During the last week Anita has been contacting keymare again regarding faulty white goods

Below is the response she had from keymare with the phone numbers to contact the relavent companies

Anita has pointed out that some of the white goods were  damaged and were on the owners snagg list

so this should be part of the snagging items keymare should correct

we shall continue to to send the e-mails of outstanding items of the owners to keymare despite there reply

            We got exactly the same response when we reported our air conditioning ,which was actually an installation fault(solder in a cpper feed pipe).Gemma informed us that she was doing it as a favour.The problem may be ,and we found this out, the suppliers of the white goods do not speak English ,I also understand that we are in Spain.

I believe that Gemma is feeling the pressure and is therefore less helpful,perhaps her workload is to great  ,We need some-one who is fresh to the situation and able to bring enthusiasm to customers services.

The contact list is helpful,I will need to improve my Spanish.

With regard to the response from keymare regarding the

maintaince on the properties

i do know of an air con company who will check out the installed units

on your behalf and give you a report to forward on to keymare prior to the guarantee running out

should you not want to relay on the keymare contractor to rectify the units ACS  will

you can contact them via a pm to me or on

We have been told by Gemma that if any other air-conditioning contractor,other than the installer does any checks or alterations on your system the guarantee is invalid .I would therefore be very careful about involving a third party.

From experience of Key Mare and their customer after services I would rather get an outside contractor in who knows what he is talking about to get my faults rectified than wait about for Key Mare or the companies who did the fitting in the first place.

I had a fault on my air conditioning at Al Andalus and the company kept coming out and regassing but didnt try to find the fault.  I was fed up with this so I got ACS in to have a look, the leak was found and repaired they mentioned it wasnt earthed !! and that I should contact Key Mare as this would definately be a snag issue.   He  found that the actual unit wasn't electrically earthed for safety, I asked Key Mare to get this done but but they said this was not needed in Spain and wouldnt get the installers out, so I checked with the manufacturers who confirmed this was needed with their units no matter what country they were installed in so i got ACS to put in an earth cable.  I didn't fancy being electrocuted because Key Mare couldnt be bothered to find out. Other people I know on  Al Andalus had the same problem with no gas in, no earth cables fitted and some electrics not even connected.

Key Mare used to deal with the fitting companies as we always went through them never straight to the installer or manufacturer so it makes you wonder why they no longer do this!!!!!!!.

The following is a very helpful post by Jane B, that she posted on the general forum. Jane runs a B&B in Vera & is a regular contributor to EOS & has published articles in the "EOS Library".
It is interesting that it states that responsibility lies with the vendor which in my opinion means Key Mare. I have had no contractual agreement with any other comany, nor have I paid any money to anyone other than Key Mare.
Therefore I believe that they are responsible for dealing with these issues.
I do agree with Lampy though, if there are these known issues with the air conditioning, I would rather  get it made safe by an independent company rather than get the origanal installers back. They are, after all, the one's that got it wrong in the first place.
I hope the following is of some use.

Do you know your real rights in respect of faulty merchandise?  You may not be aware that it is now much more like UK law than most retailers would have you believe. 
 
You can find it all here: http://www.ceaccu.org/ley_garantias_bienes_consumo.htm  It is worth printing a copy to take with you if you have a problem, even if you don’t speak much Spanish, as it is common for the retailer to insist that it is the manufacturer who is responsible and say either ‘we will send it back to the manufacturer for them to look at it’ or 'we will arrange for a tecnico to visit.'
 
Even If you don’t speak enough Spanish to get the gist, it is still worth printing it all off if you are going in to battle, but all you really need to know is that
 
The period of the guarantee is a minimum 2 years
 
During the first six months you have the right to choose between a new item and repair. They will almost certainly try to get you to accept the repair – be firm if you feel that this is not appropriate.  Clearly it would be unreasonable to insist on a repacement for a minor, easily repaired fault, but if an item has a series of faults or just plain doesn't work properly, then a replacement is more appropriate.
 
Responsibility to resolve any problem now lies with the vendor and it is up to him to sort it out with the manufacturer. This should mean that if you opt for a new item, you should get it without prevarication, and if a repair is appropriate, the sorting out is his responsibility and presumably he should do it quickly.
  
If you meet with resistance, then you need to ask for the hojas (or libro) de reclamaciones. That usually does the trick as these are taken very seriously by the authorities, but it is a bit of a pain because the onus is on you to take your copy to the Consumer people at the Ayuntamiento to register it.  ate.
 
Clued-up retailers find this law to be better rather than worse for them – one told me that she is delighted because she has plenty of power with the suppliers and she much prefers to keep her customer happy with an immediate replacement and sort it out with the supplier later.

