Ok, I have just read the minutes from the Meeting on the 16 May 09, I was under the impression that Sergio was elected as our president and that Terry was the vice president???  Our president is Mrs Marian Molina?

It’s starting to look as if the only people telling the truth are those from this so called rebel element (Condado de Alhama Association)???

I was happy to support my elected officials until now but this is all looking a sham and we have had no proper information from our official representatives. I am now thinking I would be better supporting this Condado de Alhama Association as they are at least providing information and explaining themselves?

This was going to be by reply to the change of management post, but I think it may be more appropriate to post it on here and get some awareness amongst our people of exactly how the way things have been working out there. Please folks, wake up and smell the coffee.

Well, there you have it - it sounds like it is all done & dusted the way I read this, fence or no fence. It is not the way I would expect or want things to happen but it appears that the Presidents of Jardines 1-12 have ran out of patience with RPM's non-performance and it is obvious to all that we are paying money for absolutely nothing of real value in return.
You really need to read the minutes of the meeting of May 16th to understand the situation. It very much looks like level 1 is firmly in the grip of the Polaris (Alhama Golf Resort)/RPM stranglehold and is not likely to change until some more presidents are elected to swing the balance in favour of the residents interests. Virtually all of the penthouses and the vast majority of Naranjos were under the control of Alhama golf resort casting vote at that time. Now if you think that Alhama golf resort will vote with the owners when we are asking them to put things right across the resort at their own cost, you are living in ‘cloud cuckoo land’. Hopefully the election of presidents for Penthouses and Naranjos can happen sooner rather than later and we could then make strides towards becoming a unified resort which is in everyone’s best interests.
I feel more confident now that some of the Jardines issues will be addressed and we will start to see some results very soon following all the controversy of recent weeks. I think this company will be keen to show the residents their worth to justify what they are being paid and promote themselves for re-engagement following the first term contract, where RPM did not give a jot because they knew they were just there as a front for Polaris (Alhama Golf Resort) all along.

So the fact that the "Association" didn't even bother to invite Noranjos presidents is now proved.  They knew they wouldn't be able to do anything about RPM if they had.   Have any of you given any thought to what is going to happen to owners on Naranjos?  through no fault of ours?   I'm not going to print what I really think.   Jack and alright spring to mind

Darren, don't panic.  J13 is the renumbered J12, and it is J1-5, and J 7-13 - as the two level 2 groups. 

Other than the above point, I am totally confused by all of this, as like PGM I thought that Sergio had been voted in as overall president.

As much as the jardine presidents may want to change (and I am no lover of RPM), I still don't see how they can declare independence and make a seperate appointment, RPM were appointed at the AGM, and unless that meeting can be shown to be invalid the appointment will stand and we will be committed to pay them.  As long as Polaris have the 80% + vote it won't matter how many blocks we get presidents for, and how much the owners agree on what we want.

Don't get too confused please.  When you write down your views and opinions it help me to grasp a little on what is actually going on otherwise I  wouldn't have a clue on what all the emails are about that I keep receiving.

June I don't think they will have different management for different areas, as an outsider looking in it seems to me the "association" has been fighting from the word go.  Unfortunately the timing isn't right for the Noranjos area as I believe there needs to be more dwellings completed (I might be wrong on that).  I cannot see the association sticking with just the Jardines as the resort is all of our concerns.  I for one wouldn't want to see it split up.

Ted/All,

Situation as it stands right now as I can understand it is :-

Sergio Fuenmayor is president of Jardines 1 and level 2 president of Jardines 1-5.

Mel Beasley is president of Naranjos 8 and level 2 president of Jardines 7-13.

Terrence Possehl is level 2 president of Naranjos 1-6.

Mrs Marrian Molina (of Alhama golf resorts) represents the vote of every other property not handed over,or even un-built property, is overall level 1 president of the whole of the Condado development.

Voting rights distribution is residents elected represntatives 17.86% - Alhama golf resorts, the rest.

So as you can probably gather, the residents would never ever be able to overturn any thing the level 1 president was voting for (all the rest af the Alhama golf resort share of the voting) so there is a massive conflict of interest. In short, we have a totally bogus and unworkable structure in place that can be manipulated to vote out any issue that Polaris so choose.

I get the impression that it is only the Jardines that are unhappy with the performance of RPM. Well as a owner on Naranjos I am perfectly happy with RPM and wouldn't like to see a change of contractor, we complained about security and that issue was addressed, we suggested less grass cutting and that to has been address  we  got our dead plants removed from the penthouse blocks aswell.  Can't see why a change of management is required, would it not be better if the presidents of the jardines changed tack and approached their issues with RPM in a differrent manor. I'm with June on this and would not like to see a split but  all the what I would call 'Trouble makers' and people who seem to want to rock the boat at every opportunity seem to be from the Jardines and i think they certainly have their own agenda and would not think twice about seperating from Narajos if it was too there advantage.  Strong words I know, but make no apologies for what I think.

