i was under the impression that it was one of the license holders of the clover who asked for the 2nd gate to be unlocked to comply with safety requirements not Phil????

I can understand your comments.

But ML are outside contractors.  They sent an open letter to all owners criticising the president that we elected through our garden and level 2 presidents. 

Phils mgmt style may have led to the situation, I don't know.  But I do know that the level 2 presidents replaced PT immediately after ML sent out this letter.  This letter also happened to be sent out just after PT went on holiday.  It seems a huge coincendence or a cynical owner may even think there was a possibility at least some of the presidents and ML were acting in unison.

ML should have discussed the issue with Phil.  Then asked to address the level 2 presidents meeting if that didn't work providing them with all this info and doing it in front of PT.  Then the level 2 presidents could have their vote after each party has put their side of the story to the meeting.  They way they did it was thoroughly unprofessional and to try and justify it by the actions of MrsTann merely proved to me their inadequacies.  The level 2 presidents should have been the ones to approach PT and say we can't have your wife criticising the administrators (unless it was from a viewpoint totally separated to Phils role).

I don't think any of the Level 2 presidents or ML have come out of this well...but bear in mind only one party is getting paid to do a job as a professional administrator.

I've said before I think all were doing a good job for CdA and I do hope Victoria does things well.  But the presidents will not have my vote of confidence if the actions of ML go unremarked on in an offical manner by our representatives.

You are correct the licence holder asked PT to have the gate opened as that’s what is in his contract and PT agreed as it was a safety issue also. And then the lady who is now the new level 1 president complained he had put the community at risk by having this gate opened, and that’s what the administrator accused him of. The information below is the latest development on that issue.

I would prefer that an independent audit was done on the annual accounts. If nothing to hide I don't see why this cannot happen quickly. I would like to see a clear account as to what all funds have been spent on so that any irregularities can be challenged. I would also be keen to see the criteria involved in employing an administrator. Perhaps we should also be looking for specific recommendations on the back of such audit. This should help to clear up a lot of the doubters including myself. Reading this forum a number of people would support this approach. I appreciate there will be those that don't as well so suggest this item is put forward for vote. I will be contacting my president to put this proposal forward.

 Hello ;

I was asked by another of the contributors to your community to comment if possible on the matters arising from the strong debate with regard to your administrator & dismisal of your president.

Intially I felt I needed to see more information but due to the substantial number of posts since containing a great deal information I am happy to do so now.

It seems that a Extraordinary meeting of the community has been called to dismiss the president & replace him with another. 

In normal circumstances 25 % of the community  is required to call the same . I find it strange a large number of contributors on the site where not served with the papers to attend the meeting & also this would reveal who was calling for the meeting along with the content of the agenda.These minutes are open to challenge within 30 days of receipt so it is important that a written recorded request is served on the secretary ( probably also the administrator).Ultimately these minutes will need to be adopted by the community in the next formal voting meeting.

There is further importance to the minutes of the meeting being available to all the members within 10 days of the celebration of the meeting. A news letter is not the minutes.

At the centre of matters appears a access gate which has been put into service when formally not used.This should be checked into at the local town hall as to the part it plays in the original consent of the planning permission of the community.The original architect may also be a further source of useful information. Failing all a independent architect should be tasked with finding out . The visits by police & firebrigade make desicions generally on their own public saftey concerns.

I note also questions as to the role of the administrator ; the administrator is appointed by the members to serve the community.The president is the legal representative in all legal matters in court.

Duties of all posts may be further expanded in the community statutes which may also be more explicit in the timing of appointments & durations.They do not over rule the laws of Spain.

I also note the calls for a audit & I am surprised that a indepentent auditor has not been in place in such a large community.We are part of a firm of UK chartered accountants so we have never had to do this in our larger administered communities due to the qualifcations & licencing of the partner auditing to ICAEW regulatory authority that supervises the same under our European practice licence.

In communities it is essential there is transparency with the running of finances on a montly cash book basis & also quarterly management accounts as they have to be run like a business.Everyone should know monthly what amount money is in the bank, who paid what into the account & who was paid what. A list of creditors & debtors is also mandatory.If you run a business or did in the past this will be second nature to you. In the case of a community it is a situation where the funds need to be treated like a public body as after all the members  are one & the same.

In these times of websites able to act as not only a communication medium but a permenant archive of past & present information of meetings ,accounts & news there is no excuses.

I am happy to look at the situation in detail with full information if it can be provided.