I believe that Keymare are the vendors ,they received our monies instructed the contractors .This situation is different from the UK ,because the white goods came as a package with the apartment ,bought as one and with a direct contract with Keymare.We need first to establish the facts with some-one with Spanish legal expertise.,and state who is the vendor an opinion is not sufficient..

I just want to reassure anyone who is reading this thread that I do not post any information that is provided by anyone else on the forum, without first checking the facts for myself.

I also want to clarify that the information that I posted (by Jane B) is not an opinion but is stated fact on the website link that I also provided. (which if you google ceaccu & use the translator, you will be able to see for yourself).

Jane's article does not mention anything about getting an independent check done & what effects this might have on the guarantee but the ceaccu site does cover this issue. Because the translation is not entirely clear, I have not previously commented or given an opinion on whether the guarantee is affected.

I have simply said that I personally, would rather be safe than sorry & if getting it checked means that the guarantee is worthless then that is a chance that I am willing to take.

However, I have made an enquiry to carify these issues through both the ceaccu & Maria de Castro.

I would query the guarantee invalidation. A EU rule was brought in a few years back that allows "suitably qualifed" personnel to work on items, provided manufacturer original parts are used. This was actively used against the car industry and their "rip off" dealer prices to allow Joe public to use their freedom of choice. I have also found that in the UK (I only have experience here, but we are in the EU) manufacturers don't use their own technicians, you get a third party contractor come out for repairs. I don't think Maria comes to the off plan forums, but is quite active in the main forum.

Thanks for your input. I sent a PM to Maria as I am pretty sure that she does only go into the general forum.

From reading the official site that I linked in the previous post, my interpretation is the same as yours, that if you use someone suitably qualified then the guarantee is not affected. But, as I also said, I do like to get my facts completely straight & that is why I have sought clarification.

I will post again, once I get a response.

Noreen,

              The air-conditioning in your apartment,would you be able to describe the problems that you are having with it,?If a functionality test was carried out, that would not be a breach of the guarantee.The problem would arise if panels or parts are removed.

I feel that the first approach in the UK or Spain is to contact the installers direct with a copy of the request to Keymare,if they fail to respond,then send a recorded letter.They must be given the right of response ,that is basic law irrespective of your country.

I cannot see the point in paying some-one else to service or maintain a unit that is still within guarantee until you have exhausted all avenues

The problem that I am having is regarding ,who is the first port of call ,Keymare or the installer.

I didn't actually say that there was anything wrong with my air conditioning. What I did say was that with so many defects coming to light & some of them extremely dangerous, that I would rather get it independently checked.

If I choose to get the system independently checked then I don't see that I have to contact the installers or give them the right to reply. I would rather use someone who has been recommended to service & maintain the system, regardless of whether there is a guarantee or not, simply to have peace of mind that it is being looked at properly.

Maria de Castro has confirmed to me that it is Key Mare's responsibility as part of the snagging to deal with the air con issues.

Maria has not answered the question about whether having it checked/repaired invalidates the guarantee so I am going back to her on that point.

I emailed Key Mare Head Office on Friday stating that the information being given was against Spanish & EU Consumer Law & that I had involved a solicitor in reaching this conclusion.

With the Bank Holiday, I don't expect a response just yet.

I have now had a response from Maria de Castro. I have copied my original PM (in bold italic) followed by Maria's answer (in red bold)

I hope that this information is of assistance to anyone with these types of snagging issues.

Key Mare have not responded to my comments that the information being given by their staff is against Spanish & EU Law.

I have also brought this to the attention of Seasun but again have not received any response as yet.

I bought a fully furnished apartment from Key Mare Property Developers in Vera, Costa de Almeria in October 2007. This including air conditioning & kitchen goods such as fridge/freezer, washing machine & Dishwasher.

There have been many problems with the air conditioning in many apartments & some of the problems are quite dangerous (where the electrical connections have not been done properly!). Some people are also having problems with the kitchen equipment being faulty.

The apartments came fully furnished & we only paid money to Key Mare so I believe that they are responsible with dealing with & resolving these issues. However, they are saying that the owners now have to deal with the suppliers/manufacturers in getting the problems solved. Obviously this causes many problems, through language difficulties & also the fact that many are only in Spain for very short periods of time.

Is this correct or should Key Mare deal with these issues as part of the snagging process?

Key Mare is responsible of that as part of the snagging process. We will be willing to send a legal letter to them on behalf of every member experiencing difficulties with those elements.

Can you clarify please, if someone gets their air con independently checked does that affect the guarantee? If any repairs are made, does that affect the guarantee?
It does not affect the guarantee and you can ask Key Mare to refund the expenditure of the repair back to you.

It will be interesting to see how Key Mare react to this.

It will be so much easier if they accept that they are in the wrong rather than owners having to go to the expense of getting legal letters issued!

We will have to wait & see. I know that one person was approaching KM with this information & I have asked to be kept informed of progress & I will update if I hear anything.
