COURT SENTENCE FINALLY ANNOUNCED FOR AGUILERA ... PRISON AWAITS HIM!

Well they say “everything comes to he who waits” and for me the long five year wait appears to be finally over; the Criminal Court in Murcia have today, 10^th May issued their Judgment number 00150/2013 sentencing Rafael Aguilera to 3 years in Prison for fraud … reduced to one year if / when he repays the sum of +-180,000€ PLUS Interest and Costs. Justice is clearly extremely slow but it looks like eventually one gets there in Spain. All that remains is to see whether or not he actually repays the life savings stolen from me. Right now I have some very mixed feelings about the whole situation. OK, I have finally won but was there ever really any doubt? The man was paid for a property … Mortgaged it illegally and then finally illegally sold it to someone else!

It remains to be seen when / if / how he repays the money but to all of you in a similar situation it must give you hope. Aguilera has now been charged and sentenced for a CRIMINAL offence and for sure others will now follow. The man will have a long time to now reflect upon his crimes!

 I am surprised you have not took action against the bank as well Andrew.

I DO intend to look to the Banks but with the Criminal process having been completed it remains to be seen whether Rafael Aguilera prefers "porridge" to "payment"! IF HE PAYS ... and then as I said in the previous post I responded to ... he does not Appeal than a claim against the Banks would be negated.

I am not sure how my success in both the Civil and the Criminal Courts against Trampolin and the Developer in person affects matters but I am told it strengthens my case against the Banks. I am advised by those who have read and fully understand Spanish and its wording (Keith!!!!!!!!) that the Judge consider this a deliberate and pre-meditated act of Fraud!

Let us hope that at last justice can begin to be realised for the many victims of this outrageous saga.
