Does anyone have the contact details for Maria de Castro since we have been told she is quite successful in getting peoples money back.
We have been told yesterday by the developer that our final occupancy license will not be available until May-June 2008 on Arenal Duquesa.(1st Phase - Block 15). We paid our 1st stage payment in Feb 2005!
Our solicitor has said we have the right to ask for our money back plus 10% compensation (clause in our Private Purchase Contract) since they have not completed by October 2006!! He says it could take up to 2 years in court and cost money!
Your feedback would be much appreciated

Jeff, we are in the same position.

Have you officially cancelled and asked for your deposit to be refunded ?

If you havn't you need to do this immediately through your solictor - do it through registered post and get confirmation from Arenal that they have received it.

Then, even if the Licence comes through in the meantime, you are on safe ground, you have effectively cancelled.

As regards the refund, that is in the lap of the gods. We are expecting ours sometime this year (we cancelled Dec 07), there doesn't seem to be much rhyme or reason but I would be suprised if it came through in less than 6 months. Rejoice though, think of all the developments where you would have no chance even if you did go through the courts.

Although Arenal come in for a lot of stick they have played the game honourably on refunds, so you will just have to wait.

Do not under any circumstances take this through court, you will die a slow painful and costly death.

We have had to "bridge" for our refund and it will cost us money, but at least we can expect the deposit  to come in.

Jeff, the developer is paying cancellations on the basis of the return of your deposit plus legal interest and this averages out to something like 4%-5%. Depending on the effectiveness of your lawyer this is usually paid within 3 months. You are entitled to 10% compensation but the developer refuses to pay this and knows you will have to take them to court and indeed this could take a couple of years to resolve.
