Has anyone heard that the Spanish banks have been freezing the bank accounts of foreign nationals? 

My brother was in Spain a week ago and was told that all accounts had to be verified by the local police station in Estepona or the account would be frozen. My husband is over there at the moment and spent a fruitless morning in the police station with over 200 other English people who had been waiting since 5am to get their forms stamped before the deadline of 15th September.

We bank with Cajamar and he also went into the branch at Sabinillas and was told the same information by our bank manager there; Alberto. My husband was also told by other people in the queue that their accounts had already been frozen and all money currently in them lost!

Does anyone else have any information on this? Apparently it is a crack down by the Spanish Government to stop illegal immigrants in Spain!

Very worrying if you can't meet the deadline!!!!

I have just called my bank - Solbank in Sabinillas and spoke to Jurgen Freymann who assures me this is completely untrue. I will however be sending him this link.

Well there has to be something in it as a lot of people at Manilva Beach the last two weeks of August were concerned about it and were queueing up at the police station to get their forms verified. Some had already had their accounts frozen. Our bank manager was certainly aware of it and has advised us to take the necessary steps to avoid our account closure. My husband was unable to get a ticket at the police station on Monday as 200 people had beaten him to it - they can't all be wrong or can they, There is definitely something going on....

Britons hit by tax blitz on Spanish homes

 

Owners of Spanish property could lose their homes if they fail to produce new identification documents proving their non-resident status, writes Ali Hussain.

Britons who use their overseas accounts to pay for their Spanish mortgages and essentials such as utility services and council taxes, have been required by Spanish banks to produce a residence certificate or “Residencia” since March last year.

Failure to produce the new documents could result in bank accounts being frozen and mortgage repayments stopped.

However, some Spanish banks have failed to contact homeowners or given short notice to produce the papers.

“This is not easy to do as you have to register in person at a Spanish police station and then have it stamped by a town hall official. We were warned our account could be frozen.”

The requirement is part of an EU initiative to crack down on tax dodgers. Spanish residents are taxed at source, so to avoid paying tax there you have to prove non-residence status.

Britons — there are about 145,000 with bank accounts and properties in Spain, said broker Savills Private Finance — have to declare gains made in Spanish bank accounts to the UK taxman.

You qualify for non-resident status in Spain if you spend fewer than 180 days a year in the country and are able to produce the new document.

Anyone who bought a property before the new rules came into effect may be asked by their Spanish bank to produce the Residencia. Those who bought property after they were introduced will have been told of the requirement.

Residence certificates include your name, address, nationality, date of registration and the “Numero de Identificacion de Extranjeros”, a tax number for foreigners in Spain.

The Spanish Tourism Office said: “If you have a Spanish property, and have not been asked to produce this document, I suggest you contact your bank directly.”

Homeowners can contact the Spanish Ministry of the Interior’s immigration directorate helpline for more advice on 00 34 91 363 9071.

To apply for the non-residency certificate you usually need to go in person to the Oficina de Extranjeros or police station in your province of residence.

The document costs about €10-€13, although if you go through a lawyer you may have to pay more than ¤120 (£97.20).

I have just spoken to my Spanish Lawyer who confirmed that this certificate is required by my bank  as I am a non-resident (I would not have known if I had not seen this thread) so thank you for posting it.  The Lawyer says the bank account may be frozen after 15 September until they get this certificate - She says it will take about 10 days to obtain and 120 Euros.

My experience of this is that some banks will do this automatically. I know my old bank did as they charged us about 35-40euros each for the declaration of non residence. I didn't actually have to do anything myself. I have spoken to my new bank about it and they have said that I don't need to worry about it for a year or two.
I would suggest that everyone contacts their bank and see what the procedure is that they use. I think depending on other fomrs of identity registration e.g. NIE etc they can get all of the information they require but I am not 100% sure.
It might be worth everyone posting here what they needed to do to get this as I bet it won't be consistent across all banks. In my opinion Spanish Banks have a license to charge for just about everything, no wonder they are taking over banks in the UK, they have your money, don't pay interest on current account, charge maintenance fees, charge for receiving money charge for sending money I keep expecting to see cashiers in banks wearing masks and holding muskets!! Sorry I am off on a tangent...
It just seems a bit odd to have to be in Spain [e.g. go to a police station] to get a stamp to declare that you don't live in Spain!

I also have an account with Halifax Espana and they have told me that I don't need to do anything for this account as they complete all the necessary residency requirements at the time of opening the account.

My conclusion would be that it seems to depend who you bank with. If you bank with Cajamar then you definitely do need to contact your branch immediately.

I am with Sabadell Atlantico. I called them yesterday and they say they have already set it up. They actually said it is a process that some banks do, and others don't. I think they charged around E25. They renew it every 2 years I believe.
