I can only see the possiblity of a tax liability if  you're changing your address because you've sold your home and moved, and you haven't lived in the old home for long enough to claim roll over relief on the purchase of your new home i.e. 3 years. Eithey way, if you sell your main home and

1. you've owned it for more than 3 years 

2. you've been resident in Spain for at least 3 years (read as 3 resident's tax returns filed) and

3. you're over 65

....then there's no CGT on the gain made when you sell your home, even if you don't buy another property.

If you're changing your address for any other reason e.g. you are moving between rented properties, then there won't be a tax liability.

The tax is payable by anybody who owns more than one property, so a Spaniard  who owns 2 properties is liable for the tax in the same way that a foreign owner of a holiday home is.

I hear what you're saying, but the Spanish aren't disriminating against foreigners.

Hi Nick

There were two parts to the old non resident's tax return. One part related to wealth tax and one part to an income, which is deemed to arise from all 2nd homes situated in Spain. This income is assessed for income tax (the non resident's income tax rate is 24%). Note that the income is a notional income, so it will arise whether or not you let your property.

The wealth tax element is, for the time being at least, no longer an issue. This is on the basis that all taxpayers currently benefit from a 100% wealth tax credit.

The income tax element of the return is still required. Hence you will still need to file a return so don't sack your fiscal just yet.

Now brace yourselves for the posts offering to prepare a cheap non res return......my advice is to save yourself the headache and stick with your fiscal.

Hi

If you visit forums where there's no facility to include a link to the poster's site the content is usually very limited. There's much to be gained from professionals who are prepared to give up their time to answer specific questions posted in threads, even if the poster does gain some exposure for their business.

The web has changed a great deal in the last 10 years. Nowadays an individual's web search is much more likely to concentrate on groups....in fact I'm usually more successful in finding the information I seek if I limit my searches to groups rather than using a general Google search (which will throw up sponsored links - pay per click - and businesses). Google make's a lot of money out of this, but there's a quality control risk for the user if they go with a sponsored link rather than one which answers their specific search question in detail and with authority. Searching via groups is especially successful when you're looking for niche information, such as much of what is to be found on EoS.

In summary, I believe that if you forbid links in the EoS forums the forums may ultimately suffer for a lack of content, but I am a firm believer that you should limit the font size of signatures. Providing the poster is writing good copy there's simply no need for them to use an oversized font or lurid graphics in their signature......in practice everybody knows that such a signature is really an advert

Gosh, everywhere I look on this forum there seems to be a plethora of extra large bold font....and with the addition of green highlight it's very hard on the eye!

The issue of a license may become a problem for you in the future, but only if your activities come to the attention of the local authorities. This usually only happens if somebody denounces you, so the best thing is to keep your neighbours happy and your head down.

The authorities have started to look more closely at foreign owned properties which are being let (holiday lets). I believe that their main focus has been on websites advertising holiday rentals. Best to declare the income you're receiving it, and pay the tax, then you'll take away the worry.

As you say, it's relatively easy for the Spanish tax man to track down property owners who evade taxes, and I can tell you from professional experience that the local tax offices have really tightened up procedures and practice.
