Medina el vira nightmare!

I have paid a substantial deposit on an apartment in the Medina golf development  near Granada and after 8 years, yes 8 years!!  am still waiting ( not very patiently) for the return of the deposits !  I do have a lawyer and there is a case being prepared for court  but to be honest I am flabbergasted that the Spanish legal system seems to be able to make up it's own rules and regulations! Are we not part of the EU? Why can the Spanish legal system simply bend and change the law to suit them! After 8 years I am desperate to have my deposit returned, I have even contemplated chaining myself to the outside of either the bank involved or the Court building in an attempt to get someone to take notice!! 

Please can anyone who is in the same situation as myself get in contact?

Your lawyer needs to be going to court against the developer and the bank or insurance company - depending on how your bank guarantee was done - jointly.  No good just going against the developer, they and their assets are long gone from Medina Elvira.  You will only get your money back from the bank or the insurance company, who have joint liability.

Debi46 have you had a result yet?  More deposits have been recovered recently from developments on Medina Elvira, all of them from the bank.

The small group of us,who won the case in December, also won the appeal in June. In the appeal the judge also agreed with us that interest should be paid back to the date of payment and not the date of our lawsuit. Today the 20 days for a Cassation Appeal to the Supreme Court are up, so hopefully we should no soon whether there is a further appeal. 

That's great news for your group - I don't know if Debi46 is one of you?  Was the case against Cajamar?  I hope you don't have any further problems with appeal and you get your money back soon.

In two of the recent cases (on a different development at Medina Elvira) Cajamar bank have settled out of court.  That would seem to be a good indication that buyers have a strong case if they have a guarantee or can prove their deposits went into an account for off-plan purchase.
