Is there any hope of the return of our deposits. Bet its all gone...
Or in a massive safe somewhere all rolled up Ready to be spent.. Ha ha.. Lol

Surly, there's nothing left or if there is... why should he/them return the money coz if he/them have all our dosh somewhere.. I'm sure it's not such a bad issue after 3yrs to start living a high standard of life with all of the money his has swindled... Doesn't sound to bad to me!

Pay up now n serve 12months or wait 3yrs and have the money... Mmmm!
It that what I'm reading correctly !!

Around 1800 people loose thousands of pounds of years n years of hard earned savings and he gets only gets 3yrs...(at the worst) That sounds totally totally unfair to me!!.. It's ridiculous !!

Does anyone know of any assets that are still about or have they suddly been renamed/diverted to someone else..

Hi Samuel ... half the problem ... in fact MORE THAN HALF ... is the pseed at which the Courts in Spain operate. I think we all know that this was / is a part of a huge fraud which was premeditated by both Martinez and Aguilera and they have relied upon the fact that the Courts are so dilatory that complainants might die before this reaches a head. Nevertheless ... all I can advise is that you remain personally focussed and at least be somewhat "pro-active" yourself and DO NOT JUST LEAVE IT TO A LAWYER TO RESOLVE FOR YOU. I have pursued a CIVIL case against Trampolin which I won in 2008 and then a CRIMINAL case against Aguilera which I won in February 2013 but which was appealed in July last year. The appeal is scheduled to be heard next October so that at least will conclude the action against the Developer.

The real poitive, however, is that the Supreme Court in Madrid have upheld a decision in a lower Court against Caja Madrid ... NOT IN CONNECTION WITH Trampolin ... but this establishs a legal precedent and a ruling for Ley 57/68. This ruling can be found at http://s01.s3c.es/imag/doc/2014-06-30/sentencia-avalista.pdf but in essence will mean that anyone who has paid money to a Developer for an "off-plan" property must have their funds guaranteed by the bank. This means that you have a claim against the Bank regardless of whether or not an individual Guarantee was given. There are now many Lawyers handling this sort of case ... Maria from Costa Luz or Guadalupe from GM Legal experts to name but two. Whilst personally I don't "get on" with Guadalupe she does, i believe know what she is doing as does Maria. Personally I am using a Lawyer based in Alicante who appears to be very efficient.

Is prison an option for Martinez and Aguilera ... well bearing in mind that the majority of these cases are individual sentences in Spain, I believe run consecutively and NOT concurrently. Aguilera has a one year sentence to serve for me AND HAS TO RETURN NEARLY €300,000.00 ... Ok he is attempting to Appeal this and whilst i would not want to prempt the Court (I purchased a property ... paid for it and he then both Mortgaged it and sold it to someone else) I think anyone would see this as fraud.

In conclusion I sugget you find a Lawyer who will go for the Bank and Ley57/68. ... GOOD LUCK, Andrew