I Barbara Rollett as a level 2 president Naranjos would like to set the record straight on this forum that not all level 2 presidents voted against Phil Tann!  I did not receive a call to the meeting from mileniun until less than 24 hours from the meeting taking place, as I am in uk at present this did not give me sufficient time to travel to spain  for the meeting, I gave my proxy vote to another president to attend on my behalf and my support was fully in favour of phil tann as this is all a vendetta to remove phil from the position for their own agenda.  This was conducted in my opinion as an illegal meeting and therefore should not have taken place.  They were aware that he was out of the country for 3 weeks and waited until the day I left the resort and was safely on a plane to the uk before sending out the letter to all owner with their appaling attack on his character, without the opportunity to defend himself.  putting personality/ friendships aside this man does not deserve this treatment and I suspect that I will be the next victim for standing up for what I believe.  I fully intend to FIGHT for what is right on this resort and I WILL see justice done for every owner on this resort.

 Hello Babara;

Unfortunately the law provides for a EGM to be called on sufficent notice .This is a highly debatable time frame without specific. A burofax served on a sunday can be sufficent for a meeting the next day. However most statutes provide a number of days normally  5 days .This would be worth you checking into as the setting aside of the minutes would be simple on a timing failure. The bigger question is who called the meeting as only 25 % or the president can do so.

Hi,
Would you consider the size and complexity of CDA to be very ambitious for most administrators? I do not know a great deal about Milleniun but are they considered to be 1 of the bigger players in this space? You have probably picked up from my posts that I am not their biggest fan but I don't really have anything to bench mark them against in Spain that I know. La Manga stands out for me but not doubt this has its challenges as well.

It is not really the size overall of communities that create the challenge but the quality of the systems employed in managing them. In large communities like yours' the quality of on site management has to be high so having a good head office with proven systems for managing the community in terms of financial accounting is not enough if their is not regular attendence by a partner level administrator to monitor his staff performances & also see first hand the results as well as holding a monthly board meeting. I also find it useful to spend time with the members on site as alot of  views & information can be gained this way. There is also a need to focus on the front line management duties & work in the framework of other authorities such as the Town hall or Entidad if it is in a townhall private partnership as these can have a positive or negative effect on the community depending on how they are run.

Without wanting to sound Britanic the north European management ethos is driven by client satisfaction & it is not really the way in Spain as yet. In recent elections we where unanimously re-elected even by Spanish voting sections so we feel we have the right team & systems. I think also you have to consider that community law & the community idea originated in the US with the condiminiums market .I think we all know  about the demands & business expectations of the Americans in private communities.

I also find having a UK central office helps with many owners spending their time between both countries able to interact in the UK about their community matters in Spain.

Incidently  the case I quoted not far from you was previously a ML administration . We later annulled the Entidad in a joint petition with the townhall due to corruption ( for the avoidence of doubt there was no connection to ML in this matter ).

WELL WELL WELL!!!

I don't really understand the level of anger aimed at ML to be honest. As I see it, the working relationship between ML and the former L1 president had deteriorated so much that it had become completely unsustainable, and I suspect there was blame on both sides for that situation. They issued the letter last week to bring the issue to a head, in what was basically a 'back us or sack us' statement.

It was the L2 presidents who made the final decision to back them, ALL OF THEM????? 

ML had no part in the vote. If the L2 presidents thought that more of the blame lay with ML they would surely have backed the L1 president instead. Why wouldn't they?  This your opinion based on fact and evidence them is it??

Of course only time will tell if they've made the right decision.  IS THIS BASED ON EVIDENCE??

You can of course argue that they were wrong in issuing the letter to bring all this into the open, YES!! 

but remember the catalyst for the whole situation as I see it was the former L1 president's wife publicy criticising ML in an open forum. BASED ON HER FACTS AND EVIDENCE ON DEALING WITH THEM!!!

So there was clealy wrong on both sides, EVIDENCE???

 but now it's time to move on IMO. In My Opinion?? NO EVIDENCE???

Despite this latest unsavoury incident I've generally been satisified with ML's performance until now. I see no reason therefore in replacing them now with another unknown administrator with unknown consequences. We need stability, not more even uncertainly.

At least give ML and the new L1 president a chance to show what they can do before jumping to premature and hasty reactions. Just my tuppenceworth. :) !

Totally agree elarado. The anti-Spanish sentiments voiced by some is a bit disappointing to say the least. They should remember we're guests in their country and show them some respect.Only point I'd pick you up on is that it's more an English thing than a British thing, from what I've read anyway.

Respect is always earned!

I respect the Spanish as a nation, hence buying there, but I dont respect individuals who dont respect people they work for and deal with whatever their nationality!
No further questions your honour!

This Cappieflow has no credibility in his/her posts and should be ignored as a hypocrite and given no respect!

I have expressed my thoughts and views very early on in this thread, when it first kicked off between ML and PT, anyway I now find this thread quite boring, its seems to have lost its way and many people are just using it to attack others members.

Chaddyowl, I dont like your tone or aggression to other members, whereby other members like Mark Bentley seem to talk fact, you just seem to spit venom.

I will not participate in this thread anymore.
