We were due to complete on our Penthouse Los Naranjos (Block 12), next month but for the second time (suppose to complete last month) we had a phone call from Polaris to say that the habitation certificate has not come through, so I have told Polaris to cancel appointment at Notary office and will wait until habitation certifcate comes through but they can not tell me when this will be.

 My dilemma now is PW have said I must complete in 20 days of receiving certificate, but not able to get over to Spain before February, and if over 20 days passes it will be referred to their legal department. Surely after being messed around TWICE they should be a little more flexable.

Anybody else had this problem?

We had a very similar situation.  We went out in August to complete but again PW did not have all paperwork ready.  They put pressure on us as we really did not want to have to sign for power of attorney with our solicitors but again they said they would pass us to their legal department.  It was a very stressful week but in the end we had to sign power of attorney which cost us about 100 Euros I think. Ironically now we're chasing them with our snagging list and they're way out of their 30 day legal requirement - it's very one-way.  Hope you get it sorted.

Congrats Simon!!!!  

I know when we were completing there were 2 other couples who were in a similar position to you and they had to sign over POA which Polaris paid for as a result! I thought they told us that we had to sign with in 30 days not 20. We were given a date to complete of 15 August but we didnt even have our mortgage organised yet. So they gave us a months grace and changed it to 15 September, we finally completed on October the 3rd!!! and yes we were threatened with the legal department too. Once we were in contact with the legal department I found things actually went better!!

PW pay for the POA.

These situations are very similar to what happened to us but we decided to go with POA as we didnt want to sign without the Hab Cert. When they actually got their act together and produced everything together on the same day the process was very smooth  and it resolved the 20/30 day issue.

Hi everyone

Just founf this threas and I have a question. PW have sent us an e-mail to complete in December. They have attached what I think is called the Licence od 1st Habitation.

Is this the actual COH licence that so many people have been promised but not having on the day of completion. If not, what is the differance.

Would appreciate advise on this.

We have found things a lot better since being transferred the Legal Department rather than customer services who I assume must be on some kind of bonus for earlier completions. The Legal Department seem far more courteous and as long as you keep them informed of the situation they don't seem to pressure you.

Having your solicitor talk to the Legal Dept also helps
