I am really not surprised! From my experience, where Andalucian Dream Homes told lies ie there is only one apartment left....and then further along the line finding out 3 different developers were onsite....this site cost me dearly. My previous solicitor was charging 40k Euros to get 79500 plus IVA back - he won the claim with the developers but they didn't pay up. The costs and interest awarded in court were around 26k Euro.....I was able to pay the solicitor 19,900 Euros and repeatedly explained my husband was terminally ill.
When I moved (illegally apparently) solicitors they took the Bank Guarantee and claimed against the bank..in between this i attempted to use a Cardiff Notary...but that was a waste of time.
The refund didn't include the IVA (apparently this was due to my conveyancing solicitors not doing their job (Antonio Flores was the director...and his attitude at that time was disgusting...apparently he thought there was a personality clash between myself and one of his staff - er no....she was not doing her job!! So as well as not getting the costs and interest I lost my IVA.
Also, when I did get my funds returned I was only awarded around 28k Euro costs and interest and my present solicitors took over 5k Euros just for sorting out the interest and costs. The foreign market has provideded many Spanish solicitors with a very lucrative existence......I cannot believe that my present one has a UK PR firm working for them!! Amazing. I just wish that they realised that clients are their bread and butter...and an email on the 10th Feb told me that they were contacting the court agent...it's now over 4 weeks from the original email and NO COMMUNICATION has come from them. They have been paid everything...although i no doubt expect to be charged a 'few thousand' euro to sort the refunded costs and interest.
They really have no empathy at all for their clients. When I begain using them I was so naive, but now know much more about the 'way things are done'. I am taking everything further because I really have had enough of waiting and the treatment (ie I am totally an idiot and do not 'understand' whats being done in the background !)
It is now making me so mad....especially i had to go through the current claim accounts that should have been checked before I received them - and found quite a few errors!!!!
I was not told that my bank claim was a shared claim (but I have still been charged 90% of a normal, individual claim - and 100% for the Bank Appeal.....which apparently was by letter!
I am a widow in my 60s and feel as though I have been taken advantage of.....criminality was evident in the case of Condesa and Casares......what else can I say.....however I do intend publishing my experiences soon.
At least I should be thankful I didn't go ahead...some poor sods either didn't claim their deposit back due to stress and lack of funds...(again solicitors don't seem to understand the stress of not having the funds to finance litigation).
