Jack - I suspect that you are probably right but personally I do not know. If you are buying on OCC then  I trust that you will know the answer to this question. However, this was not the point of my earlier post ( as I am sure you can see I rarely post). The point of my post was to ask you not to be disrespectful to other people ( by referring to them as mugs ) and to post information that will help people. As to my question in my earlier post could you let us all know whether or not your solicitor has advised you about Huma going in to administration . As I am sure you can understand this concerns everyone, whether they are waiting to go to court or for a property on OCC, and if your information is correct we will all be grateful to you.

With all the talk about Huma Med SL going into administration which seems to be a false rumour I decided to have a look again at my contract for OTCC, just to reassure ‘myself’ that I did make the right decision to change to OTCC February 2008

 

Tarifa @ 119.000 € plus IVA…still seems a good price…show house looks great

Deposit paid 53.931 €

@ 1.4607 > £34,868

 

Huma Indalo SL is a separate company set up to build OTCC

Manzana 1 has all the permits

Finance of the build is by Banco de Andalucia [not a Caja!]

Right to subrogate this mortgage for plot 11…..so no problem in financing the balance in Spain if I want to

Completion date May 2009 with a possible 2 month delay to end July 2009 [LFO, Escritura etc]

Now part built and looks like being ready in time

Guarantee for Manzana 1 of the deposits 1.400.000 € , interest 158.234 € from Vitalicio Seguros [ part of Banco Vitalicio de Espana C A]

 

Now compare for me with December 2007!  

 

No bank or insurance guarantee

Deposit at risk since November 2005

New planning decision awaited and then anticipated to be granted

Huma Med SL stops refunds unless you have a BG

February 2008- no planning-help!

Thoughts then:- with all the investment they have made at ACC can Huma Med SL survive this?...appears they can!

 

All I can say is that from ‘a personal point of view’ I feel ‘very’ much safer than this time last year!

 

OK, now in a full recession world wide as bad as the 70’s and maybe the 30’s, so the development at OTCC may well be slowed down [just like all the others everywhere]

But the immediate facilities for Manzana 1 will have to be finished or I do not have to complete the purchase and I can cancel the contract and get a refund

 

My deposit of 53.932 € is now worth £49,029 :-however  I do expect the Tarifa  to be completed so not relevant

 

If I had stayed in ACC and gone the court route [having no BG] the whole of 2008 would have been very worrying and I would be in the same situation as Decmeber 2007 

I for one am happy that I made the right decision’ for me’ last February and now look forward with reasonable confidence to using my Tarifa mid 2009

 

Those going the court route then good luck, but rather you than me!...and I hope on the ACC Forum you can all keep in touch and share your experience and concerns during your court cases

 

Those of us who have made the change can keep in touch on this OTCC Forum 

Lets look forward to a great 2009 with a property in Spain!!

As I said in my post I am advised that my deposit is guaranteed by Vitalicio Seguros which is part of Banco Vitalicio de Espana C A [ see previous post for details]

I have also translated the document as far as I am able and I read it as giving this group cover

I have also spoken to others who have changed to OTCC and they have been advised by different lawyers that this group policy provides a guarantee 

It is not as good as an individual guarantee for each plot and I have not yet received one..I must say however that I have not been pressing hard for one although I am told one is on it's way

As also explained in my last post, 'for me' I am in a much better position December 2008 than December 2007 and by December 2009 I expect to have a Tarifa

I may not but again I repeat 'for me personally' I would rather be in my current position than involved in a court action in Spain and still be as I was in December 2007!

But, I did not have a BG for ACC

I understand that those that do have an ACC BG and have changed to OTCC do not give up the ACC BG until they get an OTCC individual guarantee- there is a general clause dealing with this aspect in my contract

So roll on 2009......getting the Tarifa may be the only good part of 2009!!!!...except perhaps 0% base rates!

So you don't have a BG as Spanish law states you should!

You say you have translated as best you can. Why not get a real translater to do it?

Has your lawyer looked at it & given a definative answer?

Do you even have a lawyer?

You are not in a better position than you were with ACC. You still do not know if this development is going to be built & you don't have a BG.

Why haven't you been pushing for one? Or don't you want to know the answer?

What is your position as regards OTCC or ACC for that matter..do you have a BG for ACC...are you going to court....how much deposit did you pay...when do you expect to get your money back...how much is it costing you.....do you know that Huma Med SL has the money to pay you if you win.........nothing really to do with OTCC

ACC is history to me....what is your interest in OTCC 

Have to you been to the OTCC site to see building in action 

I think I have fully explained where I stand, the advice I have been given and that I will let it run

Of course you may be right.....my half built Tarifa may not be finished...the Vitalicio Seguros guarantee may not be as good as I am advised.......we shall see

Anyway lets hear about your involvement in OTCC or even ACC ...although I repeat ACC is now history to me

I note that YET AGAIN you choose not to answer my questions.

You know that I am not a buyer on OTCC (thank GOD!), & I did not buy at ACC thanks to advice from my UK based lawyer who told me in 2005 that the development wouldn't go ahead.

How interesting that you say ACC is history to you.

How many people were convinced that ACC would go ahead because of your posts?

How many buyers delayed taking any action because of you?

Now it is too late for them.

Now you are doing the same for OTCC.

Rob -Thanks for your post and I respect your honesty in telling us you are not an ACC buyer or an OCC buyer. Therefore, presumably, you have not been through 3 or 4 years of stress and worry and you do not have thousands of pounds of hard earned savings at potential risk. May I ask you 2 questions. 1. What would you do if, through no fault of your own, you were in this situation ? 2. As, luckily for yourself you are not, how are you qualified to pass judgement on what others are doing to try and resolve this mess? From what I have read Rowlands has never told others what they should do, only express his own opinion on what actions he is taking for himself.

martin.........i am not offensive.........huma are.they took 50.000 deposits of me and

between 1000 and 2000 other buyers for ACC knowing it was illegal that is at least 50million

more than any robbery, brinks matt, great train robbery all peanuts to huma...thats offensive.

I only want buyers to get there hard earned money back and now new people to get conned like the rest of us,   I only wish I had been told the truth & saved these years of stress.

I wont agree with people who are trying to sell humas properties or  humas poodles if that hurts their feelings too bad,  they can allways get a back hander from huma.

As for huma going bust,  my freinds who live on MCC told me staff are not paid and builders will not be back,  at the owners meeting the feeling is the worst its ever been,  i rang my solicitor who agrees and is trying to get a court hearing asap he thinks huma are on the edge,  i posted this to try and help buyers.

I tell the truth not lies.....I dont want to make money from people who have been conned but we are not all the same.......are we.

Jack  -I was not suggesting that you are offensive- I don't even know you. However, your post referring to your fellow buyers as 'mugs'was offensive. As to the rest of your comments about Huma, I do not challenge anything you say. You are in the same situation as many of us. Who knows what is the best way out if you have no BG? Take the offer of a property at OCC and hope that it will be built ? Yes, a risk as Huma may not deliver. Alternatively go to court, get a ruling in your favour, but Huma may not pay up and then choose to put themselves into administration. In that situation it will make no difference what the judge awards - we will only get a share of what they can return, if anything. If we had a crystal ball to tell us the best way forward I am sure that we would all use it. Please let us support each other as we all want a resolution to this. And I do hope that , with your last sentence, you are not implying that I am content to see people being 'conned'...........
