Top Gear - 14 July

I have just watched Top Gear this evening only to see Medina Elvira being shown as an example of the fallen economy in Spain. Anyone else see it?

Funny that, they actually spoke to 2 people who live permanently in Fairways.....and our maintenance guy!  but hey, what's a bit of dramatic licence between friends.  We were there, but had gone out for the day and missed all the excitement.  On being greeted by one of our neighbours, Jeremy said 'Good god, you're f***ing British'

The 'sound level' trials were done on the road in front of Tee 17, one of two unfinished developments at Medina.

The first shots showed them going up the road between Suites, Fairways and Medina Elvira 23, 'finished' developments where there are some 50 owners of apartments altogether. 

The programme certainly highlighted the crazy situation in Spain at the moment.  We await the outcome of criminal trials and to find out if we will ever get a permanent water supply or be legalised. 

Medina Elvira 23 actually looks not bad once you get inside the gates.  The apartments are great, many with stunning views, especially from Fairways.  Can't wait to get out there next month, yes we are a little crazy but we're paying for the place so might as well make the most of it, and you never know who might turn up next :) 

 Glad to hear that things are not quite as bad as I feared. We were very fortunate in some respects that we did not complete but sadly we never had a bank guarantee and are still trying to get back our deposit though we have a lien on a property in Marbella after the courts ruled in our favour. We do not know what the situation is with Peninsula but maybe one day their assets will be sold to repay their creditors.

I hope that in due course your situation is legalised and all the appartments are sold.  It's such a lovely part of the world.

Peninsula Property Management are in bankruptcy, I guess the most important thing you can do is make sure your lawyer is talking to the bankruptcy administrators, hopefully your lien will give your claim some priority but do make sure the administrators know about it.  For some reason they knew nothing about the Community Fees debt left by the developer and all liquidity had already gone (funny that) so we too are waiting for assets to be realised.

Of course Keith Rule's recent victory has demonstrated that it's better to go after the bank for refund even if no bank guarantee was issued, and that this is backed up in law, probably not much help for you as your case has already gone through but might be worth talking to your lawyer again.

I hope you see the colour of your money sooner rather than later.
