Hi - Apologies about starting a new thread about POAs, but can anyone that completed with POA tell me, when you give POA to your solicitor, do you have to be there personally to do it? I know this has been covered somewhere but I can't find it. Thanks.

Yes and No,  The POA has to be notified, either in Spain or a UK Notary.  Here are the emails I've had on the subject -

From the Spanish Solicitor-
"We write to inform you that you can grant the POA for us in a notary office of your country or in Spain.
We would draw up the document in English and Spanish and send it to the notary office to be signed by you(your wife and you) and the notary. The notary has to apostille the document with the Apostille of the Hague.
You would have to bring your passports at the notary office.
We also inform you that we charge an extra fee of 200€ for this service and you would also have to pay the notary fees for the signature and the apostille."

I then contacted a UK Notary and got -
"I am happy to notarise and legalise (apostille) the power of attorney for you.  I assume that your Spanish lawyer will provide you with a PoA in Spanish and a translation if you need one.
If the PoA is to be signed by just you, the cost of notarisation would be £75.  The Foreign & Commonwealth Office charge £27 for the apostille using their standard service which can take 2/3 weeks.  If you need the apostille more quickly, it can be obtained in as little as 3 days, but at additional cost."

As we are buying in joint names I asked about that, and the cost of fast tracking -
If I see you and your wife together, and you both sign the same document, the cost of notarisation and organising the legalisation would be £90.  The accelerated legalisation is done through London agents who charge £15.  This reduces the normal legalisation time to about 4 working daysYou can save a further day by using the FCO Premium same day service at a cost of £67 (instead of £27 for the Standard service).

Hi All,

We have just completed yesterday using a POA. 

Our solicitor did everything for us regarding the POA he emailed me the document whichwas in english and spanish which we both signed.

We sent back with it authorised copies of our passports (certified by our bank manager) and our solicitor did the rest.
We were charged 600 euro which included getting our NIE numbers and the whole process was totally hassle free.

Hi Martyn and June

My Solicitor emailed me a sample document of what they needed in POA and I took that to the Manchester Spanish Consulate and made the application there. I paid no fee to my solicitor for this but did have to pay the Notary at the Manchester Spanish Consulate about £40? We had to make two visits to the Consulate 1 to make application and then to see Notary, we then sent the POA to our Spanish Solicitor. If this were an option for you I would think there will be a Spanish Consulate in Birmingham

Thanks very much for that.  Had no idea that the consulate in Manchester had a notary service, sounds a lot easier and cheaper than the private notary that I had contacted.    Why is this so much like hard work?  Why do we get told different things depending on the solicitor you use?    Stonephil just sends over a couple of photocopies and I get told to go to a notary then get a FCO stamp etc etc.  Now it turns out the consulate go do it.  You'd think that there should be a single process that is the same no matter what solicitor you use?  Ho Hum, I'm sure I'll get there in the end.

Thanks for the replies, they are all a great help - Phil (PGM) regarding the Consulate in Birmingham, I have just done a search and found a Spanish Vice Consulate, whatever that means? - It's interesting that Phil (Stonephil) (There are so many Phils on this site) did his without going to either here or Spain. Will have to get our solicitor earning their money. Just a thought before contacting solicitor and looking a complete idiot, we have now arranged to collect our NIEs on the Friday, of the weekend that we had already planned to go out. Would this be an opportunity to sort out the POA? Is it at the same office? - PS If this post comes through about 3 times, it's because the message kept disappearing whilst I was typing, don't know where it went.

We completed by POA from the UK - it was extremely easy and stress free.  The total cost was £195 including the courier fee to Spain.  Our Spainish Solicitors emailed the POA to me which I forwarded onto the UK notary for completion together with copies of our passports and a utility bill.  She then visited our house on a Saturday afternoon bringing her husband along to witness our signatures.  

She charged £75 for attesting two signatures on the Power of Attorney and £15 each for notarising copy passport (bio date page only).  She then organised the Apostille of the Hague and arranged for the POAs to be couriered to Spain.

Anything to do with Notary's in Spain seems to be complicated and takes an eternity.

We were lucky, although I am sure we paid for it, we have not been near a notary office for anything. to that end our solicitors have been brilliant.

Why do you need POA?

Is it in case you are not able to complete due to lack of habitation cert or something. If so from the other threads on the forum PW have been paying for your solicitor to arrange POA at that time. I only did POA as it was always likely we wouldn’t be able to complete for our selves so did it just in case.

Just for information we also did NIE at Manchester Spanish Consulate at no cost, but after applying you receive NIE it in the post ours took about a month but thay worn you it may take 3 months.

Hi Phil - As you may be aware everything seems crazy at the moment so forgive me (June) if I sound stupid. I had forgot about PW paying for POA, but even so, I'm not sure we'll be able to take advantage of it. As I said before, we already have flights and accommodation booked for the 12th September so don't think we will be able to get over there again for completion at the end of September (Don't forget Martyn is working.) So it's not like PW can't deliver on the day is it? So surely it's our fault and we will have to arrange our own POA? What do you think? - PS. Have you heard anything?

You could ask to bring completion forward as you will be out in Spain that week anyway, that way if they are not able to complete due to Habitation Cert they will then pay for POA?

It’s worth asking your solicitor about doing POA at same time as NIE as the Notary does them both.

No we haven’t heard anything about completion or mortgage so far.
