I found a outstanding laywer. Today she informed me that she got all my money back with interest, wihtout going to court. This considering that 70% of the guarantees I had were a year 1 1/2 out of date. She accomplished this in 3 weeks.

Her fees were about 10% of what she recovered but the interest she got cover this.

If anyone is nervous, which I was very, I would email her and get her opinion. Even if you have no guarantees get her advice.

Are you one of the people who's apartment wasn't built?  Or , are you just wishing to opt out now that Aifos are so poor

Hi,
There seems to be a lot of talk on this forum regarding apartment blocks that have been built and completions etc  but no mention of the blocks , Lavanda for example, that have not been built, even though building licences have been granted. I cannot get an alternative apartment for the same price and it would seem that we have no possible way of getting our money back.
These people such as I who have paid the 33% deposit have been totally screwed as we have nothing to show for it and it seems that these blocks will never be built. Has anyone got any suggestions as to what course of action we should be taking or what we should expect?

In my case I only got a Bank Guarantee for the first 10,000 deposit
Already trying to get it to Court but this seems to take for ever to get a hearing date. In the meantime should Aifos go bankrupt where do we stand can anyone offer any views or advice on this?

Hi

  You have 2 options now:

1.- To wait for the bankrupt process and to be recognised a a creditor of aifos. You will be in the long queue of common creditors of aifos.

2.- To appply an embargo to the court in the following days and try to freeze assets of them before they will be declared in bankrupt ( I calculate in one month).

Thanks for your advice the embargo route sounds interesting but I have heard that it is costly to set up and that Aifos in one recent case had persuaded the judge to have the client put up a large sum of money to protect Aifos incase they lost a sale due to the embargo. Seems like pouring even more funds down the drain??

If you have any bank guarantees, I would contact the lawyer at BCP and cash them in & reduce your exposure, you will still have your contract if would want to complete down the line. If the apartment is not even started then cash them in now, the banks have money Aifos have none.
