I have spoke with a few of you in the last few weeks regarding problems at Condado De Alhama, esp mortages and completion dates.
 we are off tomorrow to sign for our property, which, was'nt supposed to be ready until the end of the year.

I know some of you have had letters from Polaris World stating signing being brought foward, also that the property MUST BE HABITABLE TO BE ABLE TO SIGN.

This is where i have my problems, my property WILL NOT BE HABITABLE, due to there being no water connected and no power connected, this could take betwee 30 -60 days and i will not get the certificate until it is ready.

I spoke with my solicitors this morning, and they said, if i have the letter or a copy of the letter stating completion at end of the year then they will be able to put a hold on the mortgage for me until i get the certificate.
 If i do not have a copy of the letter then i am in danger of losing my property, as i have no proof of polaris world saying this.

This is where you can help me PLEASE if you dont mind.

If any of you have your letter and could send it to me via email i would be very grateful because i have lost my letter.
I will need to print it off before we fly out tomorrow lunch time.

Why will you lose your property ???

Who is saying you can not sign until utilities are coneected ???

This is the norm for Spain, they always take 30-60 days after completion to connect, your mortgage company and solicitor should know this.........

PW Customer Services are adament that all will remain on the builders water/electricity suppl;ies until ares are connected, but its normal for you to complete without in Spain, you need your completion to actually apply for utilities theres no way round it.

If I am wrong please correct me, but this is what I have been told on countless threads and by solicitor and PW

Are you sure that they're not talking about the HABITATION LICENCE (rather than the property being HABITABLE)?  If so, the habitation licence is something that Polaris World arrange, and it should be available at completion.   If you buy a property in Spain without this Licence, then there is a chance you could lose it at a later date (think of it as a UK planning permission type arrangement). 

I know that others on this forum have reported that PW had given them a completion date, then nearer the time reported that the licence wouldn't be ready, and tried to put pressure on people to complete without the licence.   Those who had been affected sought legal advice on that, and the general consensus was that you SHOULD NOT agree to complete without it..  I think PW  then agreed to cover the costs of the individuals' to give Power of Attorny to their Solictors so that completion could be delayed slightly to allow PW to get the licence.  The snagging and NIE collection was going to go ahead independently to that. 

If there really is a reliance on utilities being connected, then I think that this issue is going to affect many people on this forum

Forgive me as I have been away, but are you getting confused with the Habitation License?

For people who are just about to complete, I gather you are doing so with this in place? as I read an earlier thread (that I cannot find now) of somebody saying they will not be issued until the whole development is completed is this the case?

Dan - I hadn't read anywhere that the licences wouldn't be ready at completion.  I've just managed to find th thread I was thinking of - which says that the legal advice is NOT to complete without it.  The thread was entitled "Completion delays", under the Condado forum.  Hopefully this link will take you to it -

Hi Leigh

Just to reinforce what others have said, as I understand it, in your contract you are required to complete as soon as the property is ready and if you do not you would be in breach of contract. However it is also my understanding that if a Habitation Certificate has not been issued for your property you should not complete and they cannot make you.

As has been stated on this forum it is normal for Utilities not to be connected for 30-60 days after completion and as far as I know this isn’t grounds to not complete, it is also reported on this forum that PW are leaving the builders Water and Electric connected which as far as I am aware they are not required to do.

We were in Murcia last week to sign for our NIE numbers with our solicitor. We asked this very same question. Yes it is normal for water and electric not be connected for up to 60 days after you complete. our solicitor is aware of this and has told us that is not a problem. However she has informed us that if the habitation certificate is not available on 4th july (when we complete) then we should not sign. She has been bugging PW on this issue for some time on behalf of us and other clients.. We will see.

By the way. The resort looked absolutely fantastic

When you signed for your NIE numbers, did you have to have your solicitor with you for this. I'm going over to collect my in August whilst on holiday and have not arranged for a solicitor to be there. Do I need him present?????

Can someone please advise.

We had our solicitor with us. She arranged everything, we followed her to the foreign office in Murcia (which is a very dodgy looking place) she barged in handed over our paperwork and it was a done deal. we should receive the numbers in the next 2 weeks. The whole process took no more than 3 minutes.

Hi All

I spoke to PW yesterday regarding our applications and about the procedure for collecting them the day before our completion.  Thay told us that we make our way to PW HQ and they will then transport us to the office to collect no mention of needing our solicitor.  Hope that helps.

Hi all,
Maybe to late to help on this but our solicitor e-mailed us some forms, we filled them in and sent them back to him with some photocopied documents. He then applied for and received our NIE Numbers in about 2 weeks. Didn't have to go anywhere or do anything ! I could dig out the full details if interested.
