Hi those of you having bought apartments with Touristic Licence and not Habitation Licence on El Rincon might be interested in info from Maria, a Spanish lawyer, see below (on another thread).

"A touristic apartment is built on turistic land where residential proerties are forbidden.  They are usually marketed with full furnitures, front desk services, laundry utilities...MAny developers use this " illegal game" to sell touristic units as residential apartments ( at residential prices). You will end up having a property with a touristic affection by which you legally need to put it in the market for a certain period of time a year.

If you want to buy a touristc aparment take into account taht you need to be offered of a " touristic explotation contract" together with the purchase contract.

My only advice: be sure on what you want, on what you are buying and be careful! " End

Hi Impey, how can the builder sell these apartments with either licence, if residential properties are forbidden, surely the solicitors of the buyers should of picked up on this, could you not try and contact the president on the other phases by the roundabout to check their licences issued?  I am there in 2 weeks, shall I ask around for you?

Hi, would be grateful if you could find out more about what is going on at El Rincon when you go over shortly.

My boyfriend has not signed yet for El Rincon as he is awaiting (like several others) for the Habitation Licence etc to be issued.  On another posting someone said that the few people who have signed appeared to have signed on Turistic Licence only.  I then queried on another thread if anybody knew the difference between Turistic and Habitation licence and Maria, Spanish lawyer very kindly supplied the information which I quoted in my posting.  I then posted her info on this thread.

None of it makes sense to me, I am completely baffled as much as you are.  And while all this is going on my poor boyfriend is still in rented apartment waiting for a signing date and his furniture/belongings are still in storage.

HI Impey, I will make enquiries for you whilst there, I'll ask around at the other phases.  I would suggest contacting your solicitors and asking them to confirm which licences would be issued.  Although I did read elsewhere on another thread that no one actually abides by the rules of property that have been issued with a turistic - its Spain!  I am sure it will all go well, my apartment was six months late completing - but it was worth the wait.

Hi everyone

I've spoken with our agent Medsea tonight and they have informed me that they have had several clients complete in phase 1 on both the Habitation and Touristico licence (sorry not sure of spellings), only verbal I know but sounded plausible, they did say that they still have some clients that have not completed but this was not related to any specific problems.  If anyone is waiting to complete on phase 1and is a client of Medsea I would suggest you give them a call and then if possible post a message to let us know how you got on.

I'm over at Easter and I'm going to call into their office for a chat so I can always check stuff out if needs be.

They also believe the phase 2 properties are complete and that all paperwork should be completed for possible completion by the end of  May, however they never mentioned which year !!!!.

Again good luck to all those who are still waiting to complete on phase 1, hopefully see some of you around by the summer.

Hi again.  Yes we are waiting like mugs while it seems loads of people have signed on Phase 1 El Rincon.  I don't know which blocks they are in (ours is Block 1).  Perhaps they are making us wait till last.  Our PE teacher at school told us all once that "the first shall be last and the last should be first".  When we questioned this, she said you will find out when I am good and ready, well I am still waiting to know.  Laugh out loud!!!!

Update on this thread.  Just been told we are signing for Phase 1 on 22nd March (supposedly) (we shall see).  Also that most people having already completed are on the 2nd floors with Turistic licences.

Hi Impey, don't know where my post went either! Maybe Justin is trying to tell me something?!

Anyway, I would like to know how will the touristic licences will affect owners?

Does that mean that they will have trouble selling in the future? I think I would shy away from buying a property that HAS to be rented out periodically throughout the year.

Fibby, hi,

You have raised a very good point.  I am no legal expert but if some of the Touristic Licencees (if that is the right word) have signed first then perhaps it was a simpler process than those signing with the Habitation Licence and that is why they have signed earlier than a lot of us.  Any legal beavers out there?

Fibby hi,

Just had another thought, don't know all the inns and outs of the different licences, but surely it would be better to have a habitation licence to sign on and then sort out later if you want to rent or not, rather than the other way round as one's circumstances could change.  Unless of course the touristic licence saves one having to register with whoever it is for renting and paying rental tax, if you know from the outset that you want to rent more than live in the apartment yourself.  Complicated eh!

Hi Impey, just a thought, the builder was selling some apartments, fully furnished, maybe these are the ones that will be issued with the turistica licence, the unfurnished ones may have a habitiation licence.  Did you buy yours furnished or unfurnished?  On the Torrevieja web site there is a thread for legal questions, I have posted a query for you - asking to specify the difference between the licences.  Hopefully they will come back with some info.  Will let you know

Thank you very much for your replies.  We are buying ours unfurnished although we could have had a furniture package.  In the end as my boyfriend sold his house in the UK, he had the furniture shipped over but now being stored near Torrevieja until he can get in the apartment.  And also thank you for putting the questions over on the legal question thread on the Torrevieja website.
