It appears that LOS are gong to make a lot of money from this litigation, which is fine if they get our money back. My worry is if the developers can't pay now, then what chance have we got to get 50% compensation from them. I cannot afford the procedure and have e-mailed LOS to ask them what will happen to those who cannot or will not this fee. They are still legally resposible for getting our money back, but are not going to make much by doing it through the normal way. I have e-mailed the contacts given by ed007 and will keep everyone posted.

Yes have done the same ie cannot afford tpo pay LOS any more and contacted the links Had a call from someone at Morgan Stanley today but the person I spoke to said he didnt think they have any links with this project??

Have had a call from Morgan Stanley, and they say that phase 1 was not funded by them but they will give any help they can. They also own 16.79% shares in Grupolar, which I have pointed out in another e-mail, and that should put pressure on them to refund the deposits as it makes them look crooks as well. Grupolar have an office in London at 57-61 Mortimer Street,W1W 8HS. The UK manager is or was Katy Katani. I am writing to her next to see if the threat of legal action over here will hurry them up.

Hello,

A case that we filed at the end of last year though the Courts in Estepona, a preliminary hearing was held in which the Judge suggested that an agreement was reached between the parties so that the deposit was reimbursed plus a compensation just short of the 50% requested. 

It is clear that the judge wishes to avoid another hearing, held for the 2nd of April 11 am, and so is urging the parties to reach an argreement. Our client will settle for his deposit and 30% compensation and the developer´s lawyer, JM Macias, thinks this should be reasonable.

I understand that you worry about the present situation but we have bank guarantees for all clients and therefore the deposit in its entirety plus legal interest is guaranteed.

Hi I am a client of LOS my lawyer is Javier who is currently asking me and others to fund litigation why is this so if litigation has alraedy begun and the expectation is it will not go to court? The judge has already said the parties should pay up and the developers lawyer agrees so why further litigation? I cannot afford to pay for litigation especially if the bank gurantees are secure why should litigation be necessary?

Hello,

This developer knows they have to pay but at the same time they may not have the money just now or they may wish to use it in a different way. Whichever way it is now clear that they only will pay if they are forced to and my previous comment is a clear example.

If they are now accept our proposal of 30% compensation in addition to the deposit plus interest, it will have been well worth pursuing.

I cannot see any other legal way to persuade them to refund.

Last Thursday I personally collected 36 bankers drafts from ACC-Zurich for Lawyers of Spain clients who had purchased at Lar Sol. The checks , totalling a figure of over 2.5 million Euros, were reluctantly handed over after more than 12 months of negotiations, telephone calls, legal notices, law suits and our clients´ patience. I would like to thank the LawyersofSpain team as well as the Lawbird barristers legal action on behalf of few, without whose help ACC Zurich would have kept stringing everyone along.

Also thank you to 2 clients in particular who escalated within ACC-Zurich ranks and rattled a few cages there.
