We purchased September 2003 & were told by our agent then that any builder selling offplan HAD to BY LAW give a Bank Guarantee.

Hi Mike T, at the stage of letters gone out to Palmera and associates from lawyer but of course no response.May well go with the CDS action group as there are dozens of us now all up for a group action, which will carry a lot more clout, and save a fortune going it alone, so may well now progress with them . Good luck with your case and keep us informed.

On a general note ,you may well find bank guarantees are only obtained after a building licence has been granted, so us mugs who bought off plan before this was granted and are still waiting years later will have no guarantee. Im sure though,  the crooked builders associated with Palmera would not bother after this was issued anyways.Dont also be surprised that Palmera sold you something linked to a bankrupt developer , all they want is your deposit and once they have  it ..... job done . SCUM.

Hi raganp yes so we are all in that same boat. Nothing we can do about the bank guarantee now eh? Sinking ship , no paddle springs to mind. Why oh why do we trust people. I know there are so many trustworthy estate agents out there, why didn't we meet you first? I wish !

Hi JPD just read your message but cannot see where I have to sign up,I spoke to Gwiym last wednesday Julian at the Sunday people gave me his home and mobile number, he said that though he is in the costa del sol we could still all work together concerning Palmera and it would cost 500euros which seems resonable like you all say cheaper to go together than on our own.If you could just let me know where the form is to sign as I have said not very good on the computer thanks . By the way he also said they are taking some big finance company to court as well but cannot remember the name,but he did say they are all getting woried,and it was in October, Gabe.

Hi, just read all the posts relating to those who have been wronged by Palmera Properties. Having seen the article in the Sunday People paper, I have now joined the Costa del Sol Action Group and strongly recommend anyone who has been fiddled by Palmera to look at their website http://www.costa-action.co.uk

Scroll down to Palmera Properties listed on the left hand side for all the horror stories. This also has the article in there from the Sunday People.

The more people that club together to fight against Palmera the more chance we have of getting some money back.

Hi Penthouse, thanks for that link. Very interesting, familiar and upsetting reading. Have Grupo Mirador started wearing a new hat... Grupo Urbasa!

Palmera certainly know how to pick the builders they work with dont they. Some of those poor peoples letters, could have been written by some of us on the costa Blanca, against Palmera and Grupo Urbasa.

What a total nightmare!

Hi JPD, are you taking any action against Palmera Properties or the builders at present regarding your property? Do you have your own solicitor or were you going to join the Costa del Sol Action Group?

Hi penthouse , yes we have our own solicitor. We are at the moment trying to get a group of us together to first of all find out if there is a chance that Grupo Urbasa are going bankrupt, which we have heard they may. Some are very worried about upsetting the apple cart yet as no one really knows when the exact start date of the building was. Our contracts tell us they have 36months from the day they started work plus 6 months. Some of us tend to think their contract is up, some Oct 2007. We were told our apt would be ready in spring 2006 then summer etc etc etc. The building is 80% built, but no work has been done for 18 months and we all keep getting told in two weeks they will start, next month they will start etc.

I myself and a few others want to go ahead and pay the solicitor to do some investigation (not court action as yet) just to see if the builder is going bankrupt. If he is and we dont let them know we have an interest in his assets, we may all end up with nothing. We are willing to hang on a couple more weeks, but then we will ask our solicitor to start investigating, and hopefully it will not be too late.

Can I urge everyone intent on getting deposits back and seeing PP brought to justice to contact the Costa Del Sol action group, as others have stated and supported on this thread. Our best chance  is definitely through these and their lawyers, who are already making headway ,probably due to the fact there are now 35 people in contact with them ,and they  are also hoping  to prove the allegations of fraud against Palmera and associates.Going it alone  with an independant lawyer will not only prove very costly and time consuming, but you will also find Palmera will simply ignore you and your lawyer ,and they  will be content to take a chance in court in years time, where they will try to blame another party[if they even turn up at all] Believe me I have spent all this year researching them and their practices, and am convinced this is the way to go.No more whinging ,moaning and letting off steam . Time for group action!!!!! The group action fee of 500 euros each is minimal, when you think how much these crooks owe us.

          i wholeheartedly agree with your comments about everybody joining the action group but there are some of us who have our own lawyer on there case as in our case for 18 months and are due in court on the 1st of october i am not putting the action group down but it doesnt seem common sense to pay more money out than we already have,i just hope palmera and mirador get their just deserts

Hi Robson ,couldnt agree more ! if you are that far down the legal line with a date,  of course there is no need to take any other action until you get a satisfactory outcome. Hope you can keep us all informed of the case as many of us others are soon to follow.all the best

We have just joined the group although we too have our own solicitor.  She has been acting for us for 18months and we have got nowhere so although we have to pay out yet again (3rd time lucky) we do hope this will come to a glorious finale after of  what has been an absolute nightmare.  If this action group fails I cannot see us ever getting our money back and will have to kiss goodbye to nearly £60.000. because I just cannot face the stress that Palmera has caused us anymore.

I would like to thank all those that have helped us get in contact with the group, as they say there's safety in numbers!!!!1

feelsame way ourselves its been going on for nearly 6 years for us and was supposed to be be my retirement place in the sun,fat chance now,we are more hopeful with our lawyer because he is acting for other people with palmera and mirador and won a case against aifos last yearfor a british newsspaper who had trashed aifos aifos claimed damages but the judge refuted the claim  and made aifos pay the court costs as well,i just thats agood omen for us and everbody else in this bloody nightmare

I was in their Benalmadena office around 6 weeks ago, getting the usual lies and excuses. I hope you have all joined the costa del sol action group ,whose lawyers are involved in a major group action against them to get returns of  our deposits, and it looks too as if criminal and fraud allegations may too be proven aginst them .There are over 40 of us now i believe, who are registering for this action. Only by a major group pressure will anything surely  be achieved , as you all know they will simply otherwise totally ignore you and your lawyers.
