I have read the Laws of Horizontal Porperty and tried to search on the net.  Does anyone know when Community Chargres become payable on a property built on a plot within an existing community? Is it when the Licence of first occupation is received, before that or when the first occupants move in?

Hi Marion - I'm sure someone on the forum can give you the definative answer but I would suggest that the charge becomes payable from the date of the Habitation Certificate - if I understand you correctly and the community is already up and running.  We have properties on our urb that are still owned by the builder and the charge is payable on them - so it has nothing to do with when the first residents move in.  Would be great if the builder paid us as they owe us nearly 10,000€!

Community charges are due as soon as the builder hands over the property and a Community is formed. This does not necessarily occur at the same time that the Habitation Cert appears. Our HC arrived ( six years ago ) after we had been in our property for a year. By that time we had had the first meeting where the builder had handed over the Urb to the Community, a Presidente was elected and a budget had been drawn up and the Community Fees decided ( and paid ).

I too have searched for a "legal" answer to this query and cannot find any reference to it.  Maybe a sensible time would be when the property is completed.  From that date the builder would be liable for Community charges pro rata up to the date when the final payment is made by the purchaser, then the new owner would be liable for any payment due.
