Peter,

Roy is not claiming to be a "Know it all", however he has been in business for 9 years in Spain and he is offering his advice. He works in this field and he appears to be knowledgable, he is an EOS VIP member and has made 1600 plus posts. I feel you should show the guy a little more respect. He has done nothing wrong.

You on the other hand are simply trying to cause trouble, your coupe de grace failed miserably and you have no intention of calling an EGM, so what exactly are you trying to achieve right now?

All you are doing is running down the resort on a public forum? it is a little troll like, dont you think?

Like you, I do not hide behind multiple id's (Peter Joseph Reid).  I am very glad that you find my postings interesting; I shall endevour to make them more so in the future - if only for your benefit.  As you say, you are not an owner - but a 'service' provider - therefore, you have nothing to lose when things, which they will, go 'tits up'.

Anyway, we shall have to agree to disagree (if for no better reason than I am about to catch flight).

Unfortunately when somebody results to throwing insults and the classic line don't bother to reply then I know that they have very little to offer. especially when you TOTALLY IGNORE reasonable requests for information and clarification and when they add and edit a previous post

Yes I have accused other people of being a troll and been correct, most recently I exposed an ownership scam on the forum, got the water services re-connected at Camposol when the builder illegally cut them off and have done a lot more, what's your claim to fame anonymous Peter

Clearly you don't have better things to do with the amount of time that you spend on here with these threads

Perhaps people should take a look at your past post where have all the regulars gone, they stop posting and reading because of the negativity

nolankn89 I think that the resort is great, good golf course and the potential when the airport opens in Corvera is excellent but it will be tough to rent because there are so many people trying to rent

It is 25% of the total properties in a particular phase, including these owned by the banks to call an EGM

Thank you for putting me straight.  I didn't realise that Roy was a lawyer (that's what you meant by 'working in the field' isn't it), I thought he just ran a key holding service- my mistake, consider me suitably chastised

Actually for the past 7 years I have actually operated a company called InspectaHomespain and  specialised snagging and advisory service also  The Snagging Forum www.thesnaggingforum.com, not as put a keyholding company so now you have been chastised

Perhaps you should know your facts first as these organisation have been very involved in the specialised legal requirements and issues on property purchases, have a look at the websites so my credentials in this area are well documented 

I agree a LITTLE knowledge is a dangerous thing and perhaps you can share yours by explaining about these developments where you managed to change the terms of the HPL

Let us all hope that the flight is leaving Spain

Wow Peter, now I am convinced you are simply a Troll. To imply that I am viewing the resort through Rose Tinted Specs, that’s one of the wildest statements I have ever read on this forum!

I am the founder member of the Half Empty Crew and I have always been the first to criticize the resort; everybody knows I am disappointed with my purchase and I will sell as soon as I can get a reasonable price for my place. However in the mean time I have a vested financial interest in the place and don’t like to see it run down by trolls like you!

I have sympathy for the many decent property owners on CDA, who are looking for rental income in these difficult times, or business owners on CDA who have risked their own money to open a business that could benefit the whole resort. Do you realise that your inane ramblings and vague accusations are directly affecting all of them.

Your sole mission on this forum, appears to be to stair trouble, you imply the administrators have done something wrong, but don’t produce any evidence to back up your baseless claims then you disrespect other members of this forum, who are trying to help and offer free expert advice.

If you don’t like ML, then try to get 25% of owners together and then call an EGM. However you don’t want to do that, you prefer to funnel your efforts towards negative endeavours like disrespecting your fellow owners and neighbours and running down CDA on public forums. 

I hope you are going somewher nice when you get on that plane, it sounds like a Holiday could do you good!

Darren.  You are quite free to infer what ever you like; you are only limited by your imagination.

Roy.  Come on, stop prevaricating, post the details of 'the court case' that you were involved with - if you can!!!

Section 16 is quite clear - no matter how you choose to read it. 

How you can claim to be helping people when all you advise is to 'roll over' and 'take it' from the all powerful administrator/banks/etc.  beggars belief.

 

If anyone is in any doubt about your rights under the HPA - and you still, unlike some of the posters on here, have an open mind - you could do worse than read the articles written by Raymundo Larraín Nesbitt (Abogado)

Great article thank you but it actually reinforces everything that I have said

You may be getting confused as the rules for the community are agreed and created when the FIRST deed is setup or  when the community is created normally by the developer

In the actual article that you refer to contains the following information which supports the information that it is actually a percentage of the TOTAL properties that votes, not just the ones that have been completed on

In addition to the above general laws, the day-to-day running of each community is really determined by the Communities’ Bylaws (Statutes) which are drafted at the time of lodging the Master Deed (aka Escritura de División Horizontal or Horizontal Deed). Unanimity is required to amend either the Master Deed or the Community Statutes (arts 5 and 17). So in practice it’s quite a feat to change either of them.

So, each owner does not equate to one vote. There may be a single owner, such as a developer, holding a significant communal quota which translates into great voting power.

You may find that in new unsold off plan developments, a developer may hold the majority vote as he still holds a large stock of unsold units. Conversely, it can be its lender, if they have taken over the developer’s units. Either way, they are both obliged to contribute to the communities’ upkeep, paying their communal fees in proportion to their communal quotas, like everyone else.

So he is saying that the developer or bank in the case where ownership has passed maintains voting rights providing that they are up to date with their fees

I rest my case but again show me your first, you claim that on 2 communities this has been overturned, when and where

I dont feel that me suggesting that you need a holiday would put people off renting on CDA or affect any of the new business'!

You also infer that I dont have an open mind, but if you look at my last 30-40 posts, I have been trying my best to undertand the basis of your problem with ML, I am my own person and form my own opinions, I listened to people who shared your views, like Chaddyowl, SMIVS, Fighter2 etc. and I am still undecided as to weather ML are good or bad. I have seen no proof that they are bad, but do witness plenty of evidence to the contrary.

I think that Chaddy, SMIVS, FIghter2 etc all made some excellent posts and offered a quite convincing arguements they were also able to do so by not insulting and disrespecting people with oposing opinions. I feel that you have done more harm to your campain than anybody. You have polorised people against your adjenda, by downtalking the resort and insulting people who offered you help.

I would imagine there are not too many people still reading this thread, which I am glad about. I respect your opinion and do think you sincerely believe in your cause, however the way you conduct yourself on this forum leaves a lot to be desired.

I hope any prospective purchasers, renters or business starters if reading this can see that most people dont share Peters views or conduct themselves in such a childish mannor.
