Hi all,just got word this morning re completion for 7th of August.Fair enough as it gives some leeway to get things sorted.

The girl said something during the call that really surprised me.She asked firstly if I was taking on the CAMS builder's mortgage,when I told her yes she said that it was up to me but did I know that I didn't have to use a solicitor!!

Polaris World do all the admin,book appointments with the notary etc,also do all the translation.I think she said that a bank official would accompany us re the mortgage money.The bottom line being no-one else is legally required.

Obviously in the normal course of events buying a house dictates the need for a solicitor in your corner,but surely dealing with a company the size of PW,plus no need for searches for owners and land details etc,suggests that it's only a paper exercise thats going to be repeated a 1000 times?

She is sending out the guff soon but wondered why I hadn't seen this on any posting.Anybody any thoughts or experience of this?

I know it's probably best to have an independant solictor but an approx 1200E saving would go a fair way to paying for air-con.

THATS SOUNDS LIKE A PRETTY GOOD DEAL, WISH I KNEW THAT BEFORE I INSTRUCTED MY SOLICITOR BUT ALREADY DONE A LOT OF WORK FOR ME SO BILL ALREADY ROLLING, GOOD LUCK WITH THAT THOUGH, LIKE YOUSAID SAVING WILL BUY OTHER MUCH NEEDED STUFF.

With all due respect use your own solicitor.

It sounds like PW have their own solicitor, but what happens if you have a problem in the future, who's side are they going to take.  Having your own legal person to call on from time to time is worth the peace of mind.  The cost of using a solicitor for doing the checks and being at the signing are very low compared to the costs of setting up a mortgage and the costs of the Notary.  They are restricted by the state as to what they can charge.

Also note that when you take out a mortgage in Spain you basically pay the notary twice.  Once for the signing of the property and once for the signing of the Mortgage. 

I do have a solicitor who we use based in Mazarron town, if you need one let me know via PM and I'll drop her a line.  She's spanish and speaks perfect english.

I have to say I agree with Redman.

Having a solicitor in your corner I think is a definite plus when it will come to resolving any problems either before the completion or afterwards , for example with items on the snagging list which are not completed properly.

Also I think a saving of 1200 euro in the overall scale of things is less than 1% of the outlay you are making ,Is 1% worth the risk of not having a solicitor?

                       Am doing the same thing as the solicitor in question represents the bank  and not Polaris.

Thanks everyone.

I understand the concerns and am just testing the water,still 3 months to go.

I know about the extra mortgage fees but in taking on the builder's mortgage these fees are negated.Plus I intend using a snagging service.

Anyway off to Prague for a few days and will start fact-finding when I come back,I will then post any info for interested parties.