I totally agree Billbo, all this seems a bit pointless with the Polaris vote - that is why I am struggling to understand how the Jardine presidents can do anything re RPM. 

Also think there is an error in the minutes - can't be right that Mel (who is in Naranjos) is level 2 for J7 - 13, think he is L2 for the Naranjos de Alhama 1 group (Penthouses 1-6 and J7,8) - he is level 1 for Naranjos J8.  One of the candidates for level 1 (which was clearly a joke vote!) was M Fedrico Mesa, who was level one for Jardine 12, so I think he must be the Level 2 for J7 - J13

I am now on my 3rd attempt at responding to the original thread so will try this thread instead:

Spoke to PW - as anticipated they say RPM in charge

Emailed RPM and got a callback within 10 mins saying the following:

Presidents meeting illegal and any court challenge by them will, ultimately, result in us coughing up for the legal bill

The Presidents have never sought to contact RPM with their concerns or allegations and refused to meet with RPM to discuss

RPM have asked us to consider a 'realistic' timescale  of at least another 6-12 months for them to prove their worth and say that a resort of such magnitude will always put pressure on a management co at the initial stages of development but that they are now responding within faster timescales to our concerns

They want us all to send our email addresses to them at general@rpmspain.com and will endeavour to communicate with us on a more regular and faster basis.  We should also send our concerns/fault reporting to them on their email address

She says the community fees will be coming don again as the resort completes

I am pretty much ambivalent as to who runs the place so long as it is done well.  I do, though, think that plenty of Spanish representation is a must.  Arlene

I think I must be missing something here. It is my belief that the community of Owners for Alhama Golf Resort as far as the Horizontal Property Act is concerned, is all of the dwellings on CDA. This is how the "Quotas" have been worked out and all financial aspects the same.How then can a few rebel level 3 presidents change something as serious as the management company that was voted in at a legally binding AGM. Ok PW have the majority vote on everything but that doesn't change the fact that it was voted in.

If you take this situation to its extreme, one jardin doesn't like what the management company is doing so calls a EGM for its Jardin and votes them out and gets their mate in from down the road who is pretty good with the mower and watering can. It could never happen and neither can the Jardins 1 - 13 one without a full vote of all presidents from the whole resort.

Its been bad enough with the them and us already but this only widens the divide and for what. I suspect that somewhere hiding behind the scenes, someone is down to make a lot of money.

If this does turn out to be an illegal Junta and this new company has already started work and subsequently is forced to back down, who is going to pay them. I would suggest that the owners of the breakaway Jardins will have to foot the bill wether you agreed with the takeover or not.

Well thanks Mart, with that attitude i think you can stay out on a limb!

I am in the jardines, and on every post I have said I don't understand how these people can try to make a decision for one part of CDA - I am not creating a them and us, but your attitude of let the jardines pay whether we agreed or not will certainly fuel it! As far as I am concerned we are all one group, if someone is acting illegally then the individuals can pay, not Naranjos, but neither the innocent members of the Jardines that had nothing to do with this.

I currently pay my money to RPM and will continue to do so until officially told that this is changing, and RPM are passing my details to a new administrator, and won't be paying a penny to anyone else.

Tis true - we know not what our Presidents are up to in the Jardines.  We are all as much in the dark as the Naranjos guys so don't blame us poor Jardine-dwellers for all of this.   The presidents have all gone off on one without consulting us or anyone else for that matter.  Ho hum.

Sorry Ted and anyone else I have offended.

I should have said the people supporting this move and not all Jardineers. Most of you are in the same boat as us. It just makes my blood boil when a few think that they can change things for the majority.

I have emailed Antonio Gill today and asked if the rumours are true and if they are, why should we let his company take over. I will post the answer if any and I doubt they will answer.

Happily take the pint, but no problem, i was probably over-reacting!!

Will be interested in the response you get.  Have seen Phil's post re AG, and at least they seem to have some experience, my concern remains that I don't see how they can add value if they are only acting for a part of the resort.

My preference would have been for the Presidents to work to bring Polaris to the table and get an agreement that they will abstain from the next vote on the administrators (next year), so if RPM have not proved themselves to the community by then we have the chance to vote them off.  If RPM knew that they couldn't rely on Polaris to keep them in place next year they would have to pull their finger out.

I don't think we can win if we try to up against polaris, and am worried that it will end up costing us money as a community somewhere along the line.
