Has Anybody else had problems with the electric shutters?

One of ours is working intermitantly, I have just had an E mail from Roda saying because it was not on our original snagg list then they are not responsible. Granted it has only just started going faulty but we have not had the apartment 12 months yet I am sure Roda should still be responsible, Does anybody know?

We have had quite a few problems with our electric shutters as well, in fact sometimes they will go up and down without anyone near them - spooky!

We didn't list them on our original snagging list either but we have never had any problems with Roda in getting the problems resolved, we even had to have the lounge one replaced because of the problems with it.

Don't know who you are dealing with at the "snagging office" but we have always found Andrea to be very helpful, nothing seems to be too much trouble for her.

Might be worth trying again.  Good Luck.

Hi RD,

               We had a problem with the Shutter in the Lounge it would not come down. We were out for the first time during the Easter break. We contacted the Customer service department every day of the holida. They sent out someone to check the electrics he said it was the motor as the switch was getting power. The day before we left to come home we went again, and they told us not to worry they would get round to it eventally. We informed them that if they did not fix the problem that we would get a local engineer to come and fix it at there expence. Needless to say someone arrived the next day and removed the switch and replaced it with a new one. I belive that they are aware that there have been problems before with these shutters. Thanks for the replies.

Can I just ask dennis how long after complition did they fix it. I have just had another E mail from Esther saying because we have had the apartment 8 months and it has been used they are not responsible.

Even if an item is not listed on the snagging list RODA are responsible to fix it within the first 12 months

This is the law in Spain and I have regularly heard the RODA staff explaining this to people

All electrical items in Spain actually have a 2 year warranty

That aside do not acceot the comment and advise RIDA of the 1 year rule on snagging and yell them that, if they faile to honout their legal obligation that you will complete an offical complaints form when you are next in Spain for the Town Hall to deal with

By explaining that you understand your rights will normally mean that they will change their attitude

You are often betger dealing directly with the staff in technical services including Andrea and Roman rather than the staff in the snagging department

They are absolutely responsible for the repair to this item

We also had problems with two of our shutter doors working on their own at times (I think the rocker switches are very sensitive and if you do not press the switch firmly enough, they seem to make contact on their own after a while). We found one in particular going up and down on it's own and may have been doing so for some time, which is very worrying if it happens when we are not there.

This was not on our initial snagging list, as the power was not on then and we only discovered them when we stayed at the property for the first time, recently. We put them on a subsequent list and they have been looked at very briefly by Roda, but the switch was only fiddled with by (what I assume was) the electrician. I am not convinced the same thing will not happen again.

HI All

 

Well I am glad in a perverse sort of way someone else has a problem and many thanks Roy for the advice.  We (that is me and my property manager) have been going mad with Roda in trying to get both my blinds and boiler fixed.  Roda would not do anything about the blind except if we agreed to pay their engineer 350 Euros to come and fix it.  Luckily,  my property manager is an electrical engineer by profession and has worked out that there is a sensor switch in the blinds (and one in the fuse box) which allows, in the case of an emergecy for Roda central control to open and shut the blinds - fire for instance.  He has worked out it is this sensor switch that is not working (the one in the wall switch for the blinds).  Technical Services denied all knowledge of this but it is currently in their hands to come back to us about the problem.  I am out again in mid May and if they have not fixed either situation then I am going to demand a complaints form as per Roy;s advice as I am quite fed up by the whole situation.

The boiler and blinds seem to be an ongoing problem, I am now waiting to here from the technical department as Roy suggested,  as it appears that the person I have been dealing with in the snagging department (with other issues also) is programmed to give one answer only which is "Roda is not responsible"

Out of interest has anyone looked into getting the blinds changed to a pull cord, like the ones in the bedroom and would anybody know the cost because they are obviously not up to the wear and tear we hopefully will be subjecting them to.

(and I think you stayed in my place once!)

I agree - but I also think that person in TD is under tremendous pressure so I am prepared to give them one last chance (that is until I go out in May).  And I think that a sit in the TD department will be on the cards! 

I will keep you posted and would be grateful if others with the same affliction would do the same!

I asked to fill in one of the complaint forms (Hoja de Reclamacion) when I was over a couple of weeks ago and was told I would need to have my solicitor present, as it has to be completed in Spanish. I was showed the form and there is only a very small area (about quarter of a page) where you have to set out your complaint(s).

Has anyone actually completed one of these ?

Hi RD

In answer to your question it was several months after completion that we had problems with our shutter and the repair people came out several times to sort, including the switch in the lounge which is, as others have said, extremely sensitive.   So keep persevering, especially as Roy says with Andrea.

Thanks Dennis,

Andrea has now agreed to do an "unofficial repair" although I am still in the 12 month snagging period I still cannot understand why this was not done without question. Roda say electrical items such as TV Toaster etc have a 2 year guarantee but not blinds????

If anybody knows the cost of changing to pull blinds we would be grateful or a contact of a someone who works on these.

I have actually completed more tha 15 of these forms and the comments made by RODA regarding the language and solicitor present are absolute rubbish

The form has to be freely given, has to be completed in their offices, and can be completed in English or Spanish, you do not need a lawyer and, if they refuse to supply one, on the spot, you can call the Police and they can be fined up to €6000

Comments form another site

Every public place in Spain - be it a shop, restaurant, bank, business, servive centre information centre or even bus - has a sign on the wall that says "This establishment has a complaints book for any customers that require them" (in both English and Spanish, although occasionally the English is dropped in favor of Catalan or Basque). It is a legal requirement for them to have this and it carries a lot of weight in Spain.

So, if you receive bad service in a shop or bar, ask the assistant or barman for the complaints book (point at the sign on the wall if you don't speak Spanish). It might be better to ask a different assistant to the one you have a problem with.

The forms are bilingual, so you shouldn't have a problem filling it out. Keep the two copies indicated (usually the green and white ones) and hand in the other (usually pink).

Each form is followed up and the establishment can suffer heavily if the law sides with you - if two people make a similar complaint they are even more likely to find in your favor.

You may be wondering how this will help you when you are only staying a few weeks in the country. Well, so seriously are these forms viewed, you often don't even need to fill one out - as soon as you ask for the book the service often changes instantaneously and you find you get what you want without having to go through with your complaint.

These complaint forms are a very powerful weapon for the consumer - don't be afraid to use them.

Every municipality in Spain has a public office dedicated to informing you, the consumer, regarding your rights and responsibilities in the case you should have any doubts. The offices are known as "OMIC", which stands for "Oficina Municipal de Información al Consumidor". Ask at the town hall to find out where yours is located.

Among the questions these offices deal with are those having to do with contracts, guarantees and transactions between shop owners and clients. It is best to bring all receipts and paperwork with you when you approach this office as the advisor assigned to you will usually be happy to go over everything with you. He or she will also need a paper trail in order to point you in the direction of justice should that be necessary.

The department that deals with these compliants is OMIC based at the Town Hall in San Javier and the investigate things for you and you can fill the form in there as well

They all speak English and are very helpfull and their details are

Roda have treated us so badly, I done a report to attach to the Hoja de Reclamacion, but was told that was no good either and that I had to fit it all in the little box on the form. Do you think that was a porky as well ?
