Finally got confirmation that the solicitors completed today.  YIPEE!!!!!  We will be over for Easter and will be taking photos for anyone who needs them. Any specific requests just ask. If anyone in phase one wants to go for a drink over Easter we have plenty of celebrating to do (ground floor, block 5). Mobile number 07766736675.

Hi Impey - hope your signing went well, and the move went smoothly, just returned from Spain and the lawyer has clarified the licences - see below - not sure it will help though!!  There seemed to be a few more that had moved in.

I can inform you that it is possible the existence of tourist apartments and non-tourist apartments at the same building but the application of inclusion of an apartment as tourist has to be after the hand over of a usual property. It is not normal that the developer decides it as the obligation to declare the apartments as tourist come from the classification of the land which has to be tourist, not being possible to change its designation.
All these apartments should be rented although the conditions of the lease can not be imposed by nobody, it will be the owner who will determine them.

Scufty/Ianth,

We have just returned from Spain this afternoon and posted the photos you asked for.

These were taken from the roof of block 19 in the early morning.

Everything is fine with our apartment and have no snagging to be done.

We go out again on Easter Friday so if you would like anything checking out, just let us know.

Nice photos J & L, thanks. Glad to hear you have no snags.

I have paperwork from Gomendio offering signing dates of 26th or 28th Jun.

Has anyone else out there bought what is termed a "tourist" apartment? If so, can you explain in layman's terms, what this means please?

Parador obviously just happened to forget to mention this part!

Hi, from the info I managed to get for Impey  - if a touristic licence has been issued, the property must be rented out for a period of time during the year, also tax liability is higher.  Habitation licence - your are able to live in the property all year.  A friend of mine has purchased a property at Quadamar - moved in 2 years ago, and has now been informed that they only have a touristic licence.

I understand the builder sold certain apartments fully furnished, these are probably the ones issued with a touristic licence. 

However, I would check with your solicitor.

I too have a tourist apartment and been given the same dates for signing. Does anyone know if these dates are likely to change before I book my flights!

We were told if we bought a tourist apartment it would need to be availble for rent ( according to the aperwork at least 1 week a year) and in return the apartment would come fully furnished. the idea of a tourist apartment is to help the government to increase tourism in the area.

We have also been expected to provide 1000 euros cash for the water /electricity prior to signing (not sure how I will do this ). Also we will need to sort out our NIE a couple of days before.

The forms to sign and complete for the tourist apartment are in Spanish (looks like its a list of furniture to be included etc) and has not been translated.

Does anyone already own and moved into a tourist apartment?

Hi Dream, have you not applied for your NIE number yet, it usually takes a couple of weeks, my sister applied for hers in Nov last year and went back again in Dec, (or your solicitor can return to collect)signed for her property in Jan.  But you will need your NIE to complete on your property.  Check with your agents (if you are  buying via them).

Hi Dream,

At least you knew about the tourist apartment clause. We thought we were just buying a standard flat that happened to be furnished!

I have returned the direct debit forms for the leccy and water, and the community charges. I have not returned the tourist apartment forms, and am contacting my lawyer to see if I can opt out. Checking all my paperwork first though.

 I presume that if you knew about the clause, and still went for it, it can't be a bad deal anyway? I have read through the translated contract and it sounds ok, but I would still rather do without it!

I am not booking any flights until I have been convinced by my lawyer that the signing has been completed and that he has the keys.

You should definitely be trying to get your NIE number sorted out soon. As Lesley points out, it can take a while.

Hi everyone

The tourist apartments are causing a lot of confusion,we took over ours in Nov and this is how it was explained by our lawyer and parador,You must make it available for renting at least 1 week of the year by advertising for rent, if you don't want people renting it just put the price up to an extortionate amount ,at least it's available to rent.

When gomendios send you the dates you will also receive a big contract from Integra interiors,this contract is not compulsary unless you want this company to rent your apartment for you,i spent hours reading through it and concluded that Integra would take about 40% of rental income and also that any bookings they received would over ride yours unless you booked your own apartment through Integra.

Gomendios will also register your apartment with the tourist board and then the tourist board should contact you with details of what is expected...we are still waiting .

I had come to the same conclusion about the integra contract as yourself. Your post puts my mind at rest a bit, builders and lawyers are all on holiday just now.

Did you ask about the implications of the tourist licence when you come to sell?

We have not looked into this as we have no intention of selling but i would presume it would have to be sold on as the tourist apartment, unless anyone knows if you can unregister it with the tourist board.

As mentioned in earlier post, if you do not want to rent it out, put the price up, why not advertise on this web site? rather than with any agents.  The rental market is very slow at the moment in our area, so I have been told by our neighbours (I do not rent my apartment, only use for personal use), so it will probably be unlikely that there would be many enquiries.  Good luck to you all on your completions/moving in over Easter.  Not in Spain this Easter, off to Barbados for the cricket for the next 3 weeks.

Thanks for the photos really appreciated, I'm now going to try and upload photos which show phase 2 pool looking less like a public toilet (not a dig at J&L, the pool looked that bad when we got there 2 weeks ago but got better as hopefully the photos will show), and the waterfall was working and the grass is coming through, then again might have snow by the time we get our keys !!
