Marcus Smith it would be interesting to hear on what grounds you got your money back on a property in Medina Elvira 23.  Both ME23 and Fairways had Licence of First Occupation issued which would in most circumstances mean that completion of purchase is required under the contract of sale.  I would be very keen to hear from you about your case and the lawyer who handled it.

Neither Eden Golf nor Tee 17 have been completed, in the case of Eden Golf not a brick has been laid.  Tee 17 has been more or less abandoned without being finished a large part of the development at one end is still a shell without rendering or internal finish, and the building is surrounded by fences.  One apartment is occupied but I am given to understand this is the son of the builder who is living in one of the apartments as some kind of 'on-site security'.  In both these cases it should be possible to seek refund through the bank guarantee and indeed I have met a purchaser who did have all their money refunded on a property in Tee 17 though I have also heard from others who have not been successful.

We too were successful in recovering our deposit on an apartment in ME23 plus interest and costs from the Guarantor ACC. We believe that the late completion was a sufficient enough reason.
