Hi All Phase 1 owners

We have just received a letter from the Multiservice Bureal L.M.C, based at Miradores, La Manga Club.  In it they say as they specialise in the administration of Communities within Golf Resorts, Roda Golf has requested their help in setting up the Community of Owners and to organise the AGM.

They enclosed a budget for the 9 months from 1 March to 31 December 2007 as well as proxy forms and forms requesting information about individual ownership and an agenda notifying of the first AGM at the 525 Hotel, Los Alcazares on 16th March.

Now, the budget for the 9 (nine) months is a whopping Euros 583,252 and is in respect of 378 dwellings, averaging Euros 1543 per property for the 9 months, which when extended means approximately Euros 2057 average community charges per profperty or at euros 1.48/£ about £26 per week per property. 

Does anyone have any comments?  For example is it normal on community charges (as in England) to apportion per size of property? 

Also, does anyone know what a Conjunto Inmobiliario fee consists of - this is some 68.85% of the General Budget and amounts to Euros 226,019.  There is also a reserve fund of some 95,318 euros.

This figure seems very steep.  I think its normal in Spain to proportion the cost out by the size of the property.  So we'll have to wait and see.  This figure also seems very steep considering they haven't finished the landscaping on P1 or the planned facilities.

I agree that this sounds very expensive - we have also bought at United Golf and although some may say that is not of the same standard as Roda, we have been told the community fees will be 40 euro p/mth and that will be with all of the sports, etc facilities up and running at phase 1 completion. This sounds like another example of Roda taking the proverbial if you ask me. So Roda are four times as expensive as United, not too sure what extra we would get for that premium - very little I would imagine !!

What choice, if any do we have in accepting the offer from Multiservice or can we choose do go elsewhere ??

Also, how many people will actually be able to attend this AGM in March at such short notice, not many I reckon ??

We received the community charges today as well, and there are lots we do not understand. For a start we thought there were at least 600 properties on phase 1. As there are 1800 properties in total and phase 1 is the largest phase, 378 dwelling is not logical. By the way conjunto inmobiliario  =  real estate assembly………..and no I don’t know what that means, either. When we first looked into buying at Roda, we were told the charges would be about 800 euros per year. I am writing to Roda now to see what they have to say.

I did a bit of searching on the Internet and found an email address for the Abogados at La Manga who form the Multiservice Bureau and have sent them the following email tonight: to angel@msb.es

 

Dear Sirs
 
My name is Sandra xxxxx and I am an owner at Roda Golf Phase 1.
 
We have received  documentation from your company relating to the proposed AGM on 16 th March and we have the following questions:
 
1.    Who is the "President"
 
2.    Please can we see a copy of the "President's Report"
 
3.    How many members form a "Quorum"
 
4.    What does "Apartamentos P11" consist of
 
5.    Will the charges be apportioned per square metre of property owned?
 
6.    How was the budget figure for all costs calculated - what are the basis for the charges - there are no historic costs so I assume all charges are "guesses"?
 
7.    What is a "Conjunto Inmobiliario fee"?
 
8.    Who has agreed the Administrator fee?
 
9.    Why is the reserve fund figure so high, given that the property is brand new and is covered by the Spanish equivalent of the NHBC?
 
10.    Do the gardening and swimming pool charges also include the cost of maintaining the golf course?
 
11.    Why are there extra "water" charges when these are covered by individual accounts?
 
12.    I presume the TV expenses are the Sky charges ?
 
13.    Are the lifts not covered by a first 12 months guarantee figure?  For example, the lift near my apartment was not working in January.
 
If anyone can think of any more queries, then please let me know so I can add them to this list which I am also going to send to Roda Golf Customer Services and my lawyer. 
The documentation asks you to sign a Proxy to either nominate the President to vote on your behalf or nominate someone else.  I think we need to get together on this one, agree the questions, find a common nominee who will veto or vote according to our wishes or attend ourselves.   Has anyone else got any thoughts on this?

This is great work Sandra - how do you fancy becoming President  ??

