  If you or your lawyer have sent a comunication to the developer informing them that there is a delay in the development and you want your deposit back and they did not pay you you can go to court against them to obtain your money back plus legal interests.

Hi

  You have 2 options now:

1.- To wait for the bankrupt process and to be recognised a a creditor of aifos. You will be in the long queue of common creditors of aifos.

2.- To appply an embargo to the court in the following days and try to freeze assets of them before they will be declared in bankrupt ( I calculate in one month).

   They are not going to refund you the money paid, not now that they have got everything in place.

If you have denounced the delay before September 2008 you will have to go to court to obtain your moeny back.

The Bank Guarantee is a certificate from the bank  that means that the bank guarantee the funds you are delivering to the developer until the property will be finished.

It used to expire when the architect grants the certificate of finishing the building and in spite of it is obligatory not all the developers give the purchasers the bank guarantee.
