly none succeeded in this action. We feel that some solicitors are not giving their clients advice on the probable outcomes of the choices that purchasers face. We believe it is very important that we as purchasers realise, that only we are negatively affected if HdT is liquidated
 
 
The SARC Executive committee will carefully read the proposal prior to issuing a position statement/opinion on the agreement to its membership and then placing this upon the SARC website, for all purchasers to see.

So where is it then???????

 It's the 20th March and i have still heard nothing from Hdt.

Where is this miraculous website that you mentioned?

Where is the letter they were 'ready to post' ?

All just a load more broken promises and lies as far as i can see!

Hello all fellow victims of the great San Jose theft.

Was you really expecting to get anything from San Jose that was on time and the truth. If we are lucky you will probably receive it the day before our votes have to be counted.It has probably occurred to Alumdena that if she opens up a web site where you can ask questions on the proposal that you will also be able to express our opinions of her and the way we have and are currently been treated by her and the administrators. If you are anything like me you cant hold your breath for longer than fifteen seconds when you are under water and about to drown, breath normally and lets hope that it will come in the next few days.

Nothing would have been done on Friday as it was a national holiday (Father´s day!).  Let´s hope that they have the website up and running before Semana Santa starts, which in Jumilla lasts for well over a week...

Hello everyone I am back  !!!!!!!

In answer to Dave     None !!!!!!  I doubt it will ever materialise .Just Almu spiinining Tony (What a fool ) another line  to keep him on the HdT/SJ roller coaster a bit longer. The plan is to distort the real situation in the hope that the the judge and crediters wont see right through them . I think anyone with half a brain can see exactly what is going on with this hopeless company and that to continue would be pure folly . MM/ JA/ julie anne .

Ps Tony you better get on to Justin straight away to get me banned again sure we wouldn't want a variety of opinions on here it just wouldn't do for anyone to disagree with the Great SARC leaders  ,no matter how misguided or ill informed they may be  !!!!!!!!!!

Welcome back Julie Anne!

Out of curiosity, is that your real name?  I know you changed it when you were banned the first time (or was it the second time?!)

I think quite a few people on here would welcome any advice on how to get our money back without a bank guarantee, as a lot of us are in that situation.  It´s one thing to get the courts to agree that you are entitled to a refund, but as stated before where is the money going to come from?  There´s no way that Justin could object to you passing on your experiences to others on the forum.

As for debate, if it´s a good honest argument without becoming too personal, again I don´t see Justin objecting to that.

Let battle commence!

I know we don't always see eye to eye but it's good to see you back!

As Suemac says, it would be really great to hear how you won the battle and finally got your money back, i thought you had mentioned doing a blog before you were banned (again!)

I for one would really love the opportunity to read it as it would maybe give the rest of us a new approach

Hello Julie Anne

We are new to the blogs that have obviouly been ongoing for some time and we too would be very interested in your experiences of obtaining your deposit back and the way in which you obtained it (well done you!)

What is going on at the moment seems a complete mess with no clear idea of what is being proposed and what are the consequences after the vote for all creditors/purchasers. Purchasers of property in Jumilla at present lack any clear leadership with not much faith put into SARC.

For ourselves San Jose have had our deposit for 5 years and we also have no BG in spite of having an agent and indepentent solicitor who failed to obtain one. We are, like the rest waiting for the magical web site to appear but do not have any confidence or trust in anything from Alumudena as we have over the last 5 years been told numerous lies.

We would welcome your comments please.

Hi Dellew, Don`t hold your breath for any truth coming from San Jose. You have said it yourself, lied to for 5 years, ain`t going to change now or in the future. Everything that comes from SARC is dubious at best, all they are, are San Jose puppets! They are allowing SJ/HdT to prolong this fiasco and damage any chance of us getting our cash back. Ask yourself this, do you really want to continue with your purchase when what they have already "built" has been lying open to the elements for years? Look at the El Pinet forum and see what the future holds for SADM if it ever gets off the ground. Cheers Joanniemac

Hi all . The first and most important thing is to give up on SJ/HdT .Too many are focused on SJ/HdT  like Tony et al .They are the enemy it is they who have taken your money under false pretences and  illegally ,it is they who have absolutely no regard for you or for what they have done to thousands of people . Stop complaining about how they have treated you .Stop listening to what they have to say .Stop caring what they say and see them for what they are. Everything they have done on every step of your purchase journey is against Spanish Law .Give up on them completely  and protect yourself as an innocent consumer who has been robbed .

Do we really all think the way they have treated us .the lack of information,the total disregard is coincidental .No they are playing a strategic game in giving false hope and information .  They are putting  purchasers off doing what they should be.It is a deliberate tactic in their futile  attempt to survive . They are delighted to have people as silly as Tony fighting their corner and perpetrating the myth.Until you give up completely on SJ/HdT " coming good " you can not move on .The key to success has nothing to do with SJ/HdT they do not give a sh%t about you or your situation . 

What would you do any where in the world if someone took a large amount of money  (20k,60k ,70k,100k  the amount is irrelevant ) from you for goods you did not receive ???????????

I think if you read earlier posts you will see that many people have given up on SJ/HdT and all they want now is their money back, however they don´t have bank guarantees.  This is why they are asking you for advice and further information on what they need to do next to get their money back, as you mentioned previously that you had succeeded in doing so even though you didn´t have a bank guarantee. 

Please tell us more!

Hi Sue ,I am not sure that everyone has completely given up on SJ/HdT  some still harbour false hope that they will come good . Use Spanish law .In Spain like most other countries in the world , it is not legal to take money for goods that are not delivered  it is called theft  !!!!!!! Senor JRM  does not want to go to jail nor is he a poor man .MM/JA/julie anne

Let me put it into simple terms for everyone (I don't care about being banned), SUE the arses off San Jose, take them to court for the return of your deposits. Don't just sit there waiting for some miracle to happen. IT WONT!

Spot on Dave they are criminals and if I am a victim of criminals in any country I go to the police and report  that a  crime has been committed  .Use criminal /civil  and consumer law in tandem . The Spanish legal system is not broken people just don't know how to use it to their best advantage.  Make no mistake here a crime has been committed  !!!!!!!! SJ/HdT are criminals  and unlike Tony I do not negotiate with criminals MM/JA /julie anne
