Masa have just phoned to say my property is ready 13-25 open, i asked about the habitation certificate and was told it would be a few weeks but there was no problem in obtaining. I replied i wasnt taking possession till it was ready they said if i had heard nothing in a couple of weeks to get in touch with them.

As i am not going to live there yet it seems silly to make the final payment before every T is crossed and every I is dotted after all they have kept us waiting long enough

Thanks for info.  Our solicitors have been told much the same (a few weeks - always is!!!).  We are buying on M14 and like you we are not going to live there, so not signing until everything in place.

With the bad euro rate there are more and more people starting to use this as a reason to delay completion

Again for the record you are legally within your rights to refuse to complete and there have been numerous cases in courts where the developer has lost when they have tried to enforce the completion clause

Most recently a developer that had a fixed completion date with late compensation penalties attached lost an action brought by 5 owners and it cost them more than €50k in compensation payments

I have also had the 'phone call from MASA saying they were "wondering when I was going to complete"  (I'm also on M13) and I gave them the same answer re the hab cert. My lawyer says the town hall have had the application but this doesn't mean anything - although things do seem to be progressing

The Town Hall has to then come out and inspect the site and it does not automatically agree the Certficate

With the sheer number of properties being built in the region this is not a quick process, there are long delays waiting for the inspectors availability, currently estimated at 5- 6 months for new requests

We had this sort of communication with our agents Atlas international last year all about the town hall adn Masa refused to give any compensation for the wait.

We signed and from meeting others on the site that week 5 - 12 Jan 2008, when visited the site durigng the week while sorting everything out completing with the notary on Friday 11th
Jan 2008 we then collected the Keys although we still have some snags that need doing.    

Meeting some of those already in residence and hearing how long they waited we began bthe process of buying in Oct 06 our house was built,  we  were supposed to complete March 07 - June 07 and all we kept getting was No roads then it altered to no services electric and water, then  No hab cert town hall and finally back to no electric or water.

We made a decsion to come anyway although the connections have not been done to them but we were pelasantly surprised that teh Electric is connected to mains so we will get bills already.

The water we thought was connected but it may have still been the builders but we were assured that this will be connected within a week or two after completion.

What does not make sense is how they have not applied for all the hab cerificates over the last year and it seems that they are not even in blocks.

 When were at the notary the builder rep was the most miserable man and i was thinking you are actually selling adn completing you should be pleased.

Hi Trisha and Denis. I am still confused, do you actually have your authentic Habitation Certificate yourself, not a copy or a request for it but the actual certificate?

Our dates are exactly the same as yours, bought Oct 06, promised March 07, then June 07, then ................... nothing. We are M11.

Hello fellow SG purchaser's. We paid our original deposit back in  Oct 2004 and finally signed in Dec 07. Our understanding
of the Hab Cert' is that its only real use is to get the eletricity/water officially connected, that being said it of course confirms the legality of the build and confirms that all the services conform to townhall spec'. I have been told that the service provider will not connect without sight of the H/C, ours is connected and we are going over in Feb so will report back if it is amongst the papers with our Legal people. As to anyone delaying completion in the hope of the pound improving on the euro the best advise I have got is very unlikely by much, perhaps we should have gone into the euro zone !! or is this another thread. kind regards to al at SG PeterPam.