Seriously though, this needs some real expertise otherwise we will all get railroaded into being overcharged for who knows how long.  Appreciate your efforts so far and will let you know if I can think of anything else - certainly I would not expect to pay one penny for the golf course upkeep as this should be a stand alone business.

Thanks for the vote of confidence - but my skin is not that thick!  Terrible job being el Presidente!  Although we are going to have find someone from the owners eventually to do the job  - I understand from other friends who have done the job that it is a thankless task.  I am just concerned like Mike and yourself that we do not get ripped off and that the proposed charges are fair and reasonable.  I am totally gobsmacked by the Immobiliaria charge - mainly because its a huge amount of money - 67% of the budget and I don't know what its for! 

 Is anyone intending to attend in person? 

At the moment, I feel like booking a flight out there for the meeting but have in the meantime written to my lawyer for some advice on the whole subject as well as Roda Golf.

Looking forward to more responses and more questions please.  Let's hope we can get some answers from the Administrator and/or Roda Golf.

Just booked flights and will be there for the meeting Friday 16th of March (hope they don’t change the day). I am going to go the day before and come back Saturday. Got really good flights £45.00 return (all inclusive) with Ryanair. Funny thing is we are going out on the 2nd of March for a flying visit! Sods law I think.

I forgot to say, in your letter, can you ask if the figure 378 is just a proportion of the dwellings on phase 1, sounds to me like it is just the apartments.

     Hope to see you and a few owners there

After an email from Frank here we thought we'd give you some background on this.

The first year, or 9 months in your case, is always a nightmare.  The developer appoints an administrator who then puts together the budget.  It is quite normal to fire the developer-appointed administrator after the first year, as they are not always the best for the community.

The first year budget is a lot of guess work as no one really knows how much it's going to cost to properly run the community.  It therefore tends to be higher than it should.  All budgets must have a 5% reserve amount in them by law.

Thanks for your advice Justin.  I will continue my researches and probing questions to all concerned!!   Its a minefield - I thought the time leading up to completion was the minefield, but this is a real challenge!

Hi

We did get the letter to day. And we are not happy we dont onderstand this fighers.

1.Conjunto immobiliario fee : what is that, we have payd for cardening, clening, the lifts, water and electricity, insurance policy that what is left?

2. 378 Dwelings ? That we dont onderstand is ther not 600 apartments on face 1.

3. Are the fighers going to get higher when they hend over the rest of faces on Roda golf?

I did fhone Roda golf and they did not knove enithing then i did get a phonnomber for somvone that do knove. Her name is Maresol and the phonnumber is: 968 1751 46  and the email is maresol@msb.es

I did ask her about this qustions and she told me that it is not final and they are looking for somwone to get it chiper. And i did understand that the 378 is not the hole face 1 ? And all of my qustions will be ansered on the 16th of mars.

We are not happy with this, and we are thinking of comming over if we can get some time from work. We hope that we will get it chiper then this and we are hoping that we will meet you all out ther.

Hi Hildur

I am now planning to attend for this meeting.  I have got some correspondence now from the Administrator but they are still saying that all will be explained at the meeting.  I am not sure that this is terribly satisfactory but I am still trying to get rationale's for their budget guesstimates.  If I get any new information I will post it here.  I have a feeling that some of this budget relates to the whole development and some to just the compelted properties, but I can't be sure!

Equally, if anyone finds out something concrete, then let me know, please.

Hi

We have also received our letter today and are amazed at the proposed costs - also do not understand why some of the costs are even in there. We will  not be able to come to the meeting on 16th march but have to send our proxy form to someone who is going and is willing to be proxy vote for us. A volunteer please and then we can put the form in the post to you. Suggest others do likewise or we will end up being railroaded by this management company.

HI,

Yes another one about the charges, I havnt a clue what all this means but we cannot go to the meeting on the 16th as we are off on a cruise.So is it possible I could send out form to someone who is going over. They havnt gave much notice for the meeting, and the costings seem well out.
