All I can say is I have seen a copy of the letter to the bank that issued my BG .At the time I  tried to find people with BGs with the same bank, could not find anyone.Did not realise at the time it was sent to all banks who had issued BGs on behalf of SJ  . I now understand it was .JA

I think Brian you will find that this was posted on this very site the day very soon after the event and the poster got a bit of abuse as per the norm from the guys with their heads in the sand.

Our lawyer has said categorically that there is a national or government scheme in force to cover just that senario. If a bank that has given you a bank guarantee goes belly up your money is covered and she was emphatic about that.

It'S nice to know something in spain is in place that might even work.   My original question was just a thought I had after what has been going on in the good old USA.   Like big builders big banks can also go bust.

Hi all, I received an email from my Lawyer yesterday  simply stating that we are now in the Next Stage of Prosecution and basically  'we are now ready to demand HdT and SJ to Court'/  Ive emailed with a host of questions such as 'blood from stones, what is this next stage, how does it work, is this beyond being a normal listed creditor' etc etc before I send the next epic stage payment.  Anyone else at this 'next phase'?  Ive not been able to reach him yesterday due to my work committment. 

Any ideas or thoughts?

Funnily enough we had an email thursday saying  that very soon we would be contacted and the lawyers have 10 days to reply to the court, the email was just to let us know we would be contacted and to reply by return no real news.

We have had to send 500 euros to pay for a "Procurador" for whatever thay have to do in the proceedings.
It's all money....money....money from here on in, but, if we don't try, we may as well "write it off" now.
Fingers crossed for a good outcome !

I had the same request to pay 500 euros for the procrador, i had already overpaid the lawyer, in accordance with his fee table, so i asked him to pay from that.

Otherwise i have heard nothing, other than it will be end of september early october for a report from the administration.

The whole thing is painfully slow, i just hope they go into full administration and declare a dividend, i cant for the life of me see any way the builder can carry on building in this climate.

I mean, there is even a chance the bank they bank with can go bust if it goes on much longer.

Hi each, I feel the same about the time drag, we are all just ready to get on with our lives now come what may.  Im still at the stage of fighting hard into the next stage but what impact we can have I really dont know.  Bring on the Report and shut them down, at least then we actually know where we stand.

I cant for the life of me think why any investor (as claimed by what appears to be a defunct SARC) would put funds into SJ and HdT to continue building.  Who would risk it given the reporting of Fraud and syphoning of 14 million let alone the climate.  Im way behind with funding my Lawyer and now need to send  almost 3000 euros. Makes me feel ill.  Its already cost almost a 1000 euros in negotiation for transfer costs.   Words cant be printed on a public forum of how I feel about these con men.  Watching the news last week with desperately unhappy people stranded at Airports when XL went down.. I actually wished I could swap places with them in their trauma.  A holiday cost lost or your life's work!  Life sweet tapestry eh..

Still its sunday and the sun is gonna shine, garden needs putting to bed and Ive got lots of vino to buy !!!

Hi all.  We have a bank guarantee with BBVA and since May this year have been trying to claim our deposit back.  They just keep coming up with excuse after excuse not to pay out.  We have a Spanish Lawyer dealing with the case now and he is taking them to Court.  
In his latest email to us he explained that all the banks are just playing for time.  None are paying out on Bank Guarantees and they are forcing everyone to take them to court.  The reason being that they think a good percentage of people will not go as far as this and will just walk away.  
The main excuse we have from BBVA for not paying out is that they say they do not have an original copy of the Bank Guarantee - they only have a photocopy.  This is total rubbish as my lawyer has written to the Bank of Spain to ask for an original copy and Bank of Spain has informed him that BBVA have their own Registry for their bank guarantees so therefore they must have an original copy.  All I can suggest is that, if you have the funds, press on with taking the bank to court and you should win your case and the bank will almost certainly be made to pay your legal fees as well.  You could also write to your local MEP and ask them to contact the Spanish Housing Minister.  I am sure that if the Spanish Housing Minister gets enough letters she will have to do something.

Jane - Spanish Housing Minister probably gets a backhander like the rest of them, so not much chance of action their. the way forward is a concerted nationwide effort with ever aggrieved purchases in spain 9not just san jose), appoint rottweiller human rights type lawyer and sue spanish govt in the eec

I agree with you My Lawyer has said the same thing about the banks not paying and therefore I will not give up.As for contacting MEPs I already have and think it is certainly worth a go If we all do this The Spanish housing Minister will have to take notice don't forget the Spanish Banks concerned are acting illegally . there is nothing to lose from letting the powers that be know about this but everyone must write to  or e mail their MEP not just a few. JA

 I hope you are wrong if corruption is as rife as you say even within the judiciary of Spain then we all have no chance of getting anything back at all . I as I always have think SJ is just stringing us along and the banks hope that due to the high costs of going to court most people will walk away .I for one will not . I still have a few other plans up my sleeve but right now I believe eventually the banks will have to pay out on BGs.It is as the lawyers say just a matter of time. 
If by any chance as unlikely as it is SJ get refinance all who don't have BGs should be demanding them in fact you should be demanding them now and pestering the hell out of them. SJ can not have it all ways ie we are a respectable company ,we are trying to sort this out ,we did not intend for this to happen to our customers blah blah blah and on the same hand take deposits with no BGs and instruct banks not to pay out for those who have them .I can only ask the question does SARC or anyone else on this planet ,including financiers want to deal with this company ever again I know I don't. JA

Good day and greetings to you all,
I have finally managed to get the drivers for my new PC loaded and I can access the site again.  

JA if you read the SARC reports you would of seen that we have allready asked for BGs for purchasers who continue with their purchase when offered to do so. We have also asked for compensation for purchasers and you could see from the report sent out by the agent a couple of weeks back that SJ have taken these on board.

Despite all of the nastyness we are endeavouring to get the best for our members and that also has benifits for the other purchasers.

The promise of bank guarantees is like saying jam tomorrow

Its too late to take things on board as you describe it,  the builder broke the law by not issuing them in the first place.  If they could afford them the administrators will say so........................i dont believe a word from san jose, they have some ground to cover with their customers.

They are pulling your plonker Tony, and you seem to be enjoying it........................

I want my BG, I want my money back, i want barnsley to win the premier league, i want lassie to come home.

I am convinced san jose can make all these things happen.........can't they?
