I had a telephone call from our Management Agency today saying that when they had been to our apartment to take photos for renting it out the front door of one of the apartments on the same floor was open and it looked as though it had been trashed as he said there were clothes all over the floor.

The apartment is on the first floor at the bottom of Block 8.

We believe that the couple live there permanently and work in Gibraltar.   The washing is usually hanging over the terrace.

Does anyone know if they are away on holiday or someone just broke into the apartment when they were both out working.
They have a pickup truck.

The Management Agency  phoned us to see if we had a contact number so they could phone them.

Can anybody throw any light on what has been happening there.

If you are talking about the apartment towards the right hand end of block 8 as you're facing the building,  I 'm fairly sure that they were about last week as the towels were over the balcony.  We're up the other end so had no direct contact.

If anyone reading this owns an apartment in Phase ll Block A Apartment B3 we have had a photo from our management  agents showing us the state of the terrace.  Rubbish and washing everywhere. I don't know what the inside is like.  But when the Agents came over last week  the front door was wide open and nobody was around.

A lady at the apartment told our management agents that she was renting long term and was leaving.  No idea if that was  true or not.  We were told by her that she had bought the property and would be there for 5 years.

Whoever owns this apartment should get in touch with their management agents.

With so many empty apartments anybody can take up residence.  Once they are in how dificult under Spanish Law would it be to get them out.

A community of owners should be formed as quickly as possible for Phase ll and the list of rules drawn up and circulated to all apartments.

Does anybody know when the date is for the AGM?

If you are talking Manilva Beach then an association is being formed and meeting being held on August 23rd. I have e-mail address of the two women who are dealing with the matter.  I believe they may live there but I am not sure it may be that they are just concerned people who see that unless we get condominium services there we will have problems.  Also these two women seem very informed about the complexes there so maybe able to help you.

I am sorry you are having these problems - I can't imagine what we are all going to find when we finally get there.

Thanks for your message.

Each phase in Manilva Beach has their own Community of Owners.

I think Phase ll (Block 7 and 8) Manilva Beach where my apartment is is being held in September.

Looking at the message from Nigel in Block 1 I think he wrote that  86 apartments remain unsold.

In Phase ll and lll it looks as though many are unsold.

If I remember there were a total of 277 apartments built.

I assume the Developer is liable for all the community charges for these unsold properties.

Hi Susan8.

Yes, the developer will probably be liable for the charge on the majority of these. 
It may be worth you contacting Condominium Services and discussing the developers position with them. (Call Lawrence Jordan directly. Don't bother emailing they never reply).

Nigie is correct in everything he has posted as normal
The overall situation you may wish to take into account is that there is no such thing as a free lunch and cases going against those that are avoiding completion has resulted in.
1  Legal fees awarded in favour of the developer
2 Claims from developer that they are awarded back dated interest to where the courts say you should have completed
3 Back dated management fees are also being claimed as in many cases the developer is not at fault as in this case in could be that they havent been paid.
3 Now many developers cant afford to pay  or are not paying the management companies for fees going back years and they surely must want paying and would not be suprised if they did not embargo property in form of payment.


There are so many factors to consider in every aspect of the situation in Spain and just when you think you may be getting a result the rules change of course in favour of the Spanish system that allowed all this mess in the first place.
