Weve just had word back from our solicitor, that after numerous requests Huma are refusing to pay back our deposit of 35K,

and that we will now have to go to court, at a further cost of approx £7,000!!!.

We were promised and never received a bank guarantee, anyone else in same position?

If we go to court how certain can we be that they will have to pay?

Any advice?????

Your lawyer has to give you advice but £7000 to go to court looks expensive and you should question this

the storey is that Huma have now stopped making voluntary refunds because they expect a decision very soon.....now being commercial

They must have offered you alternatives:- MCC swop at 10 % below their current price and ready now or Tabernas at a discount

Quite a few have taken the MCC option because they want Spain now

If not then perhaps your lawyer is not up front with you!

Face to face seems to have produced some good results for many...may be worth a trip over  to see Huma....take your recorder!!!  

Some lawyers want class actions to make money but not all....I am told

Nothing criminal about it I'm afraid, BP.  People believe that Huma are in breach of contract and, therefore, should return their money; Huma, apparently, believe the opposite - it's up to the courts to decide (and, going by some of the recent rulings that have been handed down by the Spanish Courts, I wouldn't like to bet one way or the other )

what recent ruleings are these then, ? can you explaine a little more as to what the courts are comeing up with, as to the 6% and compensation,
