Just got back from another trip to spain to see how things are progressing.  As expected no progress on site.  Parador still very elusive although very optomistic about work starting 'any day now'!!!

Have dicided to buy at Desert Springs in the mean time as I would like to use my property this side of my retirement (currently 40 - not planning on retirement before 55!).

Yes there is quite a price difference but that is the price of having all the full licences before taking peoples money or starting to build!

I have spoken to an independent solicicitor who was recomended by several people who already own property in spain.  This solicitor has a couple of clients at ACC and advised them not to buy there due to a problem with the licences - they bought anyway despite the advice - we all know the current position.

This solicitor still believes that the final licence has still to be granted and there is no date as to when the meeting is planned to discuss the final licence therefore no date as to when this will be agreed and in turn no idea as to when a date for work to start again on site!

Sorry to be so negative and cynical but parador just do not know the full story or more likely just are not telling the truth.

Am planning another visit at Christmas so will have some more news then, however I will be in contact with some friends in spain who are keeping their ears open for any news or progress.

hi there, can u tell me what happens to the 3.000 deposit we all paid.   I paid mine in September 2005, however I was lucky to get my 40,000 back before I got rid of my spanish solicitor for lying to me, and worldwide property for pretending they didnt know what was going on.  At the moment I have no solicitor and I dont know how to go about getting the 3,000 back.   Any help would be appreciated.  Thanks

Did you pay your 3000 euro deposit with a CREDIT CARD ?

Most credit cards are covered with a guarantee/insurance in some situations where transactions are "allegedly dodgy".

Might be worth checking with your card issuer of the terms  under which you might secure a refund though them.

I cannot claim this to be an original thought as I read this suggetion somewhere recently but can't remember where.

If you take this route perhaps you will be kind enough to let us all know how you get on.

I paid worldwide properties/parador by cheque before I went out on an inspection visit, and according to them this was passed to the spanish builder.   This was in September 2005.

I followed up on the credit card  idea with my bank but unfortunately it is only a short term solution in that the guarantee is only valid for six weeks following purchase of goods or services...ah well just a thought... no use to you anyway as I note you paid by cheque.

You will probably be ignored by the developer without a good litigation lawyer to hold your hand for you to even stand a glimmer of hope in seeing some of your 3000euro again ...sorry..just my thoughts.

I asked about the stage payment(s) because:  If you had paid it to Huma, and they subsequently refunded it, then you have a case for the return of your deposit.  But, if agent/solicitor held on to it and returned it to you when you decided to cancel the contract, then, as Harvey states, you are going to need a good litigation lawer to stand any chance of getting the deposit returned - IMHO, Huma will contend that it was you who broke the contract.

Hi Tracy

The builder still has our 3000 euros.  Our original solicitor was very honest about the chance of receiving this back - very unlikely even if Huma breach thier contract with us as it says in the small print somewhere that this is a non refundable deposit.  Even if we were to get it back there would be little compensation as the compensation due is a very low % of money with the builder - which is only 3000 euros.

I am leaving my deposit with the builder and just waiting to see what happens.  If the complex goes ahead then I may continue or maybe sell on the contract, but I am just going to sit tight and hope that every thing pans out.

If the complex does go ahead (as everyone believes) then we are in a good position as this current problem with building licences and the future restriction on further building will only enhance the value and demand of property on ACC - well thats what i think, no guarantees though.
