Hi everyone,

Has anyone yet completed on the Los Naranjos Penthouse Apartments? Has anyone been given a date for completion?

I was asked to come to Spain to complete in September. My notary appointment was cancelled because the habitation certificates were not ready. I was told the revised completion date would be in December. However, I have heard nothing more from Polaris World.

I am in no hurry to complete. However, a rough idea as to when it is likely to take place would be most welcome.

Hi,

Like you we were due to complete in October and ending up giving POA to our solicitor as no COH. We too were given a revised completion date of December. I've recently heard from PW Customer Services that they still don't have the COH. On the positive side, we snagged when we were over in October and PW have just informed us that they believe they've corrected the issues we found (all fairly minor). Just want to get it all sorted now.

Hi Jay & Kev,

There are a few of us who have completed on the penthouses, Nick & Debs(Skell)  Block 9, Simon & Alison,(ourselfs) Block 10, Barry & Sue(Barney 111) block 10 they have actually moved in and are living on site, Tom & Jane(Hendert) Block 11 and I think Frank(Golfinjim) on Block 1 has completed, I don't think any of us have our COH but I maybe wrong.  Our solicitor advised us to complete as he advised that it was only townhall delays that were holding things up and nothing else.

We are in exactly the same situation with our 1st floor in Block 16.

PW hassled us to complete in November and we agreed 20th,  everything done from our side, NIE and also POA and then the completion was cancelled as the COH was not available !!

My solicitor tells me it "wont be this year now", and when I try and pin her down further I get the response "PW dont know and when they know  - I will tell you"

My major concern now is if my bank pulls the mortage product from under me IF we have to wait for yet another few months  - my original completion date when we brought in May 07 was 1st qtr 09 - I cant see PW being far away at this rate !!

I guess we need to establish what order (if any) are they are doing the COH's in , and what they have already done, is all Jardines completed - what about the Naranjos jardines behind the penthouses ?

We are staying at Condado over Xmas so I will get some updated information even If I have to go and camp out at head office !

Hi All,

The COH's are now in for nearly all the jardines, well definately up to jardine 7, as ours is in.

Snorkychopper/Mark,

We were also worried that our mortgage product would be pulled as it had been once before by another bank, so decided to complete without our COH.  The COH then arrived approx. 3 weeks later.

Hi

Does anyone know what the actual problem is with coh's??  It is very frustrating to be chased to complete earlier than expected, only for the completions to be put back again!!

From what I have gleaned from general sniffing and surfing about....

I think the issue is that there are tons of these COHs to be issued one for every property and very few local town hall staff in Mazarron ?? to physically hit the ground and do these inspections. 

Each appartment has to be inspected and reported upon and then the wheels of officialdom have to grind to register your place in some dusty old ledger and then finally generate a scrappy piece of paper to say your "place in the sun" is fit to live in !

I can just imagine the COH guy coming into work on a monday morning  "only another 746 appartments to visit do before the 15th" - I wonder why PW cant do something to assist with this, as I cant believe they dont want my money "quick sharp" in these troubled times ?

When we completed our Solicitor told us the delays were caused by the Alhama de Murcia Town Hall rather from PW.  For that reason he advised there was no real advantage in not completing without a COH, unless you wanted to use that to delay starting mortgage payments. That wasn't an issue for us so we completed without COH, although it did arrive the very next day.

So I guess it's down to personal choice whether you decided to complete without a COH or not, but I don't think there's really any risk in completing without one.

But of course seek advice from your own Solicitor.

Hi Lisa,

Our solicitor also mentioned that all the building work going on around the penthouses could also be the reason the COH haven't been issued.  This sounds quite a reasonable explanation as they are now concertrating on the golf course nearest the penthouses or so i believe, planting trees and bushes.

Hi Mark & George,

Thanks for the info. Its like you say Mark, PW need us to complete sooner rather than later so they get their money in!! They should fund a few extra members of staff in the town hall or wherever for a couple of months to get these things done, it would be in their interests!   just a thought.

Hello,

Thanks for so many helpful replies. I too was tempted to complete without the COH. However my mortgage company (Kutxa Bank) would not value the property until the COH was available.

Anyway, the delay has meant my mortgage has been pulled. I think I will now go with the Cajamurcia mortgage taken by Polaris World. Does anyone have the e-mail address for the person dealing with the Cajamurcia mortgages?

I was also with Kuxta who pulled the product on me months ago and then with Barclays who did the same more recently, finally and hopefully 3rd time lucky now with Bancaja !!

I think as George says, there is nothing to stop you completing without COH if its your own cash money but the bank wont front the cash for your mortage untill they see the property is pukka with the blasted COH.  We had our valuation done without the COH over a month ago but cant go anywhere else untill we have it !

Hi Snorkychopper/Mark,

We too have our mortgage with Bancaja and they allowed us to complete without the COH after Nuria from Polaris sent them through copies of the application with the town hall, so If you do want to proceed without it, you can with Bancaja, once they are satisfied that the delay lies only with the town hall being understaffed.

Hi all,

The risk with the COHs is that, if there was some problem with issuing them or a problem with PW you could end up owning a property that you have legal problems with (either in living in or selling on). It is probably a tiny risk but it is still a risk.

I guess if you want to complete in a hurry for a good reason then (if your bank will let you) you should proceed without it. If you are in no hurry (as we aren't) then wait.

We didn't take any risk big or small not according to our solicitor, he advised no risk but i am glad we did complete without the COH  because due to the continual slump in the Euro, by completing when we did we have saved ourselves 7,000euros.

That's pretty much what our Solicitor told us as well. If I remeber rightly he explained that the COH has no legal significance as such (the property is guaranteed seperately by architect's and builder's insurance), it's simply the Council authorising the connection of water and electricity supplies. So it's an administrative document rather than a legal one. Of course you're still perfectly within your rights not to complete without one, if that suits you.

But I'd still strongly advice anyone not sure to get advice from their own Solicitor.

That's very interesting many thanks for that tip, think I will wait until after Xmas now but come January I will be pursuing that further, I would like to get this put to bed and start enjoying my property.
