Has anybody received as part of there contract the developers builders licence. We were told by our agents MASA that he was waiting for the amended licence from the town hall and when he has it this would be passed on to us. As of yet i have not received it from them. Our payments are backed by bank guarantees which i may add was not from the builder it was at our agents cost. Before i part with the final payment i need to know that the builder has the correct paperwork in place. As  people are living on the development i am sure all should be ok but i would like to see it in writing before i hand over my final payment. Hope you can help me out on this and possibly send me your copy of  the licence. I will contact our agent after your replies. If knowbody has the licencences then you need to ask the question to your own agents as to why you have not got them. Many thanks in anticipation of your replies

We did not see a copy at any time although the question was asked to the legal firm repeatedly.

 We completed without even the ten year builders guarantee but obtained a copy of this later from Graham Pink at Parador after sales.  This is not for an individual property but seems to be for the site as a whole.

Considering the worldwide publicity about land grab one would have thought that the agents and builders would go overboard in an effort to calm and reassure the buyer.  They only have themselves to blame when it all goes flat.

Thanks for the reply JAYBE 23 but alarm bells are now ringing. At the end of your comment you say they have only themselves to blame if it all goes flat. The people who should be worried are the people who have handed over their money and completed. The agent has got his cash and so has the builder. Like you said with all the speculation about land grab ect they should be handing out this licence like sweets so why havent they ?. And the 10 year guarantee seems very gineric and not specific which could cause problems later if needed. Im not happy about that either. Like i say i am in no doubt all is ok with this development and the builder and i dont want to scare people but handing over many thousands of pounds of life savings should not be taken lightly. Our agent give us in paper form  their guarantee that the development was not in a land grab area to this i have no doubt. It is the official licence from the town hall to build the property of mine on that place where it is that i want. Planing permision for the build to put it bluntly. Why can we not obtain this?  Has anybody obtained this?  We need more imput from members this is IMPORTANT to us all so come on lets get this sorted. Then we are in no doubt.

  • exact location of the property
  • description and details of the property,
  • property price,
  • date to exchange purchase contract,
  • details of developers building licence,
  • details of the relevant permits, insurance and other documentation

    It is strange that not one of us so far has seen a copy of any of the relevant licenses.  I have copied the message above and sent it to the solicitor and the agent asking again for a copy but once the money is in their grasp interest in the client ceases.  As all of us may have bought with other agents and used different solicitors maybe one of you out there DOES have the copies.

    If so it would be good to hear from you.  PLEASE.

    It is important that you at least see the habiation licence before you complete on your property.  It is standard practice for your lawyer to pass this on to you before completion.

    Are your lawyers giving you any reasons as to why they don't have the necessary documents available to you?

    Many people do complete on their properties without the proper licences in place, which is actually quite crazy as it means that the town hall is under no obligation to provide services to the urbanisations. 

    You must insist in this documentation being provided to you.  Apply pressure to your lawyers, that's what you're paying them for.
